21. Programme description, undertaking, code of conduct draft


Job Guarantee A Letter of intent (LOI) for recruiting the student will be provided either through iWare Logic Technologies Pvt. Ltd. or Vyom Labs Pvt. Ltd. to work as a consultant or business analyst (ERP or Oracle Apps or ITIL\ ITSM) as per the students specialization upon successful completion of the program. a. Successful completion definition b. Attendance 90% attendance is compulsory during the training duration. Student will need to mark the Attendance regularly in the attendance register provided by VishvaVidya. The attendance will be audited anytime by VishvaVidya management. If the student is not able to complete the minimum required attendance (of 90%) in such case the job guarantee and additional placement assistance will be at the discretion of VishvaVidya. If the student gets a job during the program itself he may not be able to complete the minimum required attendance (of 90%) in such case the job guarantee and additional placement assistance will be at discretion of VishvaVidya. c. Evaluation Tests Regular evaluation tests will be conducted and feedback provided to students to understand the progress and improvement required if any. d. Final Exam Final exam may consist of online test, written exam and practical exams on any or all topics covered in the programme. Passing percentage will be 60%. i. If a student fails in the exam he will have to reappear for the exam. The next attempt of exam can be taken only after 1 month of the previous attempt. To reappear in the second attempt of exam additional exam fees of Rs 1000 per subject will have to be paid by the student. Placement assistance On successful completion of the program, VishvaVidya will, in addition to providing an assured job with iWare Logic or Vyom Labs; will also provide additional placement assistance with other companies. If the student gets a job offer form some other organization he should inform VishvaVidya his preference of which job offer he wants to accept (with iWare Logic / Vyom Labs or any other job offer if he would have received) Passport All students must have a valid passport before completion of 6 months from start of the program to be eligible for the industry internship or the placement assistance. If the students do not provide a valid passport details to VishvaVidya, the industry internship and or the placement assistance will be at the discretion of VishvaVidya. Passport is mandatory because of the global nature of businesses and students may have to travel anytime for business meeting and or work purpose. Post Job Placement After getting the job placement the student will abide by the rules and regulation of the company where they will accept the job offer. Dress code Students should wear formal clothing in the institute premises. Mobile Usage Student should keep their mobile in silent mode in the institute premises.

Global Certifications VishvaVidya, in addition to the above mentioned management programmes may also help students prepare for some global professional certifications. The certification exam will be optional to the students. If the students decide to take these exams the exam fees of these certifications needs to be paid by the students directly to the examination authority for such professional exams. The VishvaVidya assumes no liability of any kind to any person for providing this information, whether or not such person rely on it and even it they inform the VishvaVidya of their reliance on it. Enrollment Agreement: The Application for Enrollment is the Enrollment Agreement (hereinafter referred to as the Agreement) between the applicant who wishes to enroll on flexible mode and the VishvaVidya. Entire Agreement: This Agreement constitutes and expresses the entire agreement and understanding between the VishvaVidya and the students of the VishvaVidya in reference to all matters herein referred to, all previous discussions, promises, representations and understandings relative thereto, if any had between the parties hereto, being herein merged. Interpretation: The masculine, feminine or neuter gender and the singular or plural number shall be deemed to include the other gender or number where the context so indicates or requires. Unless otherwise expressly provided, references to days, months or years are to calendar days, months or years. Person or persons include individuals, corporations, government agencies or other entities. Section heading are included for convenience only and are not to used construe or interpret this Agreement. Conclusion of the Agreement: The Agreement is irrevocably concluded after the applicant signs the agreement for and submits it along with the required amount, physically, electronically or otherwise. No Third Party Beneficiaries: Enrollment of any student into the VishvaVidya programmes, shall not entitle any person (including, without limitation, members) to any right as third party beneficiary. Balance of Dues: The liability of the student to pay the balance of dues continues until the last installment is cleared even if the student, for any reason, withdraws form/ discontinues the pursuit of the program. Wherever student have arrears of payment, they may not be permitted to write the examinations or their examination results may not be released and their mark sheets, pass certificates may not be issued; further such students will be considered as inactive on the rolls and their names are liable to be removed from the records. No Obligation to Services, etc: The VishvaVidya has no obligation to render any services to the student members beyond the period of validity of enrollment. To clarify further, no obligation of the VishvaVidya shall survive beyond the period of validity of enrollment. Limitation of Liability: The liability of the VishvaVidya towards the students is limited only to the extent the fees paid by them. To clarify further, the VishvaVidya shall not be liable to the students for punitive, exemplary, special, indirect, or consequential damages, including without limitation, and for loss of profits. Assignment: The students cannot assign this Agreement nor any parts thereof the VishvaVidya may, without necessity of students consent, assign its rights and obligations under this Agreement to a successor organization. Force Majeure: The VishvaVidya shall not be liable for delay or failure in performance of any of its obligations under the Agreement when such delay or failure arises from events or circumstances beyond reasonable control of the VishvaVidya (including without limitation, acts of God, fire, flood, war, explosion, sabotage, terrorism, embargo, civil commotion, acts or omissions of any government entity, supplier delays, decision of the VishvaVidya, decisions of the court and governments, communications or power failure, equipment or software malfunction, or labor disputes).

Indemnity: A student agrees to indemnify, defend and hold the VishvaVidya harmless from and against any and all loss, damage, liability and expense (including reasonable attorneys fees and costs) arising out of any third party claim, action or proceeding based directly or indirectly on the acts of omission and commission by the member or his/ her agents, the breach or alleged breach or failure to comply with any applicable law or regulations, concerning the practice of profession of management and IT. Arbitration: All disputes relation to or arising out of this Agreement shall be settled by first track arbitration of a sole arbitrator, to be appointed by VishvaVidya and the arbitration proceeding will be conducted under the Arbitration and Conciliation Act, 1996. The award of the sole arbitrator will be final and binding on the parties. Subject to that, the courts of Pune only will have jurisdiction in all matters arising out of this Agreement.
