MEMORANDUM OF AGREEMENT

This memorandum of agreement made by and entered into by and between:

The TARLAC STATE UNIVERSITY, a duly registered and recognized

university with postal address at Romulo Blvd, San Vicente Tarlac City,
Philippines, represented by its President, DR. MYRNA Q. MALLARI,
hereinafter referred to as the “UNIVERSITY”.

-and-
Max’s Restaurant Luisita Branch, a company duly organized and existing under
and by virtue of the laws of the Republic of the Philippines, with office address at
Plaza Luisita, San Miguel, Tarlac, represented herein by its Branch Manager,
Marivic Lisud, and hereinafter referred to as the COMPANY.

-WITNESSETH THAT-

WHEREAS, the students of the UNIVERSITY who are taking up Bachelor of Technical
Teacher Education under the College Education are required to undergo On-the-Job Training
(OJT)/practicum for a period of 300 hours to adequately expose them in actual work situation
and to augment their knowledge and skills;

WHEREAS, the COMPANY supports this program and is willing to help and give the
students of the UNIVERSITY who are taking up Bachelor of Technical Teacher Education in
FSM the necessary training to develop and enhance their knowledge and skills along their field
of specialization and related activities;

NOW, THEREFORE, in consideration of the foregoing premises, the parties do hereby

agree on the following terms and conditions:

SECTION I.
GENERAL PROVISION

1. The On-the-Job Training/practicum is one component of the Bachelor of Technical

Teacher Education in FSM practicum and shall cover the actual activities in the industrial
and/or entrepreneurial linkages/professional exposure.
2. The training activity/practicum shall be equivalent to 300 hours and shall run according
to the standards set by the COMPANY.
3. Any Student-Trainee accepted by the COMPANY shall comply or meet the standards set
by the latter.
4. It is understood and agreed upon that the UNIVERSITY shall be acting as an independent
entity and not as an agent or employee of the COMPANY.
5. The Student-Trainee will be personally responsible for any and all liabilities arising from
intentional or negligent acts while in the course of their training/practicum which may
cause damage to properties or injury to the COMPANY.

6. The COMPANY has the right to reprimand the Student-Trainee if ever the rules and
regulations of the COMPANY will be violated.

7. The OJT Coordinator shall be allowed to visit/follow-up the Student-Trainee during the
duration of the training/practicum.
8. Upon the Student-Trainee’s completion of the OJT/practicum, this contract shall be
terminated automatically unless otherwise renewed by both parties.

SECTION II.
THE COMPANY

The COMPANY shall:

1. Exercise general provision over the conduct of this training/practicum.

2. Determine the number of slots for Student-Trainees that will be allowed in the
COMPANY. The COMPANY shall also conduct the necessary test and thereafter select
and deploy the Student-Trainees to the different units owned and operated by the
COMPANY. Specific work assignments and work scheduled for each Student-Trainee
shall be the sole discretion of the COMPANY and shall be subjected to change from
time to time, if necessary. A copy of such assignments and schedules shall be submitted
to the UNIVERSITY.

3. Assign personnel who shall take charge and supervise the Student-Trainee. The practical
and related work that will be assigned to the Student-Trainee will be in line with the
discipline of the college and related disciplines.

4. Develop, enhance and enrich the knowledge and skills and of the Student-Trainee in the
field of industrial/entrepreneurial/professional activities.

5. Treat the Student-Trainee in a professional manner and shall not subject them to task
and work assignments that are risky, dangerous, disadvantageous and/or unrelated to the
purpose of the Agreement.

6. Ensure the safety and well-being of the Student-Trainee during the training
period/practicum.

7. Release the Student-Trainee upon completion of the required number of hours allotted
for the OJT/practicum.

8. Collate evaluation form, scores and other necessary data for the computation of the
grades after the training/practicum period. The COMPANY shall also furnish the
UNIVERSITY an Individual Performance Evaluation Report and Certificate of Training
for every Student-Trainee after the training/practicum.

SECTION III.
THE UNIVERSITY

The UNIVERSITY shall:

1. Recommend students who will undergo On-the-Job Training/practicum.

2. Designate an OJT Coordinator who will coordinate with the COMPANY.

3. Submit to the COMPANY the following documents:

3.1. Endorsement Letter

3.2. Application Letter
3.3. Medical Certificate
3.4 Waiver/Parental Permit with an attached copy of Parent's ID with Signature
(Same signature with parental permit)

4. Build up the morale of the Student-Trainees and provide assistance on their grievance in
relation to their endeavour.

5. Adhere to the trust priorities of COMPANY for the benefit of the Student-Trainees and
the UNIVERSITY as a whole.

6. Undertake such other functions that shall ensure the success of the training endeavour of
the COMPANY.

This Memorandum of Agreement shall be effective upon the signing of the parties until
completion of the OJT/practicum by the students, unless sooner or later terminated by any of the
parties.

Any renewal or extension of this Agreement shall be valid and binding only when made in
writing and signed by both parties.

IN WITNESS WHEREOF, the parties hereunto affixed their signatures this Twenty
Ninth of May, Two Thousand Eighteen.
