As per report and records of events available in the official police blotter of

FACTS OF THE CASE:

(SHOOTING INCIDENT On or about 6:00 PM of September 06, 2015 a cellphone call
received by this Police Station from Barangay Kagawad ADOBO B. CALDERITA and reported
that a shooting incident transpired at the Dona Soledad Phase 3B Barangay Labangal General
Santos City. Upon receipt of the report, the team led by COP Cambel proceeded at the said
place and upon arrival thereat, said team together with the said Barangay kagawad saw the
victim lying with his blood identified as Tinae S. y Tungol, 35 years old, married, tricycle driver
and a resident of Dona Soledad Phase 3B Barangay Labangal General Santos City while the
suspect identified as PoliceM/Sergeant Caldero Sugnud y Ininit, 31 years old, married,
presently assigned at Makar Police Station and a resident of Dona Soledad Phase 3B Barangay
Labangal General Santos City

Entry Nr. -0320 / 15 Sept 2019 /04:00AM: Person of ADOBO B. CALDERITA appeared
this office and reported that the suspects who shot him was PoliceM/Sergeant Caldero
Sugnud y Ininit

-0320/15 Sept 2019/5:00PM: : Initial investigation disclosed/conducted that PoliceM/Sergeant

Caldero Sugnud y Ininit went to the house of Tinae S. y Tungol to advice to stop the loud
music of videoke but Tungol and his companion did not pay attention that resulted to a
misunderstanding wherein PoliceM/Sergeant Ininit said the statement “kapag di kayo tumigil,
babarilinko kayo” therefore Tinae Tungol said that he will report to the barangay but
PoliceM/Sergeant Ininit said this statement “ hindi ako natatakot! Magreklamo kayo! Walang
barangay barangay sa akin!” thus, Tinae Tungol went to barangay hall without knowing that
PoliceM/Sergeant Ininit followed him and shot Tinae Tungol in his head that caused his
instant death. PoliceM/Sergeant Ininit were arrested and recovered from his direct possession
and control is one (1) magazine loaded with 12 live ammos. The suspect was arrested and
brought at Makar Police Station together with the recovered items for proper disposition.

1. Reference Blotter Entry No. 11-0320 dated September 05 2019.

2. Please be informed that on or about 06:00 pm of this date that a shooting

incident transpired at the Dona Soledad Phase 3B Barangay Labangal General Santos City of
where in the victim was identified as Tinae S. Tungol ,35 years old, married, tricycle driver and
a resident of Dona Soledad Phase 3B Barangay Labangal General Santos City, while the at
suspect was identified as PoliceM/Sergeant Caldero Sugnud Y Ininit, 31 years old, married,
presently assigned at Makar Police Station 02 and also resident of the place

3. Investigation conducted disclosed that on the said date, PoliceM/Sergeant

Caldero Sugnud Y Ininit went to the house of Tinae S. Tungol to advice to stop that the loud
music of videoke but Tungol and his companion did not pay attention that resulted to
misunderstanding wherein PoliceM/Sergeant Ininit said this statement “ Kapag di kayo titigil,
babarilin ko kayo”. Therefore Tinae Tungol said that he will report to the barangay but
PoliceM/Sergeant Ininit said “ hindiakonatatakotsa barangay! Magreklamo kayo!” Thus, Roger
Palma went to the barangay hall to ask for assistance without knowing that SPO2 Reyes
followed himultered these word to quote against the victim “PAPATAYIN KITA WALANG
YAKA!” and shot Tinae Tungol in his head that caused his instant death. The suspect was
arrested and recovered from his direct possession and control is one (1) 9mm beretta pistol with
serial number ABC 12345 and one (1) magazine loaded with 12 live ammos and immediately
brought to the police station for inquest proceeding.

I, Caldero Sugnud Y Ininit, Filipino, of legal age, married to Sana Lana Y Oil , and a resident of
Dona Soledad Phase 3B Barangay Labangal General Santos City , after having been duly
sworn in accordance with law, hereby depose and state:

1. That I am NOT the same person as one Binugha who was charged under I.S. No.063
/ Criminal Case No.0023 before for the crime of MURDER;

2. That my middle name is Sugnud and not Binugha .

3. That I have never been the subject of any criminal complaint, charge or proceeding
before any prosecutor or court;

4. That I am executing this Affidavit to certify or attest to the truth of the foregoing facts
and for purpose of denying that I am the who is the subject of the aforementioned case
in the I.S. No. 063 / Criminal Case No. 0023.

5. Further Affiant sayeth none.

Kan-on , legal ages and presently assigned at Makar Police Station Isabela after having been
duly sworn to in accordance with the law, do hereby deposed and state the following:

1. That on or about 6:00 PM of September 05, 2019 a cell phone call received by
personnel of Makar Police Station from Brgy. Kagawad ADOBO B. CALDERITA of Dona
Soledad Brgy. Labangal G.S.C. that PoliceM/Sergeant Caldero Sugnud Y Ininit, 31 years old,
married, presently assigned at Makar Police Station and a resident of Dona Soledad Brgy.
Labangal G.S.C. shot Tinae S. Tungol in his head that caused his instant death with the used
of calibre 9mm at the barangay hall of the said place. Upon receipt of the report, team led by the
COP proceeded at the said place and upon arrival thereat, said team together with the said
Brgy. Kagawad saw PoliceM/Sergeant Caldero Sugnud Y Ininit in the Barangay hall and
arrested him. Recovered from his direct possession and control is one (1) 9mm Beretta pistol
with serial number ABC 12345 and one (1) magazine loaded with 12 live ammos.

2. That we (PStaffSrgt Sabwan S Bukog, PtrlMan Prayd S. Cheken and

PtrlMan Lungag U. Kan-on) immediately arrested the suspect and thereafter informed him of
his constitutional rights in language and dialect known by him in the presence of Barangay
Elected Officials.

3. That we brought the suspect to the Police Station for further investigation and
proper disposition;

4. That we are executing this affidavit/statement to attest the veracity of the

aforementioned facts and to support the filing of appropriate charge/s in Court against the
arrested person.
