County/District Court ‘THE PEOPLE OF THE STATE OF COLORAUO City and County of Denver, Colorado Offense Case No. 2016-271739 \seatep AFFIDAVIT FOR THE ARREST WARRANT FOR THE PERSON(S) OF: Name: Brian Scott Pattison, DOB: 11/25/1985 = MURDER IN THE FIRST DEGREE, C.R.S. 18-3-102, a Class One Felony and FIRST DEGREE ARSON, C.R.S. 18-4-102(1), Class Three Felony. Your Affiant Detective Mark Crider, 95014, has been a police officer for the City and County of Denver since January 2, 1995 and has worked as a detective since April 2002. Your Affiant spent one year investigating assaults and domestic assaults, one year investigating crimes against children including sexual assaults and serious bodily injury assaults. Your Affiant was assigned to the Criminal Investigation Division Homicide unit in June of 2004. Your Affiant has attended numerous schools and training seminars in regards to death investigations, including, but not limited to suicide investigations, child death investigations, domestic related homicides and general homicide investigations, crime scene investigations, and crime scene reconstruction. Your Affiant has had personal experience and training in dozens of homicide investigations. Your Affiant obtained the following information from personal observations, interviewing witnesses and reviewing police reports of fellow officers. Your Affiant states under oath that the facts known to the Affiant which establish probable cause to believe that criminal offense was committed, and that the offense was committed by the above named person(s), are the following: On May 2, 2016, at approximately 3:15 am., your Affiant was contacted by Denver Police Homicide Sergeant James Kukuris regarding a death investigation at 727 East 26th Avenue in Denver Colorado. Sergeant Kukuris advised that firefighters had responded to this location on a fire and found an unknown deceased person inside of the apartment. On May 2, 2016, at approximately 4:10 a.m., your Affiant arrived at 727 East 26! Avenue. The street Was blocked off with fire trucks and police officers were on scene. This location is a two story brick building on the north side of East 26th Avenue. A retail business, Rosenberg Bagels, is on the first floor of the building with the address of 725 East 26th Avenue and the apartment where the body was found is on the second floor of the building and has the address of 727 East 26th Avenue. Access to the apartment is from a single exterior door on the first level next to the bagel shop entrance. There is a surveillance camera on the exterior of the building pointed in the direction of the apartment front door. Your Affiant spoke with Denver Fire Department Arson Investigator Jonathan Riggenbach. Investigator Riggenbach told your Affiant that this moming at approximately 2:30 am., firefighters from Station #3 and Tower #4 responded to this location on a structural fire. When firefighters arrived they extinguished a fire in the apartment on the second level of the building. While in the apartment, firefighters discovered a body in a closet. Denver Health Medical Center paramedics responded to the Scene and pronounced the unknown person dead at 3:53 am., through a field pronouncement by Doctor Eberhardt. Investigator Riggenbach told your Affiant that he had entered the apartment and observed a gasoline can va the floor in the area where the fire may have started. Investigator Riggenbach advised that he believed at this point that the fire started in the upstairs apartment and not in the bagel shop and the location of the gas can made the fire suspicious. Officer Emily Capser told your Affiant that she had responded to the initial call for service at the fire location and subsequently contacted the Property Manager, (008 by phone. Ms. QAR identified the only tenant in the upstairs apartment at 727 E. 26" Avenue as Shane Richardson, dob: 11/21/1986. On May 2, 2016, at approximately 7:30 a.m., your Affiant authored a Search Warrant/Affidavit for authorization to search the apartment at 727 E. 26% Avenue. Retired Denver County Court Judge Raymond Satter reviewed the affidavit and approved the Search Warrant. At approximately 8:15 am., Denver Police Homicide Detective Daniel Andrews and members of the Denver Fire Department's Arson unit executed the Search Warrant. Your Affiant subsequently responded to the scene and assisted in the search of the apartment. The interior of the apartment was heavily damaged by smoke and fire. During the search the body was removed from the scene and transported to the Denver Morgue. The body, which had been bued beyond recognition, was subsequently identified as Shane Richardson, dob: 11/21/1986. Arson Investigator Riggenbach conducted an investigation regarding the fire and advised your Affiant that the fire was the result of an intentional act of arson. Several items with DNA potential were also recovered including several empty beer cans, soda cans and a gas that is believed to be associated with the arson. Your Affiant has completed a Laboratory Request for all of these items to be examined for DNA. ‘Your Affiant reviewed Colorado state motor vehicle records and confirmed that Shane Richardson has a 1997 Subaru and 2 2012 Ducati motorcycle currently registered in his name. The motorcycle has been located at family member's home, but the Subaru has not been located and is believed to have been stolen by the unknown suspect. On May 3, 2016, Forensic Pathologist Meredith Frank conducted an autopsy on the unidentified body at the Denver Office of the Medical Examiner. After the autopsy, Dr. Frank contacted your Affiant by phone and advised that the decedent had an incapacitating gunshot wound to the head and the bullet had exited the body. Doctor Frank also advised that it appeared that he bullet that caused the injury was of small caliber. On May 5, 2016, your Affiant was contacted by Investigator Chip Whitley from the Denver Office of the Medical Examiner and was advised that the body found recovered at 727 E. 26th Avenue has been positively identified as Shane Richardson, dob: 11/21/1986. On May 5, 2016, your Affiant and Detective Dan Andrews went to Rosenberg’s Bagels and Delicatessen and viewed the interior and exterior surveillance recordings. The exterior surveillance recording shows the victim, Shane Richardson and an unknown bald white male enter the victim's apartment on Friday afternoon, April 29, 2016.The unknown bald white male was subsequently positively identified as Brian Pattison, dob: 11/25/1985. The victim and Pattison male entered and exited the apartment throughout the day. In the evening the victim, Pattison and another male, subsequently identified as INNIS, @UNHH/1972, entered the victim's apartment. Again the men exited and entered the apartment in the next few hours and at one point ST icft the apartment. During the early moming nours of Saturday, April 30, 2016, the victim and Pattison were in the apartment alone. Over the next few hours Pattison exited and re-entered the apariment several times camera, Earlier in the morning Pattison was wearing white tennis shoes and a blue sweat shirt with the letters “DKNY” printed on the front. Pattison was now wearing dark shoes and a black and white motorcycle style jacket. Over the next 45 minutes Pattison was observed on the recording entering and exiting the victims apartment several times. Each time Patison exited the apartment, he was carrying items from the apartment. Pattison walked into the 2500 block of Clarkson Street each time and returned within a few minutes without the items that he had left with. On the video your Affiant watched Pattison exit the victim's apartment carrying several items including: -Guitar case (possibly with a guitar inside) ~Several large bags/backpacks ~ Large screen flat television At 7:51 am. Pattison exited the apartment and used a key, which appeared to be on a lanyard, and locked the apartment door. The male walked south into the 2500 block of Clarkson Street and did not return on this date. Pattison would later tell your Affiant that he had loaded the items from the victims apartment into the victim’s white Subaru parked on Clarkson Street, Your Affiant continued watching the surveillance recordings and noted additional activity at Shane Richardson's apartment on Sunday, May 1, 2016. At approximately 10:16 pm., on this date your Affiant observed two people walk up to the apartment from the 2500 block of Clarkson St. One of the persons who appeared to be Pattison was carrying something in his hand which was concealed with a Jacket. This person used a key to open the apartment door and entered the apartment with the second Person. The unknown second person was dressed in a unique multi and brightly colored hooded Sweatshirt. Both persons exited the apartment approximately six minutes later and the person in the colored sweat shirt was carrying what appeared to be a skateboard. Almost simultaneously as the Persons exited the apartment, the interior business surveillance cameras showed what appeared to be s fire inside the building. Arson Investigator Riggenbach would subsequently advise your Affiant that it appeared that the fire was started at this time and the fire smoldered until SND observed the smoke coming from the building more than four hours later. Gn May 5, 2016, at approximately 6:00 p.m., your Affiant and Detective Daniel Andrews interviewed, GREEEEEEERE, dob: NP/1983, at the E] Paso County Jail in Colorado Springs. Mr. SNR had been arrested earlier on this date on charges unrelated to this investigation. Mr. INN was a friend of Shane Richardson and had called 911 after seeing smoke coming from Richardson's apartment while he was walking to the apartment. Mr. SIIB told your Affiant that he had stayed with Shane in the apartment off and on for the past two months, He said that it was his understanding that Shane Was going to party and get a tattoo from a guy they had met at the Good Company bar in Colorado Springs. He said that he believed the man’s name was Chris and he was a tattooist. Mr. QI said that Shane had the following property in his apartment: -Large screen television -Playstation -Small metal safe -Skateboard -Flying wing suit -Cell phone -Longboard (skateboard) -Large black duffle bag ~38 caliber Ruger semi-automatic pistol -A second unknown pistol On May 6, 2016, at approximately 8:40 p.m. your Affiant interviewed SE, dob: @mmm1972, in the 1400 block of Market Street. Mr. Sllmmgp was observed on the surveillance recordings outside of the victim's apartment with the victim and the bald white male. ‘lmmm§ said that while in the apartment with the other two men, the bald white male was playing PlayStation on the big screen flat television in the apartment. (_lgmm did not know the man’s name, but said that he was tattooist and had numerous tattoos including a tattoo of an unknown name on his spine vertically, On Sunday, May 8, 2016, at approximately 5:00 p.m., your Affiant interviewed (INNS for a second time at the El Paso County Jail. Your Affiant showed @NNIEB a printout of the white bald male from the surveillance recordings at Rosenberg’s Bagels. MMNIMNNNMB said that the man in the photograph looked like “Chris” the tatooist, but he thought that Chris had a litle bit of hair, Imm told your Affiant that on Sunday evening, May 1, 2016 he went to “Chris's” house because he was tunable to get in touch with Shane. ag used Google map on your Affiant’s I-Phone and pointed out the home at 2825 Zephyr Drive, Colorado Springs as Chris the tattooist’s house. Your Affiant observed SNEED type this address into the google map. KNINNNNES said that on that Sunday evening, Chris was home, but was acting strange and said that he had to leave prior {0 SIN asking him about Shane. Your Affiant subsequently drove by this address on Zephyr Drive and noted that the hhome is directly behind the Good Company bar, which according to @HNNININR is the bar where they met Chris the tattooist. On Monday, May 9, 2016 Detective Andrews attempted to identify the suspect through public records and social media searches. Public records list the residents of 2825 Zephyr Dr. as @i@ & UND GREEP. Mis, GEBAW was known to formerly use the last name of Pattison. While searcl 1g Facebook records for Pattison, Brian Scott Pattison DOB: 11/25/1985 was located and had a strikingly similar appearance to the aforementioned bald white male. A criminal history search of the suspect showed that he was on parole, listed a Colorado Springs address and had been arrested by the Colorado State Patrol on Wednesday, May 4, 2016. Detective Andrews contacted the arresting officer, CSP Trooper Santiago Marquez #5407 and leamed the following. Trooper Marquez stopped a 2001 Ford sedan, Colorado license #75199 (listing to SIRI in Colorado Springs) about 25 miles north of the Colorado/New Mexico state line for speeding. He eventually identified the driver as Brian Pattison, dob: 11/25/1985 and arrested him for impersonation and traffic charges. Search incident to arrest the suspect was found to have a Ruger .380 caliber pistol concealed in his right front pant pocket. He was booked into the Las Animas County Jail at that time. On Tuesday, May 10, 2016 at 10:00 am. your Affiant retrieved surveillance video from Cervantes Masterpiece Ballroom at 2637 Welton St-a live music venue. The footage shows the victim, and the bald white male entering the box office at approximately 5:00 p.m. on Friday, April 29, 2016 to buy two tickets to that night’s show. On May 11, 2016, an ATF trace report was completed on the Ruger semi-automatic .380 pistol that Pattison had in his possession at the time of his arrest by Trooper Marquez. According to the ATF report received the following day, this firearm was last purchased by being Shane Richardson’s father ‘on January 19, 2012. It should be noted that Shane Richardson’s mother, SI Simm, told your Affiant that her ex-husband, QE had given Shane at least one handgun. At approximately 11:00 am. your Affiant spoke with Forensic Pathologist Meredith Frank on the phone regarding the cause and manner of death of Shane Richardson. Doctor Frank told your Affiant that the cause of death is gunshot to the head and the manner of death is homicide. At 2:30 p.m. your Affiant and Detective Andrews met with Department of Corrections Parole Officer Rohan Ellis in his Colorado Springs office. Officer Ellis has been supervising Brian Pattison since his parole date of March 15, 2016. Officer Ellis advised \your A ffiant that Pattison listed his home address as 2825 Zephyr Dr. in Colorado Springs and said that he had conducted a home visit/parole compliance check on Pattison at that address on March 21, 2016. Parole Officer Ellis also said that according to Pattison’s documented tattoos, he had a tattoo on his spine with the name of “Serenity”. At 6:20 p.m. your Affiant contacted Ms. QUNNNNNENN at a recreation center near her Colorado Springs home. Ms. SINNNNB was believed to possibly be the girftiend of the suspect. Ms. @lNNNB agreed to speak to your Affiant. She was shown a single unmarked still photo which had been captured from the video surveillance footage from Cervantes showing Pattison and Richardson buying tickets, for a show on Friday, April 29, 2016. The photo depicts a bald, white male, with sunglasses and a blue hooded sweatshirt with “DKNY” written across the chest. Ms. GUNN immediately identified the pictured party as her boyfriend of several weeks- Brian Pattison. ‘Ms. @REEB went on to tell your Affiant that she knows the suspect lives at his mother’s house at 2825 Zephyr Dr., although he had spent the night at her home a few times. She said that two Fridays ago, Pattison told her that he was going to Denver for a “tattoo party.” Ms. {NIB was shown a calendar and stated that she was talking about Friday, April 29, 2016. She said that she did not see him again until about 11:30 am. to noon on Saturday, April 30, 2016. At that time Ms. q@MNmmNPsaid that Pattison arrived to her house in a “white Subaru.” He told her that the Subaru belonged to the “guy I did the tattoo party for,” and said that he was allowed to borrow it for a few days as the owner had flown out of the Colorado Springs airport. Ms. S4Bstated that she didn’t see the Subaru again after Iunch on Saturday. On Sunday, May 1, 2016 Ms. QIN said that Pattison’s sister SHEED was having a baby shower for family members. Prior to going to the shower Ms. 4B went to the Pattison’s home at 2825 Zephyr Dr. and met his mother, QIN) While at the house Ms. @ENNNBB said she went into Pattison's room Which she said was upstairs. Ms. SNNNNB told Your Affiant that she noticed a large (she estimated 42") flat screen TV and a home gaming system in the bedroom. She said that neither item was hooked up nor they didn’t appear to have been set in place within the room. Ms. @MMM stated that on Wednesday, May 4, 2016, she'd asked for Pattison’s assistance with some yard work. He asked to borrow her vehicle (a 201 1 Ford sedan-CO license #751 J&B) to run over to his mother's house on Zephyr to pick up a leaf blower to help with the yard work. She agreed and he left her home in her vehicle. She told Your Affiant that earlier in the day he'd asked for a loan of $300 “to ay for his parole” and said he'd pay her back the next day when he got paid. Ms. said that after the suspect left her home in her vehicle she did not see him or it again until she received a call from the suspect in the Las Animas County Jail. He told her to come to the jail so her keys could be released to her so that she could pick up her car. Upon arriving at the jail the suspect refused to give Ms, ME her money back stating he'd need it when he went to prison. She told Your Affiant that she believed he was fleeing the state, She retrieved her vehicle from the side of I-25 where Trooper Marquez had parked and locked it. May 11, 2016, at approxt,uately 1:05 am., your Affiant and Detective Andrews executed a Search Warrant at Brian Pattison’s residence at 2825 Zephyr Drive with the assistance of the Colorado Springs Police Department. Pattison’s mother, NNN, dob: 4NNNB8/1966, and her husband, GEEBEEEBED were present in the home at the time of the warrant. Ms. @INQEND said that her son, Brian, lives at the home and she pointed out his bedroom. Ms. §HRNMNB said that Brian left for Denver on Friday afternoon, April 29%, to give tattoos at a friend’s erty. Brian was supposed to return on Sunday, but he unexpectedly retumed on Saturday. Ms. GBB said that on Sunday she noticed a large flat screen television, a play station and a camera in Brian’s bedroom. Brian told her that the person who he had tattooed in Denver paid with this property instead of money. Ms. SINNND said that she knows her son to be a thief so she asked him to meet this person. These items were no longer in the home, but she said that a safe in her son’s closet was new and a hoody and a leather motorcycle jacket in the closet had recently appeared in her son’s room, The hoody, leather jacket and safe were documented and collected by Denver Crime Lab technicians, On May 12, 2016, at 5:18 p.m, your Affiant and Andrews interviewed Brian Pattison at the Las Animas County Jail at 2309 Main Street, Trinidad Colorado. Prior to the interview, your Affiant advised Pattison of his Miranda rights which he acknowledged and waived. The interview was audio recorded. It should also be noted that Pattison is in custody for the Possession of a Weapon by 2 Previous Offender charge as result of the State Patrol traffic stop and also a Parole Hold from the Colorado Department of Corrections. Pattison said that he was unaware that Shane Richardson was dead. He said that he was with Shane and Shane's roommate, a Black male with dread locks only known as “SM, during a recent weekend. He described @ilmas a drug dealer who was from either Detroit or Chicago. Pattison believed the day he was at Shane’s apartment was the Friday before he got arrested, which would have been April 29" Pattison said that he tattooed an outline on Shane’s back a few weeks earlier and on this particular weekend he came up from Colorado Springs to party with Shane and ‘GV and to finish the tattoo. Pattison initially said that after partying all night Friday night he stayed the night with “lm and Shane. In the morning, Saturday, “SQiggy gave him a ride back to Colorado Springs and that was all he knew. When he left Shane was alive and in his apartment, Pattison identified himself as the bald White male on the surveillance photos from outside of Shane’s apartment and from Cervantes Masterpiece Ballroom. Pattison initially denied taking any items from Shane's apartment, but eventually admitted taking several items including the large screen television on Saturday morning. He said that he took the items for “@HRD, but “WGIBW did not want the items so he, Pattison kept them. He also said that on Monday, May 2". ‘Ql came to Colorado Springs and sold him the pistol that he was eventually in possession of at the time of his arrest (Ruger .380 caliber). Pattison said that “@MlN’ was driving Shane’s white Subaru when he came to Colorado Springs that Monday night. Pattison also said that he was in Possession of Shane’s Subaru for a period of time. The interview was over two hours in duration, Pattison made several contradicting statements during the interview and the complete interview should be viewed for complete details. It should also be noted that Pattison mentioned Shane’s roommate several times as being in the apartment during the time that Pattison was in the apartment. Your Affiant watched the surveillance recordings from Friday, afternoon, April 29", until firefighters arrived on Monday moming at approximately 2:40 am., and at no time observed a black male with dreadlocks enter the apartment. There is only one door that leads up to the victim's apartment and the only two people in the apartment at the time the victim was believed to have been killed was Brian Pattison and Shane Richardson. The only other person who eiwered the apartment during this entire weekend until the fire was Sma ‘GEE and he left the apartment on Friday night while the victim was still alive and observed on the surveillance recordings in front of his apartment with Pattison. Based on these facts, your Affiant is respectfully requesting an ARREST WARRANT and SEALED AFFIDAVIT pursuant to Rule 41 of the Colorado Revised Statutes, to have this Affidavit sealed from public release of the information herein contained, due to the media coverage of this case to assure that this case is not compromised and that the witnesses mentioned in this warrant can be protected from any type of early reprisals; for arrest of Brian Pattison, DOB: 11/25/1985, for the offense(s) of C.R.S. 18-3-102, Murder in the First Degree, a Class One Felony, and C.R.S. 18-4-102(1), First Degree Arson, Class Three Felony so that this investigation can continue | affirm this information to be true and correct Signature of Aant ‘Subscribed under oath before me on S-AS UL SAT a.m. Date Fine Tadge or Notary Pabhic My commission expires: a
