Mark wasa student inmy Evidence and Intellectual Property courses and in my Intellectual Property Theory seminar, and he performed well in all three settings. | found Mark ta be a well-prepared, articulate, and insightfil student, In my Intellectual Property Theory seminar, we spent the majority of our time discussing the economic and philosophical foundations of intellectual property law and in listening to and critiquing students’ papers. In these discussions, Mark demonstrated an ability to quickly grasp new concepls, analyze complex problems and arguments, and point out flaws and propose innovative solutions in a constructive way. Murk’s seminar paper on tademark and trade dress protection demonstrates his ability to distinguish the differences hetween these two closely related concepts; argues for a need for a differentiation in their treatment; proposes and analyzes possible solutions to the problem he identifies, and makes an effective argument for an efficient resolution of that problem. Mark’s paper was one of the best in the class, and it demonstrated a good deal of original thought. In fact, | cited it in an article I published recently in the Marquette Intellectual Property Law Review.
