Bill Hudak Files Libel and Slander Lawsuit against Congressman John Tierney

Seeks Injunction to Stop Incumbent from Continuing to Make False Statements on Key
Campaign Issues
DANVERS, Mass., October 25, 2010: Bill Hudak, www.hudakforcongress.com, candidate for
U.S. Congress in the Massachusetts 6th Congressional District, commenced a defamation lawsuit
in Essex Superior Court today against incumbent Congressman John Tierney and his campaign
committee, seeking an emergency injunction ordering the defendants to cease and desist from
inventing and spreading untrue statements about Hudak that Tierney knows to be false.

The Complaint states that Tierney and his committee have endeavored to “subvert the integrity
of the electoral process by intentionally and maliciously fabricating materially false and
defamatory statements” of Hudak’s position on four of Hudak’s key issues involving tax cuts,
the middle class, seniors, and veterans. Hudak seeks an injunction ordering Tierney to remove
these defamatory statements from his television advertisement, and a court order that
Congressman Tierney himself and his committee stop making false claims verbally or in any of
their printed materials. Hudak does not seek any monetary compensation in the lawsuit.

“This lawsuit is a matter of principle; my opponent is perpetrating false statements without any
basis in fact in an effort to sway voters to maintain his hold on an office he apparently feels
entitled to keep at any cost,” said Bill Hudak. “Voters are understandably frustrated by
incumbents who say anything they want, whether true or not, to win re-election,” Hudak
continued. “That type of conduct demeans our process and insults the voters they represent, and
must stop today. Mr. Tierney in particular needs to know that this type of dishonest conduct will
no longer be tolerated.”

The court papers recite that Tierney’s current television advertisement, which has played more
than 165 times (Note: a complete listing follows below), libels Hudak by falsely claiming that he
intends to terminate the mortgage interest deduction to destroy the middle class, and to shift the
tax load from the rich to the middle class; and further that Tierney cited irrelevant and non-
supportive sources in the ad to deceive voters into believing that there was a factual basis for
Tierney’s falsehoods.

“This is a double deception,” said Hudak. “My position has always been exactly the opposite –
namely, that we need to reduce taxes on the middle class, which is being destroyed because of
the current tax and spend policies of Nancy Pelosi and John Tierney, who has voted for higher
taxes over 110 times since he’s been in office. Reducing taxes and helping the middle class is
the very reason I am running for this office, and my opponent knows it. These false statements
were pulled out of thin air to deceive the voters and are not even discussed, much less supported,
by the sources cited in the television advertisement.”

“Not only that, but despite voting to cut over $500 Billion from Medicare, Congressman Tierney
has expressly tried to frighten seniors into voting for him by claiming I intend to privatize social
security, despite the fact that my website was crystal clear stating my position to be the complete
opposite,” Hudak said. “I have never taken that position in this race, period. In point of fact, the
privatization claim has been a well-publicized and untrue tactic of the National Democratic
Party, and it is obvious Mr. Tierney either disregarded or never even bothered to read my website
before following his party’s lead to perpetrate this fraud.” (Note: Hudak’s website states, “I do
not endorse the privatization of the current Social Security system.”)

“Even worse, to claim that I intend to cut veterans benefits is particularly outrageous. From the
day I started this campaign in July, 2009, I have had a letter addressed to our Veterans on my
website promising our Heroes this would never happen on my watch,” Hudak said. “and after
himself voting against appropriations needed to protect our troops who are currently in harm’s
way, Mr. Tierney’s fabricating this statement to try to dupe our Veterans on my positions is
egregious and just plain wrong.” (Note: Hudak’s website states, “I strongly support an expanded
GI Bill.”)

John Tierney has been justly criticized recently for refusing to answer questions about his wife’s
four felony convictions for tax fraud, his refusals to provide details of what he knew, and when,
regarding the handling of $7 Million in illegal gambling proceeds in his home for her brother,
Robert Eremian, a fugitive under indictment for 442 counts of racketeering, money laundering,
witness tampering, and other illegal activity. The Massachusetts Republican Party has called for
a Congressional investigation into those issues, questioning whether the Congressman violated
the Ethics in Government Act by failing to discuss them with his wife and not disclosing the
multi-million dollar accounts with the Congress as the law requires, and whether he engaged in a
conflict of interest or other misconduct when he voted in Congress on a law to support his
brother-in-law’s illegal gambling business.

The court case is captioned “Bill Hudak vs. John Tierney, Essex Superior Court, C.A. no. 2010-
2237.” An evidentiary hearing on Hudak’s request for a preliminary injunction has been
scheduled for Wednesday, October 27, 2010, at 2:00 p.m., in the Essex Superior Court, 43
Appleton Way, Lawrence, Massachusetts.

“We look forward to seeing how Congressman Tierney can possibly justify the need to engage in
this type of dishonest conduct in his desperate bid to hold onto this seat,” Hudak concluded. “It is
 time incumbents like my opponent hold themselves to a high standard befitting the trust placed
in them by the voters.”
