The North of England P&I club has produced a set of multi-lingual questionnaires to help its
members conform to International Maritime Organization guidelines on resolving stowaway
incidents. It is part of series of initiatives by the club to combat the continued increase in potentially
difficult and costly stowaway incidents being encountered by the world's merchant shipping fleet.
According to Karen Sackfield of the club's personal injury department: 'The number of stowaway
incidents reported to the IMO in 2000 jumped to 1300 compared to just 545 in the previous year.
The increased risk of stowaways is also confirmed by the United Nations High Commission for
Refugees, which reports that the number of people giving 'cause for concern' last year has risen to
22 million.'
Under the IMO's 1997 Guidelines on the allocation of responsibilities to seek the successful
resolution of stowaway cases masters must make every effort to establish where stowaways
boarded, who they are and where they come from and to notify relevant details to the shipowner,
port of embarkation, next port of call and the flag state.
The club has initially published the one-page questionnaires in Arabic, Chinese, English, French,
Portuguese and Swahili in recognition of the fact that hotspots for illegal emigration are currently
considered by BIMCO to include Africa, Central and South America, China and the Middle East. The
forms, which were developed in conjunction with stowaway resolution specialists ARM International
in Durban, are also available to members in other languages on request.
Tony Baker of the club's loss-prevention department says that the human suffering, as well as the
delays to the ship and the time and manpower spent resolving the practical and administrative
consequences of a stowaway incident, can be out of all proportion to the initial problem. 'There are
also direct costs for not handling matters properly - for example Australia, Canada and the USA can
fine shipowners over US$5,000 for each stowaway found on board and Spain can impose a penalty
of US$160,000 if a stowaway escapes,' he says.
The club has just published detailed guidance on reducing the risk of stowaway incidents and
managing them if they occur in a special issue of its loss prevention newsletter Signals.
