Prakash (Investigating Officer)

Statement – I am Prakash, Inspector, Posted in Punnai Police Station, on 12th June 2017 at

11:00 AM police received a complaint from the metro security officials of violence and

disturbance outside the Indira Nagar metro station. I along with 5 other constables

immediately moved to the place. At 11:15 AM we reached the crime scene where we found

the victim, Pooja was lying in an unconscious state with blood all around her and Kavita was

sitting next to her and Jeyant, accused no.2 was calling ambulance to take her to hospital. At

some distance from them Deven, accused no.1 was lying in an unconscious state with cuts

and blood all around his body. Both were immediately sent to the nearest hospital.

Upon Preliminary examination Jeyant told us that Deven was trying to kill Pooja with a knife

and so in order to save her he threw a stone towards Deven and because of this the public

gathered and Deven caught hold of Pooja and placed a knife around her neck and started

warning everyone to move away otherwise he doesn’t know what he will do. On the refusal

from the public to move away he attacked Pooja and cut her neck from the knife he was

holding and this triggered the crowd and everyone attacked Deven. The same was affirmed

by Kavita.

On asking a few people who were gathered there Kannan, one of the person from the crowd

informed us that he was sitting next to Deven who was sitting next to Pooja on a bench.

Deven was really emotional and was crying and was holding a apple in his hand. Then he

took out a pen knife from his bag and was going to wipe his tears when suddenly a stone

came and hit him on the forehead. A voice was followed with that shouting murder, murder..

Deven was on the ground bleeding while all of this terrified Pooja and she stood there like a
stone unmoved because of shock. All of a sudden the public gathered there and in order to

save himself Deven caught hold of Pooja and placed the knife around her neck and asked the

public to move away but then Jeyant again threw a stone towards him and this panicked

Pooja and in an attempt to run away from Deven she got the cut and public attacked Deven.

On searching the place where we found Deven and Pooja we got the Pen Knife with blood

stains on it. The place that was informed to us by Kannan where he was sitting next to Deven

and Pooja we found a stone with blood stains on it. Considering it to be the stone that was

threw was Jeyant on Deven we stored it and sent it for the forensic test to match the blood

samples.

Then we started to investigate the close circuit camera that was placed facing the crime scene.

On seeing the recordings of the close circuit camera we got to know that it was Jeyant who

threw the stone towards Deven and Deven was not going to harm Pooja till that point of time.

After the public gathered Deven caught hold of Pooja and cut her neck and he was attacked

by the public among whom Jeyant was most violent.

We inquired Kishore, roommate of Deven who informed us that from past few months Deven

was quite tensed as Pooja who was his girlfriend was not talking to her and then even broke

up with him.

We also inquired Kavita who informed us that Deven was following Pooja despite clear

indications from Pooja that she is no more interested in him. He used to call her and disturb

her continuously. He also used to Whatsapp message her despite her clear instructions of not

trying to contact her.

We seized the mobile phones of both Deven and Pooja and asked the telecom company to

provide with their call records. On checking the phones we recovered Whatsapp
conversations between Deven and Pooja and the conversation clear indicated that Pooja had

warned Deven to not contact her but he was still trying for the same and Pooja was

continuously ignoring his calls and messages.

Kavita also told her that Pooja had gone to meet Deven at a restaurant for one last time on 9 th

June 2017 so that she can end everything. At the restaurant too Deven insulted Pooja and

questioned her character. All of this was confirmed by Alex, the waiter at the restaurant.

Kavita informed that on the day of the crime Pooja had gone to meet Deven on his

continuous request and to finally end everything.

On after complying with all the formalities and the investigation the final

report was submitted wherein accused no.1 Deven was charged under section 307 for attempt

to murder Pooja, section 354D for Stalking and section 509 for using words to insult the

modesty of Pooja. Accused no.2, Jeyant was charged under section 325 for voluntarily

causing grievous hurt to Deven, section 355 for use of criminal force with intent to dishonor

Deven and section 504 for intentional insult with intent to provoke breach of peace. Also

unknown persons who attacked Deven were charged under section 358.
