STATE OF INDIANA } Ryr' EARBORN CIRCUIT COURT ) COUNTY OF DEARBORN ) ENERAL TERM, 2018 JAN 25 201g IN THE MATTER OF ) CRIMINAL INVESTIGATION IN.) he M7 DEARBORN COUNTY, INDIANA'RKO=DERRORW Court couer PROBABLE CAUSE AFFIDAVIT Comes now Detective R, Grant Martin and hereby swears or affirms as follows: ‘That at all times pertinent to the matters discussed herein, your affiant has been employed as a Detective with the Indiana State Police Department. That on or about January 19, 2018, your affiant came to investigate CODY W. BOOTH and MARGIE L. THOMPSON for allegedly committing the crimes of: Count I: Murcer, Count Il: Conspiracy to Commit Murder, Count Ill: Murder, Count IV: Conspiracy to Commit Murder, Count V: Robbery Resulting in Serious Bodily Injury, Count VI: Conspiracy to Commit Robbery, Count Vil: Robbery Resulting in Serious Bodily Injury and Count Vill: Conspiracy to Commit Robbery. In support of Your Affiant's assertion of Probable Cause, the following facts are within Your Affiant’s knowledge, To Wit: That your Affiant has at all times pertinent to the matters herein, been employed as Detective with the Indiana State Police. That on January 19", 2018, your affiant along with other detectives of the Indiana State Police were called to assist in the investigation of a suspected double homicide at a residence just outside the City of Aurora, in Dearbom County, Indiana. While this not a complete assartion of your affiant’s knowledge in this case, the information set forth is sufficient to establish probable cause. INITIAL REPORT On January 19%, 2018 Dearborn County Sheriff's Deputies responded to 5033 Douglas Drive, Aurora, Dearborn County, State of Indiana in regards to a welfare check on Walter Bryant Jr. Walt had not been seen since earlier in the week. Your affiant leamed from that welfare check that a deceased body was found lying at the bottom of 1 the home's basement stairs. A cursory search revealed a deceased female in the basement of the home, sitting in a chair. A search warrant for the residence was obtained. During the search, it became apparent that both deceased were victims of a homicide. Both Faith Craig and Walter Bryant Jr. were identified as being the deceased. Your affiant also learned that a red 2016 Hyundai Accent vehicle registered to Walter Bryant Jr. was missing from the premises. Cody Booth (Walt Bryant's grandson and Faith Craig's son) along with his girlfriend Margie Thompson were missing from the residence. That on January 20, 2018, Booth, driving the aforementioned Hyundai vehicle, and Thompson, riding in the passenger seat, were stopped by law enforcement officers, on KY 80 in the Commonwealth of Kentucky. Booth was arrested on an outstanding warrant for Kentucky Parole Violation. The vehicle was towed from Somerset Kentucky on Saturday, January 20", 2018 to the Indiana State Police Post in Versailles, Indiana. Itwas held in a secure evidence bay until a search warrant was obtained. INITIAL STATEMENT OF CODY BOOTH That on January 20, 2018, Booth waived his Miranda rights and gave a voluntary statement to Det. Tracy Rohifing of the Indiana State Police. This interview was audio and video recorded, wherein Booth acknowledged first stabbing his mother Faith Craig to death, and then luring his grandfather Walter Bryant Jr. to the basement stairs in order to kill Walt, and forcefully pushing Walt down the stairs. Booth further stated to Det. Rohifing that he subsequently stabbed Walt to make certain he was dead. AUTOPSIES On January 21, 2048 an autopsy was performed on Faith Craig at the Hamilton County Coroner's Office. Preliminary results show that Mrs. Craig had been stabbed multiple times and died as a result of her stab wounds. On January 22, 2018 an autopsy was performed on Walter Bryant Jr. at the Hamilton County Coroner's Office. Preliminary results show that Walt sustained blunt force trauma to his head and stab wounds. SUBSEQUENT INTERVIEW OF CODY W. BOOTH (On January 24%, 2018 Det, Rohlfing and Det. Tressler met with Booth, who was in custody at the Pulaski County Jail, in Somerset Kentucky. Booth was advised of his Miranda Rights, to which he waived and made the following statement: Booth stated that early on Wednesday, January 17, he woke up early dope sick thinking of way to get some drugs to keep him and Thompson from getting sicker. Booth said his mother was sitting in the chair texting, and he crawled behind her chair with a belt in his hand and the intention of strangling his mother. Booth said, "he couldn't do it” Booth went upstairs and got a large butcher knife and placed it a brown chair near his mother, Booth said he sat an his mother's lap/arm rest of the chair and told his mom he was real sick and that he loved her. Booth said his mam looked at him and sald, "you are getting ready to do something you don't want to do,” to which Booth said, "yes." Booth then placed his mother in a headlock and she started yelling for her dad. Booth said he put his hand(s) over his mother's mouth in order to quiet her and she bit his finger. Booth said he told Thompson to get the knife and Thompson came over and “stuck” his mother, Faith a couple of times. Booth said after his mother was dead, he told Thompson that he had to kill his grandfather, Walt, Booth said Walt was upstairs in the living room and had just taken the trash out and was preparing to go have coffee with friends. Booth said he asked Walt for money and Walt told Booth that he didn’t have any money. Walt also told Booth that he needed to detox, Booth said he was trying to get Walt downstairs in order to kill him. Booth said Thompson was downstairs, and as Walt started to go downstairs, Booth said he shoved Walt with everything he had and Wait flew the downstairs landing head first either on the bottom step or the concrete landing. Booth said he went downstairs and rolled Walt over and he made a groaning sound. Booth stated that he was not sure if Walt was dead, so Thompson came over and stabbed Walt one time. Booth said Thompson took Walt's wallet which contained $180.00 in cash and they got dressed and headed to the city. Prior to leaving for the city, Booth took rings and other jewelry from his dead mother’s hands. Booth said they took Walt's red car and headed to the Colerain area of Cincinnati to buy drugs. Booth said they returned 3 back to Watt's residence to get clothes and other property to sell. Booth said they took Watt's military medals, two guns, one being a 410 shotgun and the other a double barre! shotgun that they took to a pawn shop in Cincinnati. During this time, Booth said “he put a marker in Faith's hand and wrote a bullshit note about them having Booth’, Booth sald it was also upon the retum trip they got the knife out of Walt's chest. Booth rinsed the knife off and hid the knife under the basement freezer. Later that aftemoon, Booth said they went to a friend’s residence in Cincinnati. While in Cincinnati, he and Thompson tried cashing a $1000.00 check that Booth wrote to Thompson on Watt's account at the First Financial Bank. Booth sald sometime late on January 17° or 18, he and Thompson made another trip to Walt's house in order to get additional property to sell for drugs. Booth said around 2:00 a.m. Daniel Craig, Faith Craig's husband pulled into Wall's driveway. Booth said he went downstairs and used a telephone and dialed *67 and called Danie! Craig. Booth told Danie! that he needed a ride from a location on SR 48 in Lawrenceburg in an effort to try and get Daniel away from Walt's residence. Booth stated he didn’t want Daniel to know they were inside the residence and Booth feared Daniel would notify the police. Booth said while they were at the residence the second time, he wrapped Walt in a blanket and tried pulling Walt up the stairs, but could not physically get Walt up the stairs, Booth seid their plan was to put both Welt and Faith's bodies in Walt’s red car and dump the car into the Ohio River. Booth said he and Thompson loaded Walt's televisions and immediately lef the residence in Walt’s red car around 3:00 AM. Booth said they headed towards Markland Dam and then to Cincinnatt in order to avoid detection. Booth said when they arrived at a friend’s house in the city, Booth traded one of Walt’s TV's to an unknown individual for $50 and "a gram”. Booth said when he got up Friday, he went and purchased more drugs. Later on Friday, Booth said he and Thompson pawned three of Wall's golf clubs for $50. Booth said on Friday, January 19", late in the afternoon, he and Thompson drove to his father’s residence in Somerset, KY. Booth got $230.00 from his dad and he and Thompson came back to the Cincinnati area where they purchased more drugs from a friend and they spent the night at the Super 8 Motel in Florence, KY, On January 20", after Booth got up, he learned from the news that Walt and Faith's bodies had been discovered by law enforcement. Booth told Thompson that "it 4 was time to hit the road.” Booth further stated they stopped at the first rest area and threw away a checkbook, garage door opener and other property of Walt’s. Booth said as they were driving southbound, he had a phone conversation with his dad (Ron Booth) and knew the police were onto them because his dad had been crying. INTERVIEWS OF MARGIE L. THOMPSON That on January 20, 2018, after the Hyundai vehicle was stopped, Thompson requested Det. Tom Baxter to speak with her. Your affiant and Det. Baxter conducted a voluntary, noncustodial interview of Margie Thompson. Thompson initially denied any involvement in the deaths of Walter Bryant Jr. and Faith Craig. As the conversation progressed, Thompson acknowledged that she was present at the Bryant house on. Wednesday, January 17, 2018, and Booth told her that he had hurt both Walt and Faith and they were dead, Thompson stated that she and Booth were traveling in the Hyundai vehicle, and she had placed several items belonging to Walt in a bag which had been disposed of in a trash can at a rest stop just south of Florence, Kentucky, ‘Thompson and the Detectives attempted to obtain transportation for her back to Indiana. Then, when that falled, Thompson was taken back to Indiana by Detectives Baxter and Martin at her request, On the way back to Indiana, Thompson directed your affiant and Det, Baxter to a rest park where the bag and items of property including a wallet, checkbook, keys and garage door openers were recovered. Thompson identified these items as belonging to Walt. Thompson was dropped off at her parent's home in Lawrenceburg. On January 26, 2018 Detectives Tom Baxter and Tracy Rohifing met with ‘Thompson at her parent's residence. Detective Rohifing asked to speak with ‘Thompson and told her she was not under arrest. This conversation took place in Det. Rohifing's unmarked police car. Detective Rohlfing asked Thompson If it was okay to go to Walt’s residence and have further discussion and explanation, and Thompson agreed to do so. After arriving at Walt’s residence Detective Rohifing immediately, and prior to any discussion of the case, advised Thompson of her Miranda rights from a card that Detective Rohifing carries in his billfold. Thompson waived her Miranda rights and made the following statement: Thompson told Detective Rohlfing ebout her and Booth’s daily activities on Monday, January 15" and Tuesday, January 164, 2018, Thompson went on to say that 5 when she woke up Wednesday, January 17", around 6:30-7:30 a.m., Booth went behind the chair that Faith was sitting in with a belt. Booth know that the belt would not go around Faith's neck, so Booth came around the front of the chair where Faith was sitting and Faith tells Booth he is getting ready to do something he is going to regret. Booth tells Faith that he loves her and puts his arms around his mother's neck. Faith began screaming ‘dad’ and she bit Booth’s finger. Booth tells Thompson to get the knife which was laying on a chair. Thompson said the knife came from upstairs. Thompson started to hand the knife to Booth. At this point, Booth and Thompson together stabbed Faith, Thompson stated that Booth stabbed Faith a second time. Booth told Thompson we have to, “go do him’, referring to killing Walt. ‘Thompson stated that both of them went upstairs and Booth was telling Thompson that she needed to kill Walt. Thompson said Walt was dressed and getting ready to leave to have coffee. After going downstairs, Thompson stated that Booth “threw grandpa down tho stairs.” Thompson said she heard Walt say, "son of a bitch’, Thompson said Booth ran down the stairs and Walt was trying to turn over. Booth rolled Walt over, and they both stabbed Walt. Then according to Thompson, Booth stabs Walt a second time. After Walt is dead, Booth proceeds to take Walt's wallet and other personal items. Thompson said Booth later removed the knife from Walt's body, cleaned it and hid the knife under the freezer. Thompson observed Booth to take two TV's, a laptop, two guns, rings, bracelets and three golf clubs. Thompson said they went end pawned the stuff and got drugs. At some point, Thompson and Booth came back to Walt’s house to get "some more stuff to sell’ and Dan, (Faith's husband) showed up. Booth went downstairs and called Dan and asked him to pick them up (from another location). Booth was trying to get Dan away from Walt's residence. ‘Thompson said Booth took a check out of Walt's checkbook and Booth wrote the check to Thompson for $1000.00. When Thompson later presented the check at the bank in Cincinnati, bank representatives wanted verfication and would not cash the check. PAWNED ITEMS Through other investigative measures, it was leamed that on January 17, 2018, at a pawn shop in Cincinnati, Thompson had pawned jewelry, including Faith Craig's wedding rings. On January 18%, goif clubs were pawned at a pawn shop in Cincinnati, Ohio. These clubs are believed to have belonged to Walter Bryant Jr. On Thursday, January 25, 2018 your affiant along with Det. Baxter recovered two shot guns, believed to belong to Walter Bryant Jr. from another pawn shop in Cincinnatl Pawn records show that Thompson had pawned these items on January 17. Allof the above items were recovered and are being held in evidence WALTER BRYANT JR, FIRST FINANCIAL BANK ACCOUNT In the course of the investigation, your affiant learned that voicemails were left on Watt's home telephone answering machine. These calls indicated fraudulent activity on Walter Bryant Jr.'s account. Your affiant and other detectives went to First Financial Bank in Cincinnati and reviewed a surveillance video from January 17, 2018. In this video, Thompson attempts to cash a check for $1,000.00 payable to Margie Thompson, on the First Finanoial Bank account of Walter Bryant Jr. This attempt to cash the check was unsuccessful. ‘SEARCH OF HYUNDAI VEHICLE On January 23, 2018 a search warrant was executed for the red Hyundai. Inside the vehicle, the following items were located: military medals, shot gun shells and clothing that tested presumptive positive for blood. That based upon the foregoing facts, your affiant believes that probable cause exists to believe that CODY W. BOOTH and MARGIE L.
