In response to several inquiries, I can confirm that City Planner David Sulkis has been placed on paid administrative leave pending investigation of a personnel matter. I have attached copies of letters regarding this matter that were presented Tuesday evening to Mr. Sulkis and to Planning and Zoning Board Chairwoman Susan Shaw. I must emphasize that this administrative leave is not punitive, but simply provides time for the investigation to occur. The city has retained independent counsel, Attorney Michael J. Dorney, to conduct the investigation. He will report his conclusions to the city when the investigation is complete. Until that time, it would be inappropriate for this department to issue further statements or comments.

As you know, I was seeking a meeting with you tomorrow on a personnel matter. You have declined that meeting, invoking Weingarten rights. This was not intended to be an investigatory interview, but in the interests of expediency we can forego the meeting. I am informing you now that a serious personnel matter has been brought to my attention. This matter will require investigation by an outside party. During the course of the investigation I am placing you on paid administrative leave. This is not a punishment but instead provides an opportunity for the investigator to complete his or her work. While on leave you will be expected to cooperate fully with the investigation, including making yourself available (with representation) for interviews. However, you will be relieved of all other duties. I anticipate that the investigation will take two weeks. The week after that you will be on vacation. We will discuss the investigations findings upon your return. If the timing changes based on what is learned we will communicate this to you.

Recently, a serious personnel matter related to David was brought to my attention. I have no choice but to have this investigated, and in the meantime, am placing David on paid administrative leave. This leave is in no way a penalty and no particular outcome is assumed from the investigation. I will be spending tomorrow figuring out how we will operate during the investigation.
