National technical regulation for bottled/packaged natural mineral waters and
drinking waters

1. GENERAL RULES
1.1 Applicable scope
This Technical Regulation stipulates the food safety criteria and management
requirements for bottled/packaged natural mineral waters and drinking waters.

This Technical Regulation was not applied for the functional food.

1.2 Applicable subjects


This Technical Regulation applies to:

(a) Organizations, individuals who import, produce, and trade bottled/packaged


natural mineral waters and drinking waters in Vietnam;

(b) Relevant organizations and individuals.

1.3 Definitions
In this Technical Regulation, following words/phrases will be thoroughly
understood as:

1.3.1. Bottled drinking water


The bottled water could be use for drinking, contains minerals and CO2
naturally or additionally but not natural mineral water; not contains sugar, sweetener,
flavor or others chemical.

1.3.2. Bottled natural mineral water


The water products are clearly distinguished from others conventional drinking
water by:

a) Contain certain concentration of minerals with their relative proportions and


the presence of micro nutrient or other constituents;

b) Direct exploitation from natural mineral water resources or underground


water from wells within the protection boundary areas to avoid any pollution or foreign
matters that affect the physical and chemical quality of the water;

c) No change in composition, stability of flow and temperature despite changes


of nature;

d) The water was exploited under conditions that ensure it was free from
bacteria but still keep the same chemical characteristic as initial raw water.

e) The water was bottled at the original source under stringent sanitary
conditions and only apply one of (or combine) the following treatment methods, but not
make the natural mineral water basic characteristics change.

- Separation of unstable components as well as compounds containing iron,


manganese, sulfide or arsenic by decanting and / or filtration method, the aeration
method could be applied in advance if necessary.

- Remove / add CO2

- Disinfection by UV

1.3.3. Bottling at the original sources


The water was bottled at the original sources or taken from the original sources
to the treatment sites via the continuous closed piping loop in order to not only keep the
hygiene conditions but also retain the original chemical properties of the water.

1.3.4. Bottled natural mineral water with gas


The bottled natural mineral water as specify in point e, item 1.3.2, article 1 of
this Technical Regulations was supplemented with the gas from the original water
sources in order to keep the same CO2 concentration after bottling.

1.3.5. Bottled natural mineral water without gas


The bottled natural mineral water as specify in point e, item 1.3.2, article 1 of
this Technical Regulations was kept the CO2 concentration at certain limit in order to
maintain the bicarbonate salts in the water product.

1.3.6. Bottled natural mineral water with less gas


The bottled natural mineral water as specify in point e, item 1.3.2, article 1 of
this Technical Regulations was kept the CO2 concentration less than the original
source.

1.3.7. Bottled natural mineral water with more gas


The bottled natural mineral water as specify in point e, item 1.3.2, article 1 of
this Technical Regulations was supplemented with the gas from the original water
sources in order to keep the CO2 concentration higher than the original source after
bottling.

1.3.8. Bottled natural mineral water with CO2 gas


The bottled natural mineral water as specify in point e, item 1.3.2, article 1 of
this Technical Regulations was supplemented with CO2 – food grade before bottling.

2. TECHNICAL STIPULATIONS

2.1. Requirements of the water sources used for bottled drinking water
The water sources used for bottled drinking water must follow the QCVN
01:2009/BYT promulgated by MOH’s Minister at the Circular No.04/2009/TT-BYT
dated 17th Jun 2009.

2.2. Food safety requirements

2.2.1. The chemical characteristic of the bottled natural mineral water related to
food safety requirements was specified in Appendix I of this Technical Regulation.

2.2.2. The chemical characteristic of the bottled drinking water related to food
safety requirements was specified in Appendix II of this Technical Regulation.

2.2.3. The bacteria characteristic of bottled natural mineral water and drinking
water was specified in Appendix III of this Technical Regulation.

2.2.4. Other analysis methods which have the same accuracy as the test methods
in Appendix I, II, and III could be applied.

2.2.5. Detail of the analysis method was specify in the Appendix IV of this
Technical Regulation.

2.3. Labelling
The labelling works shall follow the Circular 89/2006/NĐ-CP dated 30th Aug
2006, and the following requirements:

2.3.1. Product name

a) Shall contain words "natural mineral water";

b) Depend on the mineral water, the label shall mention clearly the water type

- Bottled natural mineral water with gas

- Bottled natural mineral water without gas

- Bottled natural mineral water with less gas

- Bottled natural mineral water with more gas

- Bottled natural mineral water with CO2 gas

2.3.2. Name of the original sources and the sources location shall be mentioned
clearly in the label

2.3.3. Chemical characteristic

a) TDS, Na, Ca, K, Mg, I, F, HCO3- concentration and the applied treatment
method in the natural mineral water production shall be mentioned clearly in the label;

b) If the fluoride concentration is more than 1 mg/L, the words “fluoride


contain” shall be indicated clearly in the label.

If the fluoride concentration is more than 1.5 mg/L, the words “not suitable for
children less than 7 years old” shall be indicated clearly in the label.

2.3.4. Not allow to indicate medical treatment functions of the products

2.3.5. Not allow the advertisements which confuse the consumers about the
characteristic, origin, and properties of the water products.

3. MANAGEMENT STIPULATIONS
3.1. Appraisal announcement
3.1.1. The imported bottled natural mineral water and drinking water products
shall be announce the appraisal result according to the stipulations of this Technical
Requirements.

3.1.2. The procedure of appraisal announcement shall follow the Decision


24/2007/QĐ-BKHCN dated 28th Sep, 2007.

3.2. Water products examination


The examination about the quality, hygiene of the water products shall be
follow the relevant regulations stringently.

4. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS


4.1. Organizations and individuals who import the bottled natural mineral water
and drinking water products shall announce the relevant appraisal according to the
stipulations in this Technical Regulation, and assure the water product quality same the
appraisal announcement.

4.2. Organizations and individuals could only import the bottled natural mineral
water and drinking water products once the appraisal announcement was completed
according to the relevant regulations issued by the government.

5. IMPLEMENTATION ARRANGEMENTS
5.1. Provincial Department of Food Safety and Hygiene will be responsible for
cooperation with the relevant departments to provide guidance, inspection/monitor on
the compliance of this Technical Regulation.

5.2. According to the management requirements, Provincial Department of


Food Safety and Hygiene has the responsibility to request Ministry of Health revise this
Technical Regulation.

5.3. In case of changing/supplementation or adjustment of cited standards and


regulations in this Technical Regulation, the new/revised regulatory document shall be
applied.
