PETITION

COMES NOW petitioner unto this Honorable Court, most respectfully


states:
1. Petitioner is of legal age, Filipina, female, and residing at Blk. 18 Lot 40,
Hernandez Street, MPV Catmon Malabon City._.

2. Respondent is likewise of legal age, male, Filipino and residing at 13


Monterey Street, 15th Avenue Cubao Quezon City;

3. Petitioner first knew respondent in an online game called Ran Online in


December 2006.

4. They were simply online acquaintances and after meeting up and several
conversations it quickly developed into a boyfriend-girlfriend
relationship.

5. Respondent introduced himself as an HRM student in NCBA Cubao


which petitioner later on found to be untrue.

6. During the time of respondent’s courtship petitioner caught him cheating


on her multiple times with other girls.

7. When petitioner got in June 2010, she had to force respondent to tell his
parents because he has really no intention to do so. When respondent’s
mother eventually knew of petitioner’s pregnancy, she told the
respondent that he has to take responsibility for it.

8. Petitioner then organized a “pamamanhikan” which she literally had to
force respondent to do by giving him money.

9. Petitioner was also the one who secured their marriage license and the
date that the marriage ceremony should take place. Respondent then
cancelled the wedding off at the last minute allegedly because the judge
he talked with to officiate the marriage became suddenly unavailable.

10.On August 2, 2010, petitioner and respondent eventually got married in


Max’s Restaurant in Quezon City in front of a few witnesses and
sponsors. (Photocopy of their Marriage Contract is attached herein as
ANNEX “A” to form an integral part hereof).

11.Even though the petitioner was already three months pregnant, petitioner
was told by the respondent to go home to her parents after the wedding.
Respondent would just visit respondent at their house during weekends.
Eventually in December 2010, when petitioner was nearing her due date,
respondent stayed with petitioner her mother’s house during weekdays
but goes to his home during weekends. All living expenses were
shouldered by petitioner’s mother.

12.Petitioner’s relationship with the respondent turned for the worst when
their first child was born. (Photocopy of their child’s Birth Certificate is
attached herein as ANNEX “B” to form an integral part hereof).

13.Respondent wanted them to live in his parent’s house in Cubao where


they will be sharing a room with his older brother. When petitioner
refused, respondent became hostile. He did not bother to help anymore
with household chores and always went straight to playing in the
computer. During weekends, he would go out and have drinks with his
friends and not come home. If he would – he would come home drunk.

14.In March 2011, they had a big fight about his night outs during
weekends. He packed his bags and walked out leaving them and their son
for his mother in Cubao. He said he is already fed up with the married
life and the petitioner. Petitioner attempted several times to make him
come back home but he would not. They then returned to their former
arrangement wherein he would visit just their child during weekends.

15.On June 2011 respondent was diagnosed to have Gonorrhea. He said he


got it from a one-night stand with someone he met at a bar but later on
admitted to the petitioner that he got it from a former school mate in
grade school.

16.Petitioner was devastated but for the sake of their child, she asked the
petitioner to lived in with them in a one bedroom apartment which she

rented. She also asked him to attend programs for hurting marriages
called Retrouvaille which he declined.

17.Petitioner tried hard to keep their family together but the respondent
consistently keep his distanced. He just while his time at a gym and
focus more on his body building rather than taking care of their son. He
would go straight to the computer and play his computer games rather
than spend time with his family.

18.Worst, he was diagnosed with Gonorrhea again in August 2011.


Respondent refused to disclose who he got it from and whenever
respondent attempted to have a talk with him or begged him to attend a
marriage counseling session with her he would give just the cold
shoulder.

19.Petitioner tried to seek help from his mother but she just told me that she
should be patient and that as long as he comes home to her that she
should be happy.

20.Thus the fights between the petitioner and respondent became more
intense and frequent. Respondent often told the petitioner that he only
married her because he was “napikot”.

21.In December 2012, respondent he got addicted to this The Magic


Gathering card game using the credit limit of the petitioner in one of the
supplementary credit cards she gave him. This exhausted petitioner’s
patience and was ready to leave him if not for the fact that she was
buried in debt because of his gambling and heavy expending.

22.But sometime in May 2013, respondent again was diagnosed with


Gonorrhea. Petitioner then on cannot bear sleeping, talking or even
seeing the respondent. She just felt exhausted of him. Since then, she
then forbid him from seeing her and their child and never saw him again.

23.Petitioner and respondent did not incur any debt nor had they gained any
properties.

24.Petitioner is the sole custodian of their child.

PRAYER

WHEREFORE, premises considered, it is most respectfully prayed


of this Honorable Court that the marriage of the petitioner with the respondent be
declared an absolute nullity.
Such other reliefs just and equitable under the premises are likewise prayed
for.
