Primer capítulo comprende los aspectos metodológicos, que abarca al diagnóstico situacional,
formulación y sistematización del problema, los objetos, justificación de la investigación, la
formulación dela hipótesis, variables, indicadores, definición del tipo de investigación, selección del
diseño de la investigación, determinación del universo, selección de muestra y su unidad de análisis.
El segundo capítulo consiste en un estudio doctrinario del problema analizado, donde sobresalen el
antecedente, desarrollo histórico, principios, finalidades y características del derecho a la consulta,
aceptados por el derecho internacional de los derechos humanos de los pueblos indígenas; así como
la naturaleza, la fuerza normativa, la jerarquía normativa del convenio 169 sobre pueblos indígenas
y tribales en países independientes de la organización internacional de trabajo de la declaración de
las naciones unidas sobre los derechos de los pueblos indígenas. Incluye este capítulo las teorías
de incorporación del derecho internacional en el derecho interno y la validez de las medidas
administrativas, así como una referencia sobre las concesiones mineras.
El tercer capítulo explica los antecedentes generales, que permite entender el proceso de
implementación del derecho a la consulta en nuestro país, ya que como todos sabemos que para
lograr la ley se comprende el derecho a la consulta previa, se tuvo que transcurrir por situaciones
políticas, jurídicas y sociales, hasta cierto punto críticas.
Cuarto capítulo contempla el fundamento del derecho a la consulta de los pueblos indígenas,
ubicadas en los instrumentos normativos internacionales vigentes, como el convenio 169 de la OIT,
la declaración de las naciones unidas sobre los derechos de los pueblos indígenas, las sentencias
de la corte interamericana de derechos humanos; así como el marco jurídico nacional que
comprende algunos artículos de la constitución política del Perú, desarrollo jurisprudencia del tribunal
constitucional, la ley de consulta previa y su respectivo reglamento.
El quinto capítulo describe los pueblos indígenas como titulares de los derechos colectivos, en
especial a los pueblos quechuas.
2. ABSTRACT
LIZANA V. G. The Administrative Acts of Mining Concession Issued in the Ayacucho Region, in the Period
1995 to 2011, within the Framework of the Right to Prior Consultation. - The present investigation, seeks to
establish the validity of the administrative acts of mining concession, granted by ministry of energy and mines
in the territory of the indigenous peoples of the Ayacucho region, between 1995 and 2011, which did not
observe the right to conceal previous collection by Convention 169 of the ILO, signed already ratified by the
Peruvian State; for which purpose it has been divided into seven chapters:
First chapter includes the methodological aspects, covering the situational diagnosis, formulation and
systematization of the problem, the objects, justification of the research, the formulation of the hypothesis,
variables, indicators, definition of the type of research, selection of the research design, determination of the
universe, sample selection and its unit of analysis.
The second chapter consists of a doctrinal study of the problem analyzed, where the antecedent, historical
development, principles, purposes and characteristics of the right to consultation stand out, accepted by the
international law of the human rights of the indigenous peoples; as well as the nature, the normative force, the
normative hierarchy of the Convention 169 on indigenous and tribal peoples in countries independent of the
international labor organization of the declaration of the united nations on the rights of indigenous peoples. This
chapter includes the theories of incorporation of international law in domestic law and the validity of
administrative measures, as well as a reference on mining concessions.
The third chapter explains the general background, which allows understanding the process of implementation
of the right to consultation in our country, since as we all know that to achieve the law we understand the right
to prior consultation, we had to go through political situations, legal and social, to a certain extent critical.
Fourth chapter considers the basis of the right to consultation of indigenous peoples, located in existing
international normative instruments, such as ILO Convention 169, the declaration of the United Nations on the
rights of indigenous peoples, the judgments of the court Inter-American Commission on Human Rights; as well
as the national legal framework that includes some articles of the political constitution of Peru, jurisprudence
development of the constitutional court, the law of prior consultation and its respective regulations.
The fifth chapter describes indigenous peoples as holders of collective rights, especially the Quechua peoples.
The sixth chapter, contains mining concessions in the region of Ayacucho, clearing previously the
contextualization of the same region, in order to compare the type of population with administrative
measures of mining concession. The seventh chapter contains the presentation, processing and
statistical analysis of the results. For this purpose, nineteen administrative files of the mining
concession granted by the Ministry of Energy and Mines in the territory of the indigenous peoples of
the Ayacucho region between 1995 and 2011 were analyzed, as well as the survey of nineteen
indigenous authorities.
Finally, the last chapter contains the verification of the hypothesis, with the relevant explanations and
legal support.
