CONSTITUTION OF THE COMANCHE NATION (As ratified November 19, 1966, amended May 28, 1976, June 10, 1978, April 14, 1979, April 25, 1981, September 29, 1984, June 29, 1985, April 28, 994, February 23, 2002, September 8, 2017, and March 21, 2018) PREAMBLE Invoking the guidance of Almighty God, we, the members of the Comanche Nation with faith in the purposes of our Supreme Being, with abounding prde in our ancient racial heritage and with the determination o promot, through united efforts, the general well-being of ur tribe and to secure to ourselves and our descendants the right, powers and privileges provided by law, do solemnly ondain and establish this organization and adopt the following constitution. ARTICLE I=NAME (Pursuant to Amendment A, adopted February 23,2002) The name ofthis goveenment will be the “Comanche Nation." ARTICLE 11—PURPOSE “The purpose of this organization shall be: ‘Section 1, To define, establish and safe guard the rights, powers and privileges ofthe tbe and is members Section 2. To improve the economic, moral, edueational and health status ofits ‘members and to cooperate with and seek the assistance of the United States in carrying out ‘mutual programs to accomplish these purposes by all possible means Section 3. To promot embership. other ways the common well-being ofthe tribe and its ARTICLE Ill- MEMBERSHIP Pursuant to Amendment V, adopted May 29, 1976, Amendment D, adopted February 23, 2002) Section, The membership ofthe Comanche Nation shall consist ofthe following: (6) All persons, who rcsived an allotment of land ae members of the Comanche Nation lunder the Aet of June 6, 1900 (31 Stat. 672), and subsequent Acts, shall be included as full blood members of the tribe, ‘appRoveD ‘March 21,2018, () All iving dsoot descendants of llottes eligible for membership under the provisions of Section I (ofthis Article bor on or before the date of adoption of this constitution. Section 4, Notwithstanding the provisions of Section 3 of this Atile, any person who meets the eligibility criteria in Section 1 ofthis Article who as a minor accepted a material or monetary benefit as a member of another Indian tribe or whose legal uardians accepted a material or monctary benefit asa member of another Indian tribe while ‘the person was minor, shall have the option of elingushing theie membership in the athee twibe and becoming a member of the Comanche Nation not later than one year ater they hecome an adult as defined by this Constitution, provided further that any person eligible for membership in the Comanche Nation under this section who has reached adulthood rior to the approval date ofthis section must take appropriate action to enroll asa member ‘of the Comanche Nation not later than 30 days subsequent to the adoption date of the section, ‘Section 5, The Comanche Nation will have an open enrallment not to exceed a period ‘ix (6) months from the time this amendment is approved by the Secretary of Interior to all allow all persons who have not met or do nat meet the eligibility requirements a stated in ‘Actcle Ill, Section | theough Section 4, the opportunity to present evidence and documentation to substantiate theit claims) for entllment to be determined by the Comanche Business Commitee. ARTICLE IV — ORGANIZATION AND OFFICERS Section L. The supreme governing body of this organization shall be the Comanche ‘Tribal Council ‘Section2, In aditon tothe tribal eounel there shall be elected a Comanche Business Commitee. Section3. The elected officers ofthe tribal council shal be a tribal chairman, a tebal vice chairman, and a tial secretary-treasuret. In addition these officers shall serve in the same eapacity onthe Comanche Business Commitee. ARTICLE V TRIBAL COUNCIL / POWERS CLAUSE ‘(Pursuant io Amenient adopted May 29, 1976, ‘Amendment X1 and Amendment XI, adopted April 14, 1979, ‘Amendments XVIII and XIX, adopted September 29, 1984, And Amendments XXX1, XXXII, XXIII, XXXIV, XXXV, XXXVI, adopted April 28, 1994, and ‘Amendment XLII, adopted September 8,207, and Amendment XLV adopted Mareh 21,2018) ‘Sastion 1, _Purwant to ARTICLE IV, Section 1. The supreme governing body of thir ‘organization shall be the Comanche Tribal Council. The Tribal Council shall consist of all duly enrolled members ofthe Comanche Nation who are eighteen (18) yeas of age or older. In addition tothe annual tribal council meting, the tial chairman shall be eguied to call special tribal council meeting inthe Following cases: (@) Upon writen request by the Commissioner of Indian A fairs or his authorized representative; or (©) When he is yo requested in writing by as many as three members ofthe business committee, setting forth the purpose ofthe meeting or (©) When he is so requested by a petition signed by 10% of the Tribal Council seting forth the purpose of the meeting consistent with the Constitution. The Tribal Council shall consist ofall members of the Comanche Nation who are eighteen (18) years of age or older; or (@) Should the tribal chairman refuse to call and hold a meeting of the tribal councilor neglect todo so for thirty (30) days after he is duly requested, the Commissioner of Indian Afuirs or his authorized representative shall be authorized to eal such special ‘meeting and shall do so by notifying the officers and members of the business committee of the date thereof. Subject to the approval ofthe Secretary of the Interior or his authorized representative where applicable, the nuthortyof the Comanche Tribal Council shall include and be exclusive with respect othe following: ‘Sections, All meetings requir a legal quorum which shall consist of one hundred and fifty (4) To change, modify alter or revoke membership rules. (b) To execute leases, contracts or permits for five (5) or more years with regard to property whieh i owned exclusively by the Comanche Nation, but this does nat inelude any individually-owned land ot personal property (6) Toelect iba officers and members ofthe business commitee and fo fill vacancies ‘whieh may occur pursuant to Article VI (@ To authorize the expenditure of funds which may be deposited tothe exclusive credit to the Comanche Nation and of funds which may be deposited tothe joint credit ofthe Kiowa, Comanche and Apache Tribes, (6) To select and authorize tribal delegations to transact business on behalf ofthe wibe ‘When travel i involved, the tems of the resolution shall include the purpose of the trip and the existence ofthe delegations authority (The salary forthe Chairman ofthe Business Commitee shall be established by the Tribal Couneil by the adoption ofan annual wba operating budget. Salary forall other ‘members of the business committe shall be two hundred and fifty dollars ($250) per month, ‘Section 7. All minutes of the tribal council meetings shall he published in a manner to be determined by the tribal council Section8, To hire an Administeator/Manager to administrate the tribal government. The ‘Administtator/Manager shall be under the direction of business committe, Members ofthe ‘business committe shall not be an employee ofthe tribal government. Section 9. To hie an attomey to represent the tribe in legal matters | ARTICLE VI BUSINESS COMMITTEE (Pursuant to Amendment X, adopted June 10, 1978, Amendment XIII and Amendment XIV, adopted Apel I, 1979, Amendment XX and Amendment XX1, adopted September 29,1984, APPROVED March 24,2018 Amendment XXII, adopted June 29, 1985, and Amendments F & G, adopted February 23, 3002) Section 1. The Comanche Business Committee shall be composed of seven (7) members of the Comanche Nation who ae at leat twenty-one (21) years of age, and be elected as provided in Ale VII ofthis constitution Sction 2. The business committee shall mest onthe frst Saturday of each month of each year at 10:00 an. In eae of algal holiday, the meeting will be ld on the following Saturday, Special meetings may be called by the tribal chairman at his discretion; provided that such special mectings do not excced a foal of twelve (12) mectings per calendar year. Section 3, Notice of al special meetings ofthe business committe shall be given bythe teal soeretary-reasurer by mailing a letter or postal ead to each member ofthe business ‘ommitee at least ten days (10) prior to the meeting date, setting forth the date, time, place, and purpose in general terms, ‘Section 4, No action shall be taken by the business committee except when a quorum is present. A quorum shall consist of five committeemen. Section, _Atthe beginning ofeach mecting of the Comanche Business Committe, the tribal seoretary-reasurer, oF in his absence the acting secretary as may be appointed by the tribal chairman, shall keep a record in the permanent minute book ofthe names of those present and those absent. If tribal committeeman is absent forfour (4) consccutive regularly scheduled ‘meetings of the business committe, te tribal chairman shall declare his seat vacant and so notify in writing the tribal committeeman affected and steps shall be taken to fill he vacaney pursuant to Article VI, Section I. Section 6, All minutes ofthe business committe shall be published in a manner t be determined by the business committee. Section 7. The duties, responsibilities and authorities ofthe business committe shall include the following (@) To establish and maintain te tribal membership roll and to insure that the rll is available for inspection at all reasonable times. (1) The proposed annual tribal operating budget shall be disseminated to tibal members forty-five (45) days prior tothe annual meeting, {@) The budget shall be printed on a ballot in such a manner that each line item may be approved or disapproved by the tribal members. (2) The line items ofthe budget shall be approved or disapproved i the election of officers conducted subsequent to the annual meeting pursuant to Amticle VIL, Section 2, in which tribal officers are elected. (6) To develop proposals which are in the interest of falling the purpose of the Comanche tribal organization including, but nt limited to, programs involving employment, health, ‘education, pubic relations, socal, reeeational, and histrial aetvitis ofthe tribe. Such program proposals shall be presented tothe tribal couneil for final consideration as to adoption or rejection, (9 To implement, administer, and report on progress of programs adopted by the tribal council («) To appoint such subcommittes as are needed to develop the proposals suggested herein ‘or any other worthwhile endeavors, including delegation of such authorities to these subcommittee asin commensurate with their responsibilities (h) To secure an aul of each fiscal year’s Financial activities relating to funds from al sources, to publish the audit ofthe prior yeas ands in the tribal newspaper and two Tocal newspapers atleast sixty (60) days prio to each annual meeting, and to prepae for ‘delivery to those attending the annual tribal council meeting a written annual report ‘which shall contain a synopsis of the vated activities ofthe business committer, the previously published audit anda forecast oF activities proposed forthe coming year. Each officer or committeman shal be eligible to serve two (2) consecutive tems effective upon date ofthis fmendment, present term being counted ar one term. At the completion of the aocond consecutive term of office, an officer or a comitteeman shall not be eligible for election to a position on the business committe unt a period of three (3) years elapsed. In addition, an officer ot commiiteeman who has completed two (2) consecutive terms on the business ‘committee shall not be employed within the Comanche tribal governmental systom until 8 poriod of three (3) years has elapsed. For the purpose ofthis section, any portion of aterm shall be considered as one teem. ARTICLE VII ELECTIONS (Pursuant to Amendment Il, adopted May 29, 1976, Amendment VI, adopted June 10, 1978 ‘Amendment XVII, adopted April 25, 1981, and ‘Amendment XX1, adopted September 29, 1984) Section 1, Assoon as practicable after this constitution is adopted the Area Director shall, «alla tribal council meeting and shall hold and supervise the fest nomination and election hereunder for the tribal committee and officers, a follows: (@) The Area Director may at his discretion delegate cheirmanship ofthe initial meeting toan employee under his supervision. A secretary forthe proceeding may be provided by the Area Director from his staff or he may also designate this responsibilty toa member of the Comanche Nation. (&) Atthe inital meeting ofthe tribal council shall nominate candidates forthe office of tribal chairman for three 3) years, vice-chairman for thee (3) years, seretary- tweasurer fortwo (2) years, two (2) business committee members for two (2) years and two 2) business committee members for (1) year. Nomination shall be made from the floor and accepted by the chairman. Persons duly elected at the ensuing election shall serve forthe terms stated above unless their successors are duly elected prior to the expiration of such terms. Thereafter, all terms of office shall be fora petiod of Unee yeas or wil a succenor is duly elected. (4) Following the intial organization meeting, and election day shall be designated to lect the business eommitteemen a officers from among the eandidates who were nominated during the inital meeting. This election day and poling places shall be declared by the Area Director. The election of eommittcemen and officers shall be by ‘soert ball. No absentee ballots willbe considered at such election, ‘Scction2, At each annual Comanche Tribal Council meeting subsequent to the ist election red to of officers and business committeemen, under this constitution, candidates willbe no compete for election to olices being vacated by reason of expiration of term of offic. Determination of qualifications of nominated candidates and election processes shal be as desered in Section 1 (c) and (dof this Article except that the Comanche tribal officers and business committeemen will assume the responsibilities assumed by the Area Director the first election under tis constitution and except that absentee ballots shal be considered tall, subsequent eletions of officers and business committeemen, No election shall be held later than 60 days after the annual mesting. Because a valid election was not completed by the Comanche Nation within sixty (60) days after the 1980 Annual Meeting, the Anadarko Agency is authorized to conduct one (1) election fr the tibe pursean to euls and regulation as prescribed by the ‘Anadarko Ageney. The Anadarko Ageney is further authorized to notice, call, and conduct 2 ‘special meeting ofthe Comanche Tribe Council for the sole purpose of nominating candidates for the vacant or expired postions that willbe filled pursuant tothe election, nominees are offically qualified as candidates for office in accordance with the ‘Section 3. Should an incumbent ofthe Comanche Business Committe aecept a nomination tan annual trial council meeting asa candidate fora different office, that individual shall be required to resign the business committe postion which he then hols. Although such resignation shall not be effective until the completion ofthat year's election processes. "Nomination for candidates to fll he unexpired potion of such person's term of office shall be ‘nade atthe same tribal council meeting which he aceepted nomination fora different office. ARTICLE VIII VACANCIES AND REMOVAL FROM OFFICE (Pursuant to Amendment XV, adopted April 14, 1979, and Pursuant to Amendment XLIV, adopted September 8, 2017) ‘Section, If' commiticeman or officer of the tribe shal die o resign be removed or recalled from office, his office shall be doomed vacant and tho tribal chairman, oe should this ‘office be vacant, the tribal vice-chairman, shal inumediately call a meeting af the Comanche ‘Tribal Couneil to beheld within twenty (20) days for the purpose of filling such vacaney for the unexpired term, except that when such vseancy shall cur within four months ofthe apeRovED Maren 21,2018, annual meeting of the Comanche Tribal Council, the postion shall remain vacant unl the next, election when provisions shall be made to fill he vacancy. The petitioner's representative shall provide proper evidence or ecept by the accused, the tba chainnan shal allan official meeting of the Comanche Tribal Council within tity (30) days forthe purpose ‘of hearing and disposition of the case. (6) The format forthe Tribal Council meeting shall be established as follows: (D Presentation ofthe Bil of Particulars against the accused by a representative ofthe accusers. This presentation shall be limited strictly to those specifies included inthe Bill of Particulars as presented to the accused (@) The accused shall be given adequate opportunity to answer any and all charges of Which he or she is accused. The accused may personally present or may choose 19 utilize the services of another to present this response. (6) Upon completion ofthese two presentations no further discussion shall be allowed and. voting shall proceed immediately in a manner prescribed by this constitution. (4) A majority vote of those voting ofthe Tribal Council meeting shall be sufficient to effect recall providing « quorum is present. Should «quorum not be present the charges again the accused shal be declared null and void and no futher aeton shall be taken on this petition ‘Scotion3. Any officer or committeeman who shall be found guilty be any State or Federal Court of felony, a misdemeanor involving dishonesty or of accepting a bribe shall forfeit his office and such office shall immediately become vacant and be filled in accordance with Section ARTICLE IX — QUALIFICATIONS OF OFFICERS (Pursuant to Amendment XVI, adopted April 1, 1979, and Amendment XLVI, adopted March 21,2018) apPROVED March 21,2018 Seation 1, No person may seck tribal office unless he willbe atleast twenty-one (21) ‘years of age at the time of his election and is a member of the Comanche Nation, Section, Anyone who has been adjudged or convicted of any felony, a misdemeanor involving dishonesty, bribery, embezzlement, o of any improper appropriation or obligation of teal assets, any improper addition or removal fom rbal rolls, any indebtedness tothe "Nation, or fils a drug tes shall not be eligible to hold offic. Section 3, Any person recalled from office os a result of action by the Comanche Tribal CCoureil in accordance with Section 2 of Aniele VII ofthis constitution shall forfeit the right to seek election to any postion on the Comanche Business Commitee fora period of three years beyond the expiration ofthe tem of office in which the recalled person was serving at the time of real. ARTICLE X — BILL OF RIGHTS (Pursuant to Amendment XXII, adopted September 29, 1984, and Amendment XXIV and ‘Amendment XXV, adopted June 29, 1985) ‘Scstion L, _Allmembers ofthe Comanche Nation shall enjoy without hindrance freedom of ‘worship, Conseience, speech, pres, assembly and association Section2. This constitution shall not in any way be construed to alter, abridge or otherwise {jeopardize the rights and privileges of the Comanche Indians a citizens ofthe United States. ‘Seation3, The individual vested property rights of any member of the Comanche Nation, “which shall include restricted lands and income therefrom as wel as personal property, shall not be altered, abridged or otherwise affected by the provision of this constitution. Section 4, Tribal members shall have the right to review tribal records, including those of any enterprise operated/funded inthe name ofthe Nation (including CERCO, Bingo and any ‘other trbally oprated/funded business) so long as the examination ofthe records is peri ‘within seven (7) days ofthe receipt of a written request forthe review. No charge or fee shal be imposed upon any tribal member in connection with the eight to examine bal records. No person or commitee shal be authorized to deny any trial member the right to make copies of tribal records except as required by Federal Statutes. Section 5. No charge or filing fe shall be imposed upon any tribal member in connection ‘ith the ight to petition which are provided for inthis constitution, No person or committee shall be authorized to deny any tibal member the right to petition ARTICLE XI AMENDMENTS (Pursuant to Amendment Il, adopted May 29, 1976) arPnovED March 21,2018, Section {, Amendments to this constitution may be proposed by a majority vote of the business committe or by a petition signed by two hundred (200) adult members ofthe tribe who are entitled to vote, andl if approved by the Commissioner of Indian AfTuirs, shal be submited 10 the voters ofthe Tribe, and shall become effective when raifed by a majority vote of those who ‘ast ballots in an election called by the Commissioner of Indian Affairs. ARTICLE XII - DUTIES OF THE OFFICERS. (Pursuant © Amendment Vil adopted Sune 10,1978, ‘and Amendment XXXVI, adopted April 28, 1994, and Amendment XLVI, adopted March 21, ‘2018 Section 1. The Chairman exereses the authorities and powers as delegated to his office by this Constitution and the Comanche Tribal Council. He shall preside at all meetings of the Teel Council and the Business Committee and be the principal member ofall riba delegations. When ‘0 authorized by the Comanche Tribal Council, he shall sign necessary papers and instruments forthe Comanche Nation, Seation 2, The Vice-Chairman shall perform the duties of the Chairman inthe event of the {emporary absence or disability ofthe Chairman or when itis determined according of Aticle VIII Section 2 that a hearing for removal of the Chairman is deemed necessary by the ‘Comanche Tribal General Counel Scotion3, The Seeretary-Treasurer shall preside in the absence ofthe other officers and shal keep records, including financial records, ofthe organization, shall record and keep the minutes ‘ofthe tribal council and business committee meetings ina permanent book, and shall be responsible for sending all notices of meeting as herein required. He shall Keep cops ofall such notices and requests for mectngs together with a statement by him or another office, athe case ‘may be, that such notices were mailed and published as required herein and place the sae in the appropriate permanent minutes book as a preface tothe minutes ofthe meeting so calle. Section, Copies ofall minutes ofthe tribal council and business committee meetings and resolutions shall be sen tothe Anadarko Ageney.
