RE: THE “AUSTRALIAN VACCINATION NETWORK” AND ITS CHARITY LICENCE

I refer to my letter to you dated 27 January 2010 in which I enclosed 3 documents, 1 showing that
the “Australian Vaccination Network Inc (AVN) and its President, Ms Meryl Dorey had for 3 years and
8 months engaged in several frauds and breaches of the Charitable Fundraising Act 1991.

Since I wrote to you drawing your attention to these frauds, another breach of the Act has been
detected. That is outlined in Annex 1 to this letter. Also in Annex 1 I recommend that you, the
responsible Minister, cancel any and all fundraising authorities that the AVN hold.

Since I wrote, other news that has come to light regarding the AVN is that, according to its electronic
newsletter dated 22 February 2010, “telephone and email support in regards to vaccination
questions will only be available to financial members of the AVN.” In other words, the AVN is now
operating as a purely commercial operation, and refusing to assist general members of the public
who call for assistance and advice. Surely this proves that the AVN does not meet the definition of a
“charity” as defined in the Act.

Finally, I ask you to note that, more than 6 weeks after I wrote to you, I have not received any
response from your office or the relevant Department.

Document 1, dated 14 August 2009, to the Manager Investigations of Charities Office at the Office Of Liquor
Gaming and Racing, (OLGR) raises my concerns that the “Australian Vaccination Network”, (AVN), is no charity,
as defined in the Charitable Fundraising Act of 1991. I recommended that the AVN be investigated.

Document 2, dated 15 October 2009, is the response from the Acting Manager, Charities Investigations,
rejecting my claims and recommendations. It is clear that no investigation was conducted into the AVN.

Document 3, dated 27 January, is my report of what I found relating to the fraudulent activities of the AVN.
ANNEX 1.

REPORT: THE AUSTRALIAN VACCINATION NETWORK’S DONATION DANCE

In August 2008 the Australian Vaccination Network (AVN) set up a “Fighting Fund” 1 to help
a family who had refused to allow their newborn child to be vaccinated against Hepatitis B,
against hospital advice. The mother had tested positive for Hep B and the baby was at great
risk of contracting this life-threatening disease. The President of the AVN, Ms Meryl Dorey,
admits in the attached documents that the AVN assisted the family who were evading DOCS
and the police who were attempting to ensure that a Supreme Court Order was complied
with.

One month later, in September 2008, this appeared in an AVN/Living Wisdom E-newsletter: 2

“We understand that these donations were sent to the AVN for the purpose of
helping these two families in distress and the many other families who either now or
in the future may face a similar situation. We also know that many of you have been
thinking – and rightly so – that if this sort of discrimination could happen to these
families, it could happen to any one of us as well.

“With this in mind, it is vital that the AVN stay open for business and in a strong
enough position to help any other families faced with something like this. Currently
the AVN is facing the serious prospect of having to close because of financial
constraints. We therefore ask that if you have donated funds to our legal Fighting
Fund in recent times, you consider allowing us to use a portion of that donation for
our day to day running expenses and to pay some outstanding debts. If you have
made such a donation to the Fighting Fund and would rather it remains there to be
used only to pay the legal expenses of families fighting this discrimination, please let
us know either by telephoning or email. If you did make a donation but we haven’t
heard from you by 7th October 2008 about this matter, we will assume that you
have no objection to the AVN utilising your contribution for the administrative and
operational purposes of the AVN and the Living Wisdom magazine.” (My
emphasis.)

So, donations for a particular cause, (assisting a family to evade a vaccine intended for a
child at significant risk of Hep B) were siphoned off into paying the running costs of the AVN
and to support the production of the “Living Wisdom” magazine, (entirely a commercial
operation), without the express approval of those who donated.

Note that no accounts relating to this appeal, audited or otherwise, have ever surfaced.
I recommend that:

1. You, the Minister, order the OLGR to conduct an investigation into this appeal, pursuant
to the Charitable Fundraising Act 1991 Division 1 S26 with a view to determining how much
money was raised and where it went, and whether it was used, or purported to be used, to
endanger the life of a newborn baby and to evade DOCS and the Police attempting to serve
a Supreme Court order.

2. You, the Minister, pursuant to the Charitable Fundraising Act 1991 Division 2 S31, acting
in the public interest, revoke any and all fundraising authorities that the AVN hold, being
satisfied that the AVN, which, by their own admission in writing:

1. blatantly subverted Government Health Policy and hospital advice, and


2. endangered the life of a newborn baby, and
3. assisted people to evade the Department Of Community Services and the Police and
who refused to comply with a Supreme Court Order.

It is clear that the cancelling of the AVN’s charitable fundraising authority would meet any
of the requirements in the Act which are that:

“(a) that any fundraising appeal conducted by the holder of the authority has not been
conducted in good faith for charitable purposes, or
(b) that any of the persons who have conducted a fundraising appeal by virtue of the
authority, or any persons associated with any such appeal, are not fit and proper
persons to administer, or to be associated with, a fundraising appeal for charitable
purposes, or
(c) that any fundraising appeal conducted by virtue of the authority has been
improperly administered, or
(d) that, in connection with any fundraising appeal conducted by virtue of the
authority, the provisions of this Act or the regulations or the conditions of the
authority were not complied with by any person conducting or participating in the
appeal, or
(f) that, in the public interest, the authority should be revoked.”

This family is homeless, scared and have a 3 day old baby and 3 year
old child who have 2 seriously stressed-out and now unemployed
parents. They need safe places to stay (hotels probably) which cost
money as well as food, clothing (everything they had is in their unit
which they can't get to right now) and things for their baby.

Many of you - both in Australia and overseas - have been asking what
you can do to help this family which is fantastic! We are currently in
the process of setting up a fund to raise money to both help this
family to survive and to establish a legal fund for their defence. Let
me assure you that their defence is YOUR defence because even blind
Freddy would be able to see the precedent being set here. If this
family is forced to vaccinate their child - so will you be. It is the thin
end of the wedge that started with the forced vaccination of health
staff who unfortunately have been too disorganised, disempowered

do to fight for their children? The government needs to know that we

RE: THE “AUSTRALIAN VACCINATION NETWORK” AND ITS CHARITY LICENCE

I refer to the attached 3 documents.

Document 1, dated 14 August 2009, to the Manager Investigations of Charities Office at the
Office Of Liquor Gaming and Racing, (OLGR) raises my concerns that the “Australian
Vaccination Network”, (AVN), is no charity, as defined in the Charitable Fundraising Act of
1991. I recommended that the AVN be investigated.

Document 2, dated 15 October 2009, is the response from the Acting Manager, Charities
Investigations, rejecting my claims and recommendations. It is clear that no investigation
was conducted into the AVN.

Document 3, dated 27 January, is my report of what I found relating to the activities of the
AVN. Briefly, I found using publicly available documents, that the Australian Vaccination
Network Inc (AVN) and its President, Ms Meryl Dorey have for 3 years and 8 months:

1. appealed for donations to pay for Bounty Bag i inserts when:

2. there was no arrangement with the company, and

3. there never could be, and

4. the AVN appealed for money to establish a vaccine testing facility while this was
not a realistic possibility, and

5. during that time raised about $308,000 in donations for those purposes, and
6. never spent a cent of that on Bounty Bags or vaccine testing, and

7. the AVN operated as a charity but without a charity licence for 2 of those years,
and

8. in spite of being informed by Bounty Bags that there was no arrangement with the
AVN, the AVN continue to conduct this appeal to this day.

So the AVN for many years operated in breach of the Charitable Fundraising Act 1991 - Sect
20 and nobody noticed. (The Section says: “Any money or benefit received in the course of a
fundraising appeal conducted by the holder of an authority is to be applied according to the
objects or purposes represented by or on behalf of the persons conducting the appeal as the
purposes or objects of the appeal.”

Furthermore, the Charitable Fundraising Act 1991 Sect 24 requires the AVN to have their
accounts audited annually. A glance at the accounts presented to the Office of Fair Trading
(in Document 3) for the years 2007 and 2008 shows that the accounts were not audited.
Was this detected by the OLGR and it not, why not? The accounts for the year 2006 do not
show any donations, yet we know that the AVN conducted fundraising appeals then. Why
did the auditor not comment on that? The AGM for the year 2006 was held on 29 August
2008, 19 months late. Did this raise any concern within the OLGR?

In summary, the OLGR have failed to respond to legitimate concerns that the AVN was
misusing its charity licence, allowed the AVN to conduct appeals for donations for 2 years
without a charity licence, then issued a charity licence and backdated it for those 2 years,
and have failed to detect fraud and failures to comply with the relevant legislation.

Minister, there has been a breakdown of public administration in your department. I urge
you to instigate a full investigation into the so-called “charitable” activities of the AVN and
its President, Ms Meryl Dorey, and why your department failed to detect any breaches of
relevant legislation.

RE: THE “AUSTRALIAN VACCINATION NETWORK” (AVN).

I refer to the charitable fundraising licence number 11694 held by the AVN.

I wish to raise the concerns that I and many others have about the so-called “charity” status
held by the AVN. To put it briefly, the AVN is no charity, as defined by the Charitable
Fundraising Act of 1991 No 69, which says that a “charitable purpose” includes “any
benevolent, philanthropic or patriotic purpose.” The AVN do not concern themselves with
benevolence, philanthropy or patriotism.

Instead, the AVN and their President, Ms Meryl Dorey, have maintained a consistent anti-
vaccination campaign for over 15 years. Her writings have been roundly condemned by
experts in the field of immunology and the medical profession. Ms Dorey and the AVN have
been condemned by Nobel laureate Professor Peter Doherty, who has said that Childhood
Vaccination Denial is a “Crime Against Humanity.” Indeed she and the AVN are being
investigated by the New South Wales Health Care Complaints Commission for providing
incorrect medical advice. 1 A copy of the complaint that led to the HCCC’s investigation of
the AVN is enclosed. You may wish to contact the officer concerned at the HCCC, Ms Kristie
Brown, Health Care Complaints Commission, Locked Bag 18, Strawberry Hills NSW 2012, and
refer to complaint number 09/01695.

You should be aware that Ms Dorey has admitted on television that she has no
qualifications whatever, apart from "having a brain."

You should also be made aware that the parents of baby Dana McCaffery (who died of
Pertussis this year) have written that they are outraged that without their knowledge,
“Meryl Dorey rang the Director of the North Coast Area Health Service Public Health Unit on

12 March 2009 seeking details on Dana’s death and contended the department had misled
the public.” 2 They go on:

“Even after I told Meryl what happened to Dana at the (TV) debate, a few weeks
afterwards I found an AVN blog with members making false claims that stated they
had information she was sick from birth, immune-compromised from the HiB vaccine
or died as a result of the antibiotics or medical treatment she received.

“Not only is no-one privy to this information, it is wrong and extremely distressing. In
the latest Living Wisdom, Meryl got every fact wrong about Dana - her age, when she
died, where she might have caught it, when the last death was and uses language to
downplay the seriousness.”

So, Meryl Dorey and the AVN are not above the most egregious invasions of privacy, they
are also quite capable of misrepresenting the facts to suit their anti-vaccination agenda,
while engaging in bizarre conspiracy theories. This was not “benevolence, philanthropy or
patriotism” at work here. Ms Dorey is not a qualified health professional and her
presentations are completely unbalanced. She is no expert and does not present good
science or a balanced view of vaccination issues. The AVN’s posture of a “charity” is a
charade and their holding of a charitable fundraising licence is a travesty. That their
activities are partly funded by taxpayers via their status as a charity is compiling parody
upon farce.

Ms Dorey’s and the AVN’s campaign against vaccination has led to a significant drop in
vaccination rates and consequently the deaths of children, for example three children have
died this year from Pertussis, (Whooping Cough).

But it gets worse. On her “No Compulsory Vaccination” blog 3 Meryl Dorey posted an
article titled “Flu is not the Biggest Danger it’s the Vaccine”, which said “we have long
crossed the line into a fully-fledged fascist dictatorship.............”and that that the
forthcoming compulsory flu vaccination program is a plot run by the Illuminati to insert
microchips in every person on the planet in order to take over the Earth. According to the
author of the article, the Illuminati are a race of reptilian humanoids and that many
prominent figures are reptilian, including George W. Bush, Queen Elizabeth II, Kris
Kristofferson, and Boxcar Willie.

I also ask you to note that the AVN has failed to comply with Charitable Fundraising
Regulation 2008 S23 (Complaint handling mechanism) in that the AVN has failed to “provide
a mechanism that will properly and effectively deal with complaints made by members of
the public”. There are many occasions where I and others have pointed out in writing
instances where the information provided by the AVN to the public have been demonstrably

wrong, yet the AVN and Ms Dorey have entirely failed to respond to our complaints. I can
provide the relevant correspondence if you wish.

I ask you to note, that by granting the licence to the AVN, the OLGR has failed to conform to
Section 3 of the Act, “Objects,” where the licensing process is supposed to prevent
“deception of members of the public who desire to support worthy causes”. As is
demonstrated here and in my complaint to the Health Care Complaints Commission, the
AVN is a most unworthy cause.

I ask to you to examine very closely your Department’s decision to grant the AVN a licence
to raise money for so-called “charitable” purposes, and on finding that the AVN’s activities
do not include benevolence, philanthropy or patriotism, cancel the licence.

I also draw your attention to S47 of the Charitable Fundraising Act 1991 No 69, “Public
access to information”, where the Minister may call for audited financial statements
concerning fundraising appeals conducted by the person or organisation concerned during
its last financial year and, previous financial years, and as in sub paragraph (b) (2), I
recommend that your Department call for audited accounts and provide me with a copy.

In Summary, I recommend that your office;

1. Investigate the AVN to determine if its activities include any benevolence, philanthropy
or patriotism; and

2. Make a determination as to whether the AVN is a charity, as defined by the Charitable


Fundraising Act of 1991 No 69; and

3. Upon finding that the AVN is not eligible for charity status, cancel licence number 11694;
and

4. Pursuant to S47 of the Charitable Fundraising Act 1991 No 69, the duly delegated officer
of the Minister call for the audited financial statements concerning fundraising appeals
conducted by the AVN and Ms Dorey over the last financial year and the previous seven
financial years;

5. Pursuant to S47 of the Charitable Fundraising Act 1991 No 69 sub paragraph (b) (2),
forward to me all the audited financial statements received from the AVN.

I refer to your letter of 14 August 2009 in which you raise several issues in relation to the Australian
Vaccination Network Inc (the Network). You effectively claim that the Network does not pursue any
charitable purpose and that therefore its current licence to fundraise, number CFN11694, should be
revoked. You also allege that the Network is in breach of authority condition 22, in that it does not
provide a mechanism that will properly and effectively deal with complaints from members of the public.
Finally you request that you be provided with the Network's audited financial statements for the last
seven years.

The Charities Unit within the NSW Office of Liquor, Gaming and Racing, a division of Communities
NSW administers and regulates the Charitable Fundraising Act 1991. This Act governs the conduct of
charitable fund raising appeals in NSW and its application does not extend beyond this.

I have reviewed the charitable status of the Network and in the course of doing so, have considered the
Network's objects as stated in its Model Rules and legal advice provided to this Office in the past by the
NSW Crown Solicitor as to what generally constitutes a charitable purpose. Pemsel's Case sets out the
four principal divisions of charity as relief of poverty, advancement of education, advancement of
religion and other purposes beneficial to the community. The Charitable Fundraising Act 1991 extends
the meaning of charitable purpose beyond the Pemsel divisions to include any benevolent,
philanthropic and patriotic purpose. I have also taken note of the fact that there is no legal requirement
in NSW for parents to immunise their children and that there is a vigorous debate in the community
surrounding the immunisation issue.

After considering the above, I am satisfied that the Network does pursue a charitable purpose in that
one of its primary aim is the advancement and promotion of education and learning amongst the public
about all matters concerning human health and physical and social well-being. Accordingly, I do not
intend to take any action to revoke the Network's licence to fundraise, on the basis that it does not
pursue a charitable purpose.

Authority condition 22 attached to the Network's authority to fundraise requires that it provide a
mechanism that will properly and effectively deal with complaints from members of the public and
grievances from employees, but only in relation to its fund raising activities.

The Network does not have such a mechanism in place. I accept however that this breach of authority
condition was inadvertent and due to ignorance of legislative requirements. The Network has
undertaken to implement such a mechanism as soon as possible and in light of this I do not propose to
take any further action in relation to this matter at this stage.

Finally, section 47 of the Charitable Fundraising Act 1991 in conjunction with clause 13 of the
Charitable Fundraising Regulation 2008 imposes an obligation on the Network to provide you with a
copy of the last seven years audited financial accounts within 30 days of you requesting them. Failure
to do so may constitute an offence under section 47(1) of the Act, with a maximum penalty of a $550.00
fine. The Network is entitled to charge you a maximum fee of $13.00 for the first page and $1.00 for
each successive page.

Section 47 of the Act also states that this Office on behalf of the Minister may provide this
documentation to you. This discretion is generally only exercised when an organisation itself has failed
to provide the requested documents. Accordingly, you should apply directly to the Network for the last
seven years audited accounts and if they are not provided to you within 30 days of your application, you
may request them from us and they will be provided upon payment of the appropriate fee.

1. EXECUTIVE SUMMARY

The Australian Vaccination Network Inc (AVN) and its President, Ms Meryl Dorey have for 3

6. never spent a cent of that on Bounty Bags or vaccine testing, and

7. the AVN operated as a charity but without a charity licence for 2 of those years,
and

8. in spite of being informed by Bounty Bags that there was no arrangement with
the AVN, the AVN continue to conduct this appeal to this day.

2. BACKGROUND – WHO IS THE AUSTRALIAN VACCINATION NETWORK?

The AVN is a very active anti-vaccination lobby group who freely dispense information and
advice on diseases and vaccinations. The AVN’s activities include publishing brochures and a
magazine “Living Wisdom”, a quarterly newsletter “The Inside Edition,” a website, email
newsletters, public meetings and seminars, Internet Web Seminars, production and sale of
videos DVDs and CDs, web logs, (blogs), internet discussion groups, and appearances on
radio and television. In all of these, AVN President and Public Officer Ms Meryl Dorey
features very prominently. The AVN’s magazine “Living Wisdom” claimed to have a
circulation of over 2,500 to subscribers and 5,000 via newsagents, but has been replaced by
an on-line version for which circulation figures are not available.

The AVN is registered with the Australian Securities and Investment Commission as a
business with the ARBN of 30 077 002 923.

The AVN is registered with the NSW Office Of Liquor Gaming and Racing as a charity for
fundraising purposes with licence number 11694.

The AVN was first registered in 1994 with the NSW office Of Fair Trading as an Incorporated
Association with the registration number 20791 27, (under its original title of “The
Australian Council For Immunization Information”).

Their postal address is listed as PO Box 177, BANGALOW NSW 2479, near Byron Bay.

The Public Officer is listed by the Office of Fair Trading as MERYL DOREY. The public face
and spokesperson of the AVN is Meryl Dorey. The President is Meryl Dorey.

Documents filed with ASIC list the directors as Meryl Dorey, Melissa Begg, Michael Francis
Stacey, Molly Knight, and Grant Touzel.

The AVN says that its Mission Statement is:

“The AVN, publisher of Informed Voice magazine, is dedicated to the idea that health can be
achieved and maintained without the use of pharmaceutical drugs and vaccines. “ 1

The AVN maintains a consistent anti-vaccination pro-homeopathy stance in all its


publications and public appearances.

3. WHAT ARE BOUNTY BAGS?

Bounty Bags are a division of ACP Magazines; they give to mothers of new-born babies a gift
pack which “contains a variety of products and leaflets,” 2 , such as:

“products and information associated with reputable companies in the baby market,
including many Government departments who choose the Bounty distribution for their
health promotion campaigns. We currently distribute information on behalf of the NSW
Ambulance Service and also a Department of Health and Ageing DVD called ‘Living with
Water’ a new drowning prevention initiative.” 3

Bounty Bags claim that they are “Exclusively distributed to over 90% of new mothers.”

4. THE NATURE OF THE FRAUD COMMITTED BY THE AVN AND MS DOREY

4.1. The appeal for donations: In many of the AVN publications, since as early as May 29,
2006, 4 the President of the AVN, Ms Meryl Dorey has appealed for donations saying:

“What your donation will go towards-

• Lobbying Federal Parliment (sic) for changes to legislation, taking away the
need for parents to see doctors in order to register as conscientious objectors to
vaccination.
• Ability to offer our services and our magazine in the Bounty Bag which is
given to every woman who births in hospital. (My emphasis.)
• Ability to proceed with our plans to have all currently licensed childhood
and adult vaccines tested for the presence of mercury, lead and other heavy
metals. (My emphasis.)
• Cover the costs of our 1800 number, 1800 007 468, which allows parents and
health professionals to report vaccine reactions.”

The Internet Archive shows that this appeal has appeared on the AVN’s website since 3
February 2007. 5 The same appeal appears in Meryl Dorey’s emails, in the AVN magazine
“Living Wisdom” and the AVN HPV brochure attached. 6 This appeal remains on the AVN
website today, 27 January 2010, as the screen capture below shows.

4.2. Bounty Bag inserts: However, as the attached correspondence (dated 9 November
2009) 7 from Bounty Bags shows, there never was any arrangement with Bounty Bags to
“offer our (AVN) services and our magazine in the Bounty Bag which is given to every woman
who births in hospital.”, because

Bounty Bags says that the Company:

“has worked hard over the years to comply with the National Health and Medical
Research Council guidelines and WHO guidelines for the protection and promotion of
Breastfeeding. The Bounty Bags only contain information in support of immunisation;
for example, a current immunisation schedule, sponsored by Panadol is included in
every Bounty New Mother Bag.”

As can be seen in the attached letter from Megan Baker Bounty Hospitals Manager to Dr
Kerwyn Foo, Staff Specialist Oncologist at Wollongong Hospital, Bounty has:

“no knowledge of the AVN magazine or the information contained on their


website.”, (their emphasis) and “Bounty would not consider promoting this kind of
information,” (ie AVN publications.)

MS Baker goes on:

“Bounty only carries products and information associated with reputable companies
in the baby market, including many Government departments who choose the
Bounty distribution for their health promotion campaigns. We currently distribute
information on behalf of the NSW Ambulance Service and also a Department of
Health and Ageing DVD called ‘Living with Water’ a new drowning prevention
initiative.”

So, Meryl Dorey and the AVN have been appealing for donations to pay for their
publications to go into Bounty Bags since at least May 29, 2006, when there was no such
arrangement, and according to the Company, never could be, and they continue to make
that appeal.

4.3. Vaccine Testing. Moving right along, the AVN in those fund-raising appeals, asked for
donations to give them the:

“Ability to proceed with our plans to have all currently licensed childhood and adult
vaccines tested for the presence of mercury, lead and other heavy metals.”

A quick glance at the AVN’s annual financial statements shows that over the 3 years 8
months that this claim has been made, the organisation made no efforts to develop the
facilities and expertise required for such a scientific enterprise, or to conduct such testing
through outside contract pathology laboratories. It is highly unlikely that this was ever a
possibility. Such laboratories and procedures are expensive, (well into the tens of

thousands of dollars), and require expertise at a PhD level, while Meryl Dorey has no
qualifications whatever.

4.4. In Summary, these fundraising appeals, to pay for Bounty Bag inserts and pathology
testing facilities appear to be clear breaches of the NSW CRIMES ACT 1900:

“178BA Obtaining money etc by deception

(1) Whosoever by any deception dishonestly obtains for himself or herself or another
person any money or valuable thing or any financial advantage of any kind
whatsoever shall be liable to imprisonment for 5 years.

(2) In subsection (1):

"deception" means deception (whether deliberate or reckless) by words or conduct as


to fact or as to law ....”

5. THE AVN WAS APPEALING FOR DONATIONS WHEN THEIR CHARITY LICENCE HAD
EXPIRED.

The AVN’s Charity Licence was valid from 5 July 2002 until 4 July 2007, 8 and was not
renewed until 29 May 2009, 9 when prominent Australian Skeptic Peter Bowditch informed
the AVN that the licence had expired. 10 This means therefore that the AVN had run the
appeals for donations continuously for nearly two years without the appropriate Charity
Licence. This appears to be a breach of the Charitable Fundraising Act 1991:

“Part 2 – Fundraising appeals

Division 1 – Offences

9 Conducting unlawful fundraising

(1) A person who conducts a fundraising appeal is guilty of an offence unless the person:

(a) is the holder of an authority authorising the person to conduct the appeal, or

(b) is a member of an organisation, or an employee or agent of a person or organisation,


that holds such an authority and is authorised, by the person or organisation that holds the
authority, to conduct the appeal, or

(c) is authorised under subsection (3) to conduct the appeal without an authority.”

The Charitable Fundraising Act 1991 does not empower the OLGR to issue charity licences
retrospectively. In this case, this is exactly what was done: the AVN’s Charity licence was
issued on 29 May 2009 and backdated to 4 July 2007, to cover the period during which the
AVN appealed for donations while not holding a charity licence. Why was that?

6. THE AVN HAS NOT APPLIED THE FUNDS RAISED TO THE PURPOSE REPRESENTED IN THE
APPEALS.

“Division 3 – Application of funds raised

“20 Proceeds of appeal

“(1) Any money or benefit received in the course of a fundraising appeal conducted by the
holder of an authority is to be applied according to the objects or purposes represented by or
on behalf of the persons conducting the appeal as the purposes or objects of the appeal.”

7. THE SIZE OF THE FRAUD: HOW MANY DOLLARS WERE RAISED?

The AVN’s annual reports for the years 2006, 2007, and 2008 are attached. 11 They show the
following donations:

A breakdown of how much was donated purely in response to appeals to pay for Bounty
Bags and vaccine testing is not shown, but by averaging the annual donations for years 2007
and 2008, (to give a figure of $82,297.31 pa), and applying that to years 2006 (pro rata) and
2009, we can estimate total donations accumulated during this appeal to be roughly around
$308,614.91. Note that this appeal continues to this day on the AVN website
http://www.avn.org.au/donation.html.

8. OTHER ISSUES

The public rightly expects that donations are received and properly accounted for in an
organisation that complies with all laws and regulations. Clearly the public’s expectations
are not met here; for examples see:

- the complete omission of the amount raised via donations in year 2006, and

- the holding of the AGM for the year 2006 on 29 August 2008, 19 months later. (The Act
requires AGMs to be held within 6 months of the end of the organisation’s financial year.)

- the absence of any accounting for money supposedly spent in response to appeals.

9. CONCLUSIONS

It seems clear that the AVN and Ms Dorey have for 3 years 8 months:

1, appealed for donations to pay for Bounty Bag inserts when:

2, there was no arrangement with the company, and

3, there never could be, and

4, the AVN appealed for money to establish a vaccine testing facility while this was
not a realistic possibility, and

5, during that time raised about $308,614.91 in donations for those purposes, and

6, never spent a cent of that on Bounty Bags or vaccine testing, and

7, consequently have breached NSW CRIMES ACT 1900, S178BA, and

8, the AVN operated as a charity but without a charity licence for 2 of those years,
and

9, consequently have breached the CHARITABLE FUNDRAISING ACT 1991, and

10, failed to properly account for donations, and failed to hold an AGM within 6
months of the end of their financial year, and so

11, consequently have breached the ASSOCIATIONS INCORPORATION ACT 1984 and
CHARITABLE FUNDRAISING ACT 1991, and

12, in spite of being informed by Bounty Bags that there was no arrangement with
the AVN, the AVN and Ms Dorey continue to conduct this appeal to this day.

10. RECOMMENDATIONS:

I recommend that the AVN and Ms Dorey be subjected to a full investigation and audit into
the circumstances of the AVN’s and Ms Dorey’s appeals for donations with Terms of
Reference being:

1. Did the AVN and Mrs Dorey appeal for donations under the guise of using those
donations for Bounty Bag inserts and vaccine testing?

2. Over what period of time were those appeals conducted?

3. Was there ever any realistic probability that the AVN and Mrs Dorey could
arrange for Bounty Bag inserts and vaccine testing or a pathology laboratory?

4. Is the AVN an appropriate organisation to hold a Charity Licence?

5. Why was the AVN’s Charity licence issued on 29 May 2009 and backdated to 4
July 2007?

6. Did the AVN appeal for donations during the period 4 July 2007 to 29 May 2009
while not holding a charity licence?

7. Is there prima facie evidence that the AVN and Mrs Dorey have contravened the
NSW CRIMES ACT 1900 S178BA, the CHARITABLE FUNDRAISING ACT 1991 and
the CHARITABLE FUNDRAISING ACT 1991 ?

8. Exactly how much was donated in response to this appeal and where did it go?

Dear Dr Foo

Thank you for your correspondence alerting Bounty to the Australian Vaccination
Network website. We were extremely concerned to note the reference to Bounty
on this website as we have no dealings with this organisation and would never
endorse any group which sought to defy NH&MRC recommendations. We have
no knowledge of the AVN magazine or the information contained on
their website.

Bounty has worked hard over the years to comply with the National Health and
Medical Research Council guidelines and WHO guidelines for the protection and
promotion of Breastfeeding. The Bounty Bags only contain information in support
of immunisation; for example, a current immunisation schedule, sponsored by
Panadol is included in every Bounty New Mother Bag.

Bounty only carries products and information associated with reputable


companies in the baby market, including many Government departments who
choose the Bounty distribution for their health promotion campaigns. We
currently distribute information on behalf of the NSW Ambulance Service and
also a Department of Health and Ageing DVD called ‘Living with Water’ a new
drowning prevention initiative.

We appreciate you raising the issue as we were unaware of the AVN website.
Bounty will contact the Australian Vaccination Network to ensure that the Bounty
reference is removed from the site ASAP as it wrongfully implies collaboration
between the two organisations.

Please reassure your colleagues that Bounty would not consider promoting this

many members we have. We currently have just over 2000 members. And to add
up all of the money and divide it by the number of members. If I do that, it
comes out to $260 per year per member or just over $21 a month.

So - for less than the cost of sponsoring a child who is overseas, you can
actually help support Australian children right here at home. Can you please
$21 a month for the next 12 months to help achieve these goals? Maybe you
can only pledge $5 a month - or $10? Maybe you are in a position to give $40
or $50 a month?

Whatever the case may be, please have a think about it and if you can give,
please do. If you are not yet a member, please join! We need you and God
only knows, you need us too!
