Mike As discussed before. Several times. The current Contractor was not responsible for this site
condition and is not currently responsible for this site. The
City Attorneys Office, TCEQ and the USACE have declined enforcement on this situation because it is
not Waters of the US nor Waters of the state, and the
drainage goes to adjacent property that belongs to the City. There is no violation here.
We are working diligently to develop a plan to remediate the Borrow Pit, and will let you know when we
mobilize to do that work (along with obtaining the
appropriate permits).
