Dear Mr. Ohlrich: Per my telephone conversation with your office, this is to inform the Court that Ron Chapman, M.D., M.P.H., has been appointed Director of the California Department of Public Health, and that he assumed the duties of that office on June 13, 2011. Dr. Mark B. Horton formerly held this office and was named as a defendant in the underlying federal case in his official capacity. I notified counsel for the parties of Dr. Chapman's succession to the office of the Director of the California Department of Public Health, and asked if there was any opposition to his substitution in this case, in his official capacity.
