(sample) SURVEYOR'S REPORT

Subject Parcel: "Lot 3, Block 2, Palm Breeze Subdivision"

With this report I bring several of my findings to your attention. This firm completed a field survey of
the subject parcel on January 15, 2005 and the survey map is delivered with this report. The map
shows the parcel's location along with surrounding physical objects and measurements.

Issues in Locating the Written Deed: Original monuments placed by the platting surveyor of Palm
Breeze Subdivision initially defined this parcel. To control the lot's location an original monument
must be "(1) called for in the document, (2) identifiable, and (3) undisturbed."(Brown, et al. section
11.20, page 316). Original monuments were found at the NW and SE lot corners. These meet the
above conditions because they are called for on the subdivision plat, are identified as being the type set
by the platting surveyor, and are undisturbed as proved by harmony of measurements. These corners
are classified as "existent", according to the principle "An existent corner is one whose position can be
identified by an existing original monument ----." (Brown, et al. section 11.19, page 314)

The original monuments were not found at the NE or SW corners, in addition there is no reliable
perpetuation of these locations, therefore these corners are classified as "lost" according to the principle
"A lost corner is a point of a survey whose position cannot be determined by the original monument or
by acceptable evidence as to where the original monument was." (Brown, et al. section 11.19, page
314). These lost corners were restored by proportional measurement according to the principle,
"When excess or deficiency is found, it is distributed in proportion to linear measurements between
original found monuments." (Brown, et. al. section 12.17, page 361).

Issues of Ownership and Title:

There is a possession encroachment by your neighbor to the east up to the existing fence located about
4 ft into your lot. You have a claim of title by deed to the original shown lot line. The neighbor has a
claim by possession. Since that possession is over 15 years old, this claim may be superior to yours in
the eyes of the law. Please see an attorney to pursue legal advice on this situation.

Also, your west lot line overlaps 5 feet across the original section line forming the western boundary of
the tract originally subdivided into Palm Breeze. The owner of the section to the west therefore has a
senior claim to the strip shown over the westerly 5 ft of your parcel. This agrees with the principle, "As
between private parties, a junior grant, in conflict with a senior grant, yields to the senior grant."
(Brown, et. al. Section 11.6, page 303) You should also see an attorney to pursue this issue.
