My name is Mlchael F. Olenick I am a resident of Palm


Beach County"

I am the co-founder a small business that/ among other


activities, analyzes foreclosure case information.
My ccll eague Lisa Epstein broug'ht the above*captioned case
tc my attention and asked me to search for others that fit
the same fact pattern: docket entries that prove non-
compliance with court orders that mandate mediation or
conciliation.
My research uncovered o*'her incidences of non-compliance tc
medlation and conciliation orders. My engineering wor"k is
ongoing. Early analysis indicates that the non*compliance
errident j-n this specific case is not an isolated incident.
Wtrile there is no requirement for standing to petition the
Court to issue an order to show cause for indirect cri-minal
contempt, blatant disregard for the authority of our
judiciary Lras a ripple effect thar affects the entire
community- Contempt is a crime andn like any crime wave/
erodes the security and well-being of every person in the
crime-infected neighborhood.
I am willing' to share the findings of my research, either
in sunimary form or in as much detail as requested, with the
Court and/or law enforcement.

justicen particularly with respect to the foreclosure crisis
affecting Arnerica today
1. I value the freedoms and rights afforded to Anerican

B. I value the freedoms and rights afforded to the citizens of
Florida in The Constitution of the State of llorida includinq the
riglhts of due process delineated in Section II and Section IX.
9. f value t-he right. to live in a state where there exists a

sepa.ration of powers between the executive, legislative, and

judicial branch.
10. I believe it i-s vital to our community, our country/ and to
every American to ensure access to a judiciary free from
political pressure, even when driven by perceived pressing
economic interests. trconomically driven political pressure on

the judiciary such as the pressure from the Florida Legislature


upon the Florida Supreme Court to .set a goal of a 622 reduction
in foreclosure case backlogr within a short t-ime frame is
reminiscent of l-he manipulation of the judiciary by the Ki-ng of
England against which our foundinq fathers complained of when

they penned the Declaration of Inciependence. These concerns led


t'c the bedrock constitutional principle of independent courts, a

core loalance of power at the federal and state level.

an expectation of compliance with orders by the courts of- the

oath to devote myself to those coinmitted to my care.

responsibility which includes helpinq others meet the most basic
needs of alf lrving things-food, water, and shelter.
15. I have personally observed over 1,000 foreclosure hearings
in the 15th Judicial Circuit, in and for Palm Beach County,
Florida.
16. I have seen all- walks of society lose their homes, many

withoul alLernative housinq options - I watch them a1l-; t.re


families with youngr children, the disabled" hard-working or new1.y

unemp.loyed,n the men / the women, all ethnici1,les, all agtes, and
their affected animal companions. The most horrifying is the
elderly, some in their BOs and 90s, whose homes were fully paid
cffn yet were lured into over-inflated, teaser rate loans, and

n3w are in foreclosure. Some of these older FloriCians have no


livinEi children, flo lifespan feft in which to recover from this
economic blovr, and no place to go. I question daily how we as a

societ-y can treat our citizens of all ages, and our beloved pets
t-his r^/ay, evictinq them from the only homes they know.

18. Although I am not an attorney, I have acted as an

'Interested Person" pursuant to Fla,R.Civ.Pro 1-420(e) (U.5. Bank

v savola PB Case No. 502007CA008051) and an Amicus curiae (e"q.,


USBC Bank v Santiago No: 502008CA016305) in several foreclosure

19. I have submitted cornments to the Ftorida Supreme Court Task

Force on Residential Foreclosure cases sc09-54 & SC09-1450.


20. I spent numerous hours and great effort- towards the defeat
cf the non- j u,d.icial f oreclosure bills HB1523 and SB227O -

2l - I have hosted strategic sessions for: those who are equally


concerned about America's Foreclosure Crisis. These have been in
the forn. of soci-al gatherings" formal seminars, small group
meetings/ etc.
22 - I have notified Chief Judgre Peter Blanc of my reports of
incidents of foreclosure Plaintiffs'faw firms'misconduct to
m.any regulatory and enf orcement agenci-es including but not
limited lo, the Professional Committee of the Paln Beach County

Bar Association, the Florida Bar, Office of the Attorney General,


FDLE, the U.S. Department of Justice, the FBI, FINRA' the OCC,

tae SEC, the FDfC, SIGTARP' etc..

23 - I have observed contemptuous behavior on the part of many

higih-volume foreclosure Plaintiff law firms, specifically,


multipte egregi 611s violations of Court Orders otherwise termed
"fndirect C::iminal ContempL".

24 - I am aware of the great burden that Wall Street's reckless
gamble has placed squarely on the back of Florida's judlciary.
25 - The 1sth Judicial Circuit foreclosure elecironic docket lags
up to eight weeks behind the filing of a pleadi-ng. A pleading
filed today might be added to the computerized docket in six to
eight weeks, after which" there is an addrtional four: to six week

fag before the pleadinq is fj ted in the hard copy court file.
The foreclosure Plaintiff law firms are noLorlous for their lack
of nolifying defendants or their counsef
26. In the spring 2070 session, FLorida's legislature rejected
leqisl-ation written by the Florida Bankers Associat.ion which, if
passed, would have removed new foreclosure cases from the court
system unless the homeowner was able to pay up to $1,900 in
filing fees in addition to paying for legal fees. By rejecting
this legislation, the Florida Iegislature soundly rejec*.ed Lhe

Florida Banker Associations' attempt at jettisoning the due

process rights of Fl-oridians.


21 - F-iorida's leqislature allocated a one*time stacewide
allocation of funds Lo be distributed throughout the Florida's
court system. The 15th Judicial Circuit recej-ved two allotments:
$540,C00 earmarked to cover sal-aries of two senior judges anC six
case managers; $403,000 to fund document management tasks.
28 " 11, -is increasi-ngly apparent that these funds were

exclusively budgeted to fund the newly evolved "rocket-docket"


sys*"em of fo::eclosure case dispensation without any consideration
given to monitoring compliance with Florida law, principles of

equity, or the mandatory Florida Supreme Court Foreclosure Task

Irorce/ s orders in AOSC09-54 and SC09-1460. These two orders were


crafted after a year of careful consideration and effort by the
r,rembers of the Task Force and Supreme Court Judges who took the
unusr:al- and significant action of requiring mediat.ion in specific
cases and amendinq the Rules of Civil Procedure for foreclosure
Furthermore, it is increasingly apparent that the

budqetary priority is flip-fIopped. The dramatic acceleration of


foreclosure sununary judgment hearings is aggravating ttre
catasLrophic legral outcomes of the preexi-sting and growing
backtor; of documents neither docketed nor filed.
29. Confidence in the docket's depiction of case actirrity has

C,eteriorated to the point that hearings and d-eadlines are missed,


effectively eliminatinq opportunities to move for a reheairing' to
oppose a pleadi-ng, to timely file responses or objections, to
move to vacate a sale, and/or to file for an appeal.
30- In this specific case/ Deutsche Bank v. Zapata, Case No

502008CA017384XXXMB, the parties were ordered to mediation.

31. Before mediation, the plainti-ff, by and through counsel


tne Law Offices of Davi d ;i. Stern, led by Florida Attorney Davld
J. Stern, sold the house in direct vioJ.ation of this Court's
Ordern as evidenced concluslvely by the record.

33. Mr. Sl-ern is a higih-volume foreclosure filer who presumably

is aware that plaintiffs in owner-occupied foreclosures bear the


sole burden of fronting mediation fees pursuant to Florida
Supreme Court Administrative Order AOSCO9-54.
34" Mr. Stern is a high-volume foreclosure filer who presu:iiably

is aware cf the fact Lhat foreclosure cases initiated prior i,o

the effective date of the Florida Supreme Court Administrative


Order AOSC09-54 may be court ordered to mediation and the upfront
pa\.ment of the mediation costs to be borne by the party or
parlies at the discretion of the presi-ding judge.
35. Florida Mediation Group, Inc. presumably is aware of the
fact that foreclosure mediation of owner-occupied foreclosur:es is
fronted solely by the plaintiff pursuant to Florida Supreme Court

36. Fiorida Mediation Group/ Inc- presumably is aware of the
fact that fcreclosure mediation of owner-occupied foreclosures is
fronted solely by the plaintiff pursuant to the December 28, 2009

Florida Supreme Court Administrative Order AOSC09-54-

I am a foreclosure crisis activist, a consumer advocate, and


air investor advocate. I spend a great deal of time, at-tention,
and effort focusinq on America/ s foreclosure c;:isis. I am

w,itnessing its deleterious effects on my community, my stat,e, ily


country, my fellow citizens/ and, on the state and federaf level,
o'i.ii. three branches of government, our law enforcement agencies,
anci our regulatory agencies.
2. I am deepJ-y af fected by the immeasurabf e human misery caused
equaily by the julienning, rebundling, derlvitizlrre, and shorring
of securitized mort.ga-ge. In an a1-tempt to lessen the global
economic darnage, the U.S. Treasury and the U.S. Senate/ over the

search for Ms. Zapata's docket (Case No. 50200BCA0173B4XXXXMB),

6. Scrol-ling down the docket, i-t became apparent tha.t. there had
been a. violation of this Court's Mediation Order,' Ms. Zapatans
house hacl -i"n fact been so].cl before Court ordered nediati-on. I
believe that this Court's Order was issued pursuant to an Order
of the Flo::ida Supreme Court No. AOSC09-54 which became effective
for all residentiaf foreclosure cases on December 28, 2009. Tne

plain't-iff, by and through the many attorneys of record and

various local freelance counsel, the Law Offices of David Stern


has intentionally, and with knowledge aforethought disregarded
iwo Court Orders. Specifically, the record reflects a l-ack of
compliance with the Order cf the Circuit Court Judgie Roqer Co'lton
in lt{s. Zapata/ s case and the Administrative Order of the Ff orida
Supreme Court No. AOSC09-54.

On April 7n 2014, a hearing was held on Plaintiff's Motion
for Summary Judgment. On the date of sunmary judqmenl,

Cclton. One of these orders granted mediation to be scheduled to
