INDEPENDENT CONTRACTOR CRITERIA CHECKLIST

Who is an Independent Contractor? If an employer has the right to control or direct only the result of the work
done by an independent contractor, and not the means and methods of accomplishing the result then that person
can be classified as an Independent Contractor. If you answer No to any of the questions below then the
employed person may not truly be an Independent Contractor and may be subject to the Workers Comp. laws.

1. Does the Independent Contractor have a business license?

2. Does the Independent Contractor have employees of their own?

3. May he/she bring a helper to the job without prior approval?

4. If the Independent Contractor does have employees or has the


ability to hire, can they show proof of Workers Comp. coverage?

5. Does the Independent Contractor have General Liability


insurance coverage?

6. May the Independent Contractor set his/her own working


schedule (time on time off)?

7. Is the Independent Contractor responsible to you beyond the


job final completion date and quality of work?

8. Is the Independent Contractor subject to a breach of contract


suit should he/she not complete the work or the job?

9. Are you subject to breach of contract suit should you terminate


the Independent Contractor prior to job or work completion?

10. Does the Independent Contractor furnish the materials or tools


for the job?
