RESUMEN PRELIMINAR

La investigación tuvo como objetivo general, determinar la calidad de las sentencias

de primera y segunda instancia sobre, Desalojo por ocupación precaria según los parámetros

normativos, doctrinarios y jurisprudenciales pertinentes, en el expediente N° 32085-2014-0-

1801-JR-CI-31°, Distrito Judicial de Lima, Lima 2017. Es de tipo, cuantitativo cualitativo,

nivel exploratorio descriptivo, y diseño no experimental, retrospectivo y transversal. La

recolección de datos se realizó, de un expediente seleccionado mediante muestreo por

conveniencia, utilizando las técnicas de la observación, y el análisis de contenido, y una lista

de cotejo, validado mediante juicio de expertos. Los resultados revelaron que la calidad de la

parte expositiva, considerativa y resolutiva, pertenecientes a: la sentencia de primera

instancia fueron de rango: alta, muy alta y muy alta; y de la sentencia de segunda instancia:

baja, muy alta y alta. Se concluyó, que la calidad de las sentencias de primera y de segunda

instancia, fueron de rango muy alta y alta, respectivamente.

ABSTRACT

The general objective of the investigation was to determine the quality of the sentences of

first and second instance on, Eviction for precarious occupation according to the relevant

normative, doctrinal and jurisprudential parameters, in file No. 32085-2014-0-1801-JR-CI

-31 °, Judicial District of Lima, Lima 2017. It is of type, quantitative qualitative, descriptive

exploratory level, and non-experimental, retrospective and transversal design. Data collection

was done from a file selected by convenience sampling, using observation techniques, and

content analysis, and a checklist, validated by expert judgment. The results revealed that the

quality of the expositive, considerative and resolutive part, belonging to: the judgment of first

instance were of rank: high, very high and very high; and of the sentence of second instance:

low, very high and high. It was concluded that the quality of first and second instance

sentences was very high and high, respectively.
