With deep regret, that TODAY, after deep reflections, recognizing my smallness Cultural,
Religious, Political, and Professional, facing the below placements, AFFIRM, without fear of
WRONG, that the CRIMINAL "accidents" occurred in Mariana, and Brumadinho, ARE

Art. 177, V (old and new), shows us the certainty that the "privatization" of Companhia

MONOPOLY the Union (Brazilian State), research, mining, enrichment, reprocessing,

Com profundo pesar, que HOJE, após profundas reflexões, reconhecendo minha pequenez
Cultural, Religiosa, Política, e Profissional, frente as colocações abaixo, AFIRMO, sem medo de
ERRAR, que os CRIMINOSOS “acidentes” ocorridos em Mariana, e Brumadinho, SÃO
RESPONSABILIDADES daqueles que “privatizaram” a Companhia Vale do Rio Doce, que se
tornou Vale S.A., uma vez que, além de TODOS os Crimes, já divulgados pela mídia, e por isso,
publicamente conhecidos, podemos, e devemos, DESTACAR o MAIOR DELES, a alteração do
percentual de Aplicação dos LUCROS nas Comunidades, de 80% (OITENTA por cento) para
5% (CINCO por cento).
Logo, se a Companhia Vale do Rio Doce não tivesse sido “privatizada”, TODOS os
Governos seguintes, continuariam a DISPOR de um Importante, e histórico, “BRAÇO DE
FOMENTO”, bem como, também teriam à DISPOSIÇÃO um Volume Exacerbado de Recursos
Humanos, Materiais, e Financeiros, para PROTEGER as VIDAS HUMANAS diretamente
PERDIDAS, e principalmente, para PROTEGER a FAUNA, a FLORA, e as VIDAS HUMANAS que
Delas dependem.
A “fantasiosa crise estudiniense”, por ser conhecida desde de muito, mas deflagrada para
derrubar o EURO, nos apresentou a, concreta, IRRESPONSABILIDADE que foi deixar o
“MERCADO” livre para conduzir qualquer normatização, e fiscalização, uma vez que, a avaliação
feitas pelas Autoridades Internacionais, introduziu no chamado “Acordo de Basiléia” importantes
CRITÉRIOS NORTEADORES da normatização, e da fiscalização, do Sistema Financeiro
Internacional, sendo um deles, a “contabilização” de Ativos envolvidos em “Especulação
Financeira”, cujos valores SÃO SUBJETIVOS.
Além do CRIME LESA PÁTRIA acima citado, apresento, os “hercúleos” esforços, feito por
MIM, um Cidadão Brasileiro COMUM, que se verificaram “INFRUTÉFEROS”, por sermos um País
HIPÓCRITA, feito DE Advogados, feito POR Advogados, e feito PARA Advogados, onde
“Palhaços Trágicos”, em contexto de Trágica Comédia, RECONHECEM, como por exemplo, a 2ª
Câmara do CFOAB – Conselho Federal da Ordem dos Advogados do Brasil, que Operadores
do Direito, incluso os Bacharéis de Direito, não cometem infração ético-disciplinar, ao
apostarem à frente de seus Nomes, a Titularidade Acadêmica de “DOUTOR”, pelo singelo motivo,
de se tratar de “ALCUNHA”, conforme o documento “Porque Sou Doutor Em Direito de Merda”,

avaliando a Ementa 003 2013 SCA do CF OAB, quanto ao uso banalizado da Titularidade de

Sou obrigado a reconhecer o fato, concreto, de que o Brasil é uma “Republica Hipórcita
de Bananas”, uma vez que, desde 1998, através da “Nova Ordem Jurídico-Institucional”,
considerada por alguns como Eu, Vanguardista, Revolucionária, Brilhante, Obra Prima Jurídica,
TODOS os problemas existenciais, de HOJE, já tinham, suas soluções, no mínimo,
ORIENTADAS, e por isso, posso AFIRMAR, sem medo de ERRAR, que poucos, por
IGNORÂNCIA, ou mesmo EM CONVENIÊNCIA, foram capazes de entendê-la, como exemplo cito:
O Art. 231, § 1º , §2º , §3º , §4º, §5º, §6º, §7º(Art. 174, §3º e §4º), nos apresenta a certeza
de que o ESTADO BRASILEIRO reconhe os índios, sua organização social, seus costumes, suas
línguas, suas crenças e suas tradições, e os DIREITOS ORIGINÁRIOS, através da posse
permanente, sobre as terras que tradicionalmente ocupam, competindo à União (Estado
Brasileiro) demarcá-las, implicitamente através de SUA TUTELA, proteger e fazer respeitar todos
os seus bens, reconhecendo também que esta área demarcada são tradicionalmente ocupadas
pelos índios as por eles habitadas em caráter permanente, as utilizadas para suas atividades
produtivas, as imprescindíveis à preservação dos recursos ambientais necessários a seu bem-
estar e as necessárias a sua reprodução física e cultural, segundo seus usos, costumes e
tradições, cabendo-lhes o usufruto exclusivo das riquezas do solo, dos rios e dos lagos nelas
existentes, ratificando a TUTELA DA UNIÃO (Estado Brasileiro) assegura que o aproveitamento
dos recursos hídricos, incluídos os potenciais energéticos, a pesquisa e a lavra das riquezas
minerais em terras indígenas só podem ser efetivados com autorização do Congresso Nacional,
ouvidas as comunidades afetadas, ficando-lhes assegurada participação nos resultados da lavra,
na forma da lei, onde as mesmas são inalienáveis e indisponíveis, e os direitos sobre elas,
imprescritíveis, de tal forma, que É VEDADA a remoção dos grupos indígenas de suas terras,
salvo, "ad referendum" do Congresso Nacional, em caso de catástrofe ou epidemia que ponha
em risco sua população, ou no interesse da soberania do País, após deliberação do Congresso
Nacional, garantido, em qualquer hipótese, o retorno imediato logo que cesse o risco, com o
reconhecimento explícito de que são nulos e extintos, não produzindo efeitos jurídicos, os
atos que tenham por objeto a ocupação, o domínio e a posse das terras indígenas, ou a exploração
das riquezas naturais do solo, dos rios e dos lagos nelas existentes, ressalvado relevante
interesse público da União (Estado Brasileiro), segundo o que dispuser lei complementar, não
gerando a nulidade e a extinção direito a indenização ou a ações contra a União (Estado
Brasileiro), salvo, na forma da lei, quanto às benfeitorias derivadas da ocupação de boa fé,
ressaltando que não se aplica às terras indígenas o reconhecimento de atividade econômica,
presumivelmente, por não se enquadrarem no setor público e no setor privado, quando, então,
DETERMINA que os índios, suas comunidades e organizações são partes legítimas para
ingressar em juízo em defesa de seus direitos e interesses, intervindo o Ministério Público em
todos os atos do processo.
