COMPLAINT-AFFIDAVIT

I, LITTLE RED RIDING HOOD, Filipino, of legal age,

residing at 123 Don Manolo Blvd., Alabang Hills Village,
Muntinlupa City, do hereby charge:

WOLF, (hereinafter referred to as WOLF)

Wolf, of legal age, residing at 321Madrigal
Avenue, Ayala Alabang Village, Muntinlupa
City, where he may be served with notices,
orders, pleadings, and other processes of this
Honorable Office.

With

ATTEMPTED MURDER under Article 248 of the

Revised Penal Code

and for said purpose, after being sworn in accordance with

law, depose and say that:

1. I am known to be LITTLE RED RIDING HOOD in

our neighborhood

1.1 Attached herewith as Annex A is my NSO

birth certificate proving that
GRANDMOTHER is my grandmother.

2. On the 4th of January 2016, at around 5:30 in the

afternoon, I was walking from my residence in Muntinlupa
City, going to my grandmothers house to bring her cake
and wine in 5th St. Holy Family Compound when I
encountered the WOLF in the woods.

3. The WOLF induced me by showing me how great

the flowers in the woods were and it would be great to pick
some and bring them to my grandmother.

4. When I was picking up some fresh flowers, I

remembered that I needed bring her cake and wine for my
sick grandmother, I was surprised to find the cottage-door
already open.

5. When I went into the room, I had a strange

feeling that I said Oh dear! How uneasy I feel today and at
other times I like being with grandmother so much!

6. I called out Good Morning but no answer so I

went straight to the bed and drew back the curtains.

7. There I saw my grandmother with the cap pulled

far over her face and looking very strange.

8. I uttered 'Oh! grandmother,' she said, 'what big ears you have!'

WOLF: All the better to hear you with, my child,'

LITTLE RED RIDING HOOD: But, grandmother, what big eyes

you have!

WOLF: All the better to see you with, my dear.

LITTLE RED RIDING HOOD: But, grandmother, what large hands

you have!

WOLF: All the better to hug you with.'

LITTLE RED RIDING HOOD: Oh! but, grandmother, what a terrible

big mouth you have!'

WOLF: All the better to eat you with!

9. It is well-settled in our jurisprudence Murder

under Article 248 of the Revised Penal Code is committed
when:
 Article 248. Murder. - Any person who, not falling within the
provisions of Article 246 shall kill another, shall be guilty of
murder and shall be punished by reclusion temporal in its
maximum period to death, if committed with any of the following
attendant circumstances:

1. With treachery, taking advantage of superior strength, with the

aid of armed men, or employing means to weaken the defense or
of means or persons to insure or afford impunity.

2. In consideration of a price, reward, or promise.

3. By means of inundation, fire, poison, explosion, shipwreck,

stranding of a vessel, derailment or assault upon a street car or
locomotive, fall of an airship, by means of motor vehicles, or
with the use of any other means involving great waste and ruin.

4. On occasion of any of the calamities enumerated in the

preceding paragraph, or of an earthquake, eruption of a volcano,
destructive cyclone, epidemic or other public calamity.

5. With evident premeditation.

6. With cruelty, by deliberately and inhumanly augmenting the

suffering of the victim, or outraging or scoffing at his person or
corpse.

10. Furhtermore, under Article 6 of The Revised

Penal Code (R.A. No. 3815),

There is an attempt when the offender commences the

commission of a felony directly or over acts, and does not perform
all the acts of execution which should produce the felony by reason
of some cause or accident other than this own spontaneous
desistance.

11. WOLF on the night of the incident voluntarily

induced me by wearing my grandmothers clothes and
pretended to be my grandmother.

12. If it were not for the huntsman who passed by my

grandmothers house to check on her, the Wolf would have
successfully killed my grandmother and I.

13. I am executing this Complaint-Affidavit to attest

to the truth of the foregoing and for the purpose of
instituting a criminal action against the respondent for
violation of the provisions of the Revised Penal Code,
specifically, ATTEMPTED MURDER under Article 248.

Affiant further sayeth naught.
