An Act to provide lor the deyelopment, regulotion qnd cotltrol ol the profession ol
travel agencies in Pakiston
a.
WHEREAS it is necessary and expedient to provide for the development,
regulation and control of the profession of travel agencies in Pakistan;
(f) " travel agency " means a person, by whatever name called, whe-
(i) makes, directly or indirectly, on commercial basis arrangements
for the passage of the tourists, or use oI transport, or traNporta-
tion of their baggage or goods by sea, air, rail or road; or
(ii) makes arangements for lodging, transport or other selvic€s
relating to travel of persons within Pakistan or arranges eoter.
tainment, sight-seeing, exculsion and guide servic€s, whether
the arrangements are made on the basis of comprehensivc all
inclusive rates or on the basis of separate charges for each
service provided ; or
(iii) has been delegated geDeral authority in respect of sales for
the airlhes or other carriers, either dtectly or through a sub.

G) " tourist " means a person normally residing outside Pakistao who
e4ters Pakistan and remains th€rein for not less than twenty-four
hours and not more than six months in the course of any year tor
purposes such as touring, recreation, sports, health, study, religious
pilgrimages or business, and includes a citizen of PakistaD. who tra-
vels within Pakistan or proceeds abroad for any of the said purposes.
(5) The licence shall, unless earlier cancelled or suspended under section
.[0 or section 11, remain valid for one year.and may be renewed from year to
year in such mamer, and on payment of such fee, as may be prescribed.
(3) The Federal Govemment may, after maki-ng such inquiry as it may
deem frt and after gving a lravel agency an opportunity of showing cause
against the order prolxrsed to be made, order payment, out of the business
guarantee fund oi the travel agetrcy, oI any sum owed by the aggncy to a
tourist, carrier, company or hotet or lodging house and not settled by it
within th.irty days irom the date of its becoming due.
(4) A trayel agency from whose business guarantee fund payment of any
amoult has been made under sub-section (3) shall, within a period of fifteen
days oI such payment, deposit the said amount into the business guaradee
fund.
8. Service charyes.-(l) The rates (}f service charges ftom the tourists
shall be set out in a rate list drawn up by a licensed travel agency from time
to time a:rd approyed by the Committee.
(2) A copy of the rate list referred to itr sub-section (1) for the time
being in force shall be posted at some conspicuous part of the office of the
travel agency.
13. Appeel af,d review. (1) A travel agency aggrieved by the decisiou or
order of an officer or authority other tlan the Federal Government under this
Act or tbe rules may prefer an app€al to the Federal Government within the
prescribed time and ia the prescribed manner; and the decision of the Federal
Govemment ia such appeal shall be ffnel.
(2) The Federal Government may at any time of iis own motion, or on the
applicatiotr of any travel agency aggrieved by any decision or order passed by
the Federal Goyernment under this Act or the rules within the prescribed time
and in the prescribed manner, pass such order in relation thereto as it thinks fit:
(2) No court shall take cognizance of arr ofience punishable under this Act
except upon a complaiot made in writing by or under the authority of the
Federal Government
