PETITION

Petitioner, through the undersigned counsel and before this Honorable

Court, states that:

1. That petitioner BRENDA CASAS, is of legal age, a Filipino citizen,

single and a resident of Unit 16, Crescent Condominiums, Sanciangko
Street, Cebu City, Philippines;

2. That the minor JOHN DANIEL CASAS, is a 9-year old minor and a
resident of Block 18, Phase 1, Angelville Residences, P. del Rosario Street,
Cebu City, is the child to whom guardianship is being prayed for before this
Honorable Court. Attached and made integral in this petition is a photocopy
of the minor’s birth certificate marked as Annex “A”;

3. That the mother of said minor, CHRISTINA CASAS, met an

unfortunate car accident last October 28, 2018 which caused her to lose
both her legs and is still confined in the hospital for complete recovery. She
hereby consents to the petition for guardianship over the person of the
above-named minor and for the issuance of the corresponding letters of
guardianship in favor of Ms. BRENDA CASAS;

4. That the biological father of JOHN DANIEL CASAS has already

passed away on December 23, 2017;

5. That CHRISTINA CASAS, the mother of the minor JOHN

DANIEL CASAS, is the owner of a house located at Block 18, Phase 1,

Angelville Residences, P. del Rosario Street, Cebu City and likewise the
proprietor of Axiom Enterprises, a hardware business with three (3) different
branches in Cebu City, and due to the unfortunate accident which greatly
compromised her health and ability to take care of her son, wishes to transfer
ownership over the said properties to minor JOHN DANIEL CASAS, her
only legitimate child and compulsory heir and be the subject of guardianship
as well;

6. The names, ages and residences of the relatives of the named minor
are the following:

7. Letters of guardianship over the person and properties are prayed for
by petitioner, who is the aunt of the minor (sister of minor’s father), and
with whom the minor is entrusted every time the mother of the minor is not
capable of performing her obligations due to her unfortunate health
condition and considering the fact that the father of minor has already passed
away.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed that this

Honorable Court to declare BRENDA CASAS as the legal guardian of the
minor JOHN DANIEL CASAS.

Other reliefs and remedies just and equitable under the premises are likewise
prayed for.

Sunset Subdivision, Barangay Tabunok, Talisay City after having been
sowrn to in accordance with law hereby states:

1. I am the petitioner in the above-entitled case.

2. I caused the preparation of the aforementioned petition.

3. I hereby certify that I have not commenced any other action or

proceeding involving the same issues as are now raised in the petition,
before the Supreme Court, the Court of Appeals or any other court, tribunal
or agency. To the best of my knowledge, no such action or proceeding is
pending before the Supreme Court, the Court of Appeals, or any other court,
tribunal or agency. Should I learn that a similar action or proceeding has
been filed or is pending before the Supreme Court, the Court of Appeals or
any other court, tribunal or agency, I shall personally notify this Honorable
Court of such fact within five (5) days from said notice.
