1 SCOPE
The WORK required under this specification includes, but is not limited to,
the furnishing of all supervision, labor, materials, equipment, and services
necessary for, and reasonably incidental to, the repair of fences, terraces,
roadways, bridges, culverts, cattle guards, and clean-up of the PIPELINE
right-of-way over its entire length in a manner satisfactory to the
COMPANY.

2 CODES AND STANDARDS


The CONTRACTOR has the responsibility of compliance with all the
applicable regulations, codes, standards, and all specifications. In the
event of any apparent conflict between this specification and any such
applicable regulation, code or standard, or in the event of a disagreement
concerning the requirements of any such applicable code, regulation or
standard, the COMPANY shall have the right, but not the obligation, of
interpreting the regulations, codes, standards, and specifications and their
application to the WORK. The COMPANY’s decision on any disputed
interpretation shall be the final resolution of the dispute.

3 CONSENTS, PERMITS, LICENCES AND


AUTHORISATIONS
The CONTRACTOR is required to obtain and/or procure all consents,
permits, licenses, authorizations and all such approvals required during
the design, engineering, construction, pressure testing and pre-
commissioning stages of the WORK other then those that are specifically
indicated as being obtained by the COMPANY.

4 ORGANIZATION
4.1 Clean up operations are to be conducted by a clean up crew organized by
the CONTRACTOR at the time backfill operations are initiated and shall be
diligently undertaken, until the completion of the entire job.

4.2 The CONTRACTOR shall keep the clean-up crew as close as practical to
the backfill operations, except for occasional out of sequence working,
made around small areas. If rough clean-up operations are performed
during adverse weather or ground conditions, the CONTRACTOR shall be
required to complete the clean-up in such a manner as to meet the
COMPANY’s standard for normal dry weather clean-up without additional
cost to the COMPANY.

5 POLICING
5.1 As soon as the pipe is laid and backfilled, the CONTRACTOR’s clean-up
crew shall clear the surrounding grounds and right-of-way of any rubbish,
loose brush, fallen trees, stumps, surplus material, and the loose rock from
excavation operations. Also, all spent electrodes, tape containers and
other typical construction debris will be collected at the same time, until the
area is restored to its natural condition.

5.2 Brush, stumps, and other items shall be disposed of by the


CONTRACTOR at a place and in a manner in compliance with all
applicable environmental regulations and requirements, satisfactory to the
COMPANY, as identified in the CONTRACTOR’s Environmental
Management Plan.

6 LANDSCAPING
6.1 COMPANY shall use its best efforts to furnish CONTRACTOR a list of
right-of-way with all special clean-up provisions contained in the right-of-
way easements. All provisions shall be binding on the CONTRACTOR.

6.2 Ruts due to trucking or other ground damage shall be ripped and repaired.

6.3 All wood corduroy used through the construction for maintaining roadways
along the right-of-way where lands are poorly drained and in swamps
shall, if approval is obtained from the landowner, remain in place.
Unsupported and loose ends shall be chopped or cut down to the level of
the ground. Where cut corduroy has been constructed through drained
and normally dry areas, corduroy shall be removed and disposed of in the
same manner as brush and stumps. All temporary roadways shall be
cleaned up in a manner satisfactory to the COMPANY and landowner.

6.4 The right-of-way shall finally be graded to a smooth natural appearance


using suitable graders. Grading shall be performed in compliance with all
applicable environmental permits. In general, grading shall be minimized
in environmentally sensitive areas such as along stream banks and ponds
adjacent to the right-of-way. Efforts shall be made to preserve protective
vegetation such as grass and shrubs in order to reduce the potential for
erosion in these areas. Such grading shall not destroy or degrade any
final erosion and sedimentation control structures. Repair of such damage
shall be at the CONTRACTOR’s expense.

6.5 In all areas where the pipe is "pushed" the CONTRACTOR


shall grade the area in a manner which is not injurious to
surrounding facilities, vegetation or wildlife.

6.6 Prior to hydrotesting and on completion of clean up and


reinstatement, the right-of-way shall be ripped to a depth of
0.4 m where the PIPELINE has been laid to 1.0 m or greater
cover, and 0.2 m elsewhere, except where agreed with the
COMPANY that this is not required.

6.7 The CONTRACTOR shall install final erosion and


sedimentation control structures as required by applicable
regulations and/or the COMPANY’s Erosion and
Sedimentation Control Plan. This may include, but shall not
be limited to, the installation of rip-rap embankments at
stream crossings, construction of water diversions across the
right-of-way on sloping terrain, and application of lime,
fertilizer, seed, mulch and tackifier to minimize post-
construction erosion and stream sedimentation.

6.8 Final stone picking shall be undertaken as necessary and


during the CONTRACT maintenance period, so that the
incidence of stones at the surface of the right-of-way is not
greater than that encountered in adjoining land.

6.9 No construction debris or materials developed due to the


WORK activities are allowed to remain on the work area. All
materials to be removed from the site must go to approved
dumping locations, to be agreed by COMPANY.

7 FENCES
7.1 On the completion of the backfill and the clean up of the right-of-way,
permanent repairs shall be made to all fences.

7.2 Fences shall be replaced by like material either saved from the original
fence through which the gap was made or new material similar to that
removed.

7.3 Where fence material originally consisted of wire strung between steel or
wood posts, permanent repairs shall be made using new and like kinds of
wire and post, but in no case shall the fence post replaced be inferior to
the equivalent of a creosote post 100 mm in diameter. All fence gap

replacements shall be painted in a manner satisfactory to the landowner,


and approved by the COMPANY.

8 RIVERS, CREEKS, DRAINAGE


8.1 At points where the CONTRACTOR’s Environmental Management Plan
deems it necessary and to prevent erosion along the PIPELINE trench,
terraces and drainage trenches shall be built and sack breakers or rock
riprap shall be placed in or adjacent to the PIPELINE trench, in
accordance with COMPANY drawings.

8.2 The CONTRACTOR shall restore river and creek banks to the original
profile and shall provide additional protection using sack breakers, rock
riprap, or gabion boxes. This WORK shall be done in a manner
satisfactory to the public or private authorities having jurisdiction.

8.3 Where applicable, the CONTRACTOR’s Environmental Management Plan


shall be adhered to during clean-up at all rivers, creeks, and drainage.

9 BRIDGES, CULVERTS, AND CATTLE GUARDS


All bridges, culverts, and cattle guards, whether public or private, that are
damaged by CONTRACTOR’s equipment during the construction of the
PIPELINE shall be repaired or replaced at CONTRACTOR’s expense to
the entire satisfaction of all public or private authorities having jurisdiction
over same, and the COMPANY.

10 HIGHWAYS AND ROADS


10.1 The CONTRACTOR shall restore all Highway and Road crossings to a
condition equal or better than the condition of the road when found.
Restoration shall include road surfaces, trenches and verge disturbed
during construction. Final acceptance of reinstatement will be by
COMPANY and all authorities having jurisdiction over the crossing.

10.2 A photographic record will be taken before construction, and after final
reinstatement to ensure the integrity of the highway or road has not been
deminished.

11 RIGHT-OF-WAY AND PIPELINE MARKERS


11.1 On completion of the backfill and clean-up, and during the time when
CONTRACTOR is making permanent repairs to fences, the
CONTRACTOR will be responsible for installing the pipeline markers and

warning signs furnished by the CONTRACTOR. The markers and signs


shall be erected in accordance with the Approved for Construction
Drawings at highway crossings, stream crossings, railroad crossings,
turning points of the PIPELINE or where instructed by the COMPANY.

11.2 In urban areas, pipeline markers are required in prominent locations for
any change of direction and all street crossings.

12 PUBLIC RELATIONS
The "good will" of the property owners along the route of the COMPANY’s
line is a valuable asset to the COMPANY, and the care taken by the
CONTRACTOR in the repair to fences and in the clean-up will make a
lasting impression on the property owners and tenants affected by the
construction of the line. Accordingly, the CONTRACTOR shall cooperate
in all matters concerning public relations.

13 ACCEPTANCE OF WORK
13.1 Any section may be accepted, subject to the COMPANY providing written
approval in this regard. The CONTRACTOR must obtain, in writing, the
approval of all State and Municipal authorities, Road departments, Rivers
authorities, and other authorities having jurisdiction over the said
area/crossing.

13.2 The CONTRACTOR shall understand that settlement on crossings or the


general trenchline may occur after the above approvals are granted.
Therefore the CONTRACTOR’s responsibility for any and all maintenance
will continue until the end of the defects maintenance period, established
under the main CONTRACT.

13.3 The CONTRACTOR shall be required to procure the release of any


additional or supplemental permits obtained on any public road and
railroad.

13.4 Final acceptance of the WORK shall be predicated upon the sole
judgement of the COMPANY that all requirements of the contract
documents have been fulfilled.
