DID ESCAPE OR ATTEMPT TO ESCAPE FROM LAWFUL CUSTODY WHILE A PRISONER CONFINED IN
THE BACK SEAT OF A MARKED CLEARWATER POLICE CRUISER, OR WHILE BEING TRANSPORTED
TO OR FROM A PLACE OF CONFINEMENT OR WHILE, OR RELEASED ON FURLOUGH FROM.

ON THE ABOVE DATE AND TIME THE DEF WAS IN POLICE CUSTODY IN HANDCUFFS IN REFERENCE
TO A DISORDERLY CONDUCT CHARGE. SHORTLY AFTER THE DEF WAS SAT IN THE REAR SEAT OF
MY MARKED POLICE CRUISER, AN UNKNOWN SUSPECT OPENED THE REAR DOOR OF THE
CRUISER. THE DEF PUSHED THE DOOR OPEN AND FLED OUT OF THE VEHICLE ON FOOT. THE DEF
RAN APPROXIAMTELY 100 YARDS BEFORE HE WAS CAUGHT BY POLICE AGAIN.__~

POST MIRANDA THE DEF DID NOT WISH TO SPEAK WITH POLICE.

WITHOUT OFFERING OR DOING VIOLENCE TO THE PERSON OF THE OFFICER.

ON THE ABOVE DATE AND TIME WITNESSED THE DEF AND ANOTHER SUBJECT ENGAGED IN A PHYSICAL

ALTERCATION AT THE LOCATION ON THE SAND. MADE CONTACT WITH THE DEF AND ATTEMPTED TO |

PLACE HIM INTO HANDCUFFS FOR THE DISORDERLY CONDUCT CHARGE. THE DEF PLACED BOTH HANDS
UNDER HIS BODY WHILE HOLDING THEM TOGETHER. THE DEF CONTINUED TO DO SO EVEN AFTER HE WAS
TOLD THAT HE WAS UNDER ARREST. THE DEF WAS ULTlMATELY PLACED INTO CUSTODY.
