OTTOVILLE — Immaculate
Conception Catholic Church
in Ottoville is preparing for
its annual Parish Festival on
Sunday.
Family-style chicken and
beef dinners will be served
in the air-conditioned Parish
Center cafeteria. A staple for
the festival, the meals include
mashed potatoes and gravy,
noodles, a vegetable, roll and
homemade dessert. Meals will
be served for dine-in, carry-out
or drive-thru from 11 a.m to 2
p.m. and 4-7 p.m. Drive-thru
customers will receive chicken/
beef combinations.
For a quick bite, the lunch
stand offers soups, sandwiches,
desserts and French fries from
11 a.m to 10 p.m.
Games and entertainment
will be offered throughout the
day and include a sanctioned
kiddie tractor pull, Fish Pond,
Pop Toss, indoor bingo, chil-
dren’s rides, Putt Putt Golf,
Sandland and dodge ball and
corn hole tournaments for all
ages.

music in the afternoon.

The test began with BP shutting off
pipes that were funneling some of the oil
to ships on the surface so the full force
of the gusher went up into the cap. Then
deep-sea robots began slowly closing,
one at a time, three openings in the cap
that let oil pass through. Ultimately, the
flow of crude will be blocked entirely.
All along, engineers will be watching
pressure readings to learn whether the
well is intact. The first two valves shut
off like a light switch, while the third
works more like a dimmer and takes
longer to close off.
On Wednesday evening, the com-
pany said it had isolated a leak on the
line attached to the dimmer switch, and
was repairing it before moving forward.

back up the claims or shed
any new light on his time in
the United States, but prom-
ised to reveal more later.
“I have some documents
proving that I’ve not been
free in the United States and
have always been under the
control of armed agents of
U.S. intelligence services,”
he told reporters.
He sought to downplay his
role in Iran’s nuclear program
— which Washington and
allies fear could be used to
create atomic weapons. Iran
says it only seeks energy-

Official’s son indicted in
Ohio corruption probe

CLEVELAND — The
son of an elected official
targeted in a two-year coun-
ty government corruption
probe pleaded not guilty
Wednesday to charges of
bribery and conspiracy in a
purported scheme to trade
TVs for consulting con-
tracts.
Tightening the prosecu-
tion ring, federal prosecu-
tors announced earlier in the
day the indictment against
31-year-old Vincent Russo,
son of Cuyahoga County
Auditor Frank Russo.
Ann Rowland, an assis-
tant U.S. attorney, wouldn’t
comment whether the charg-
es were intended to get
Russo to testify against his
father or cooperation by his
father in the wider probe.
Vincent Russo, who was
led into court in handcuffs,
was released on bond. His
attorney, William Beyer, said
outside court that Russo would
fight the charges at trial.
The defendant, who lives
in the Cleveland suburb of
Willoughby Hills, declined
to comment except to appeal
for privacy on behalf of his
pregnant wife.

Vaneisha Robinson’s find is the
real deal, ringing in at nearly
$10,000.
Twenty-year-old Robinson
says she used to wear the jersey-
shaped pendant to high school
when she didn’t know its value.
Then she had it appraised.
Gemologist Jerry Ehrenwald
says the 14-karat white gold
pendant sports more than 2 car-
ats of diamonds. The number
23 jersey reads ‘King’ on the
front and ’James’ on the back.
Robinson, who’s an amateur
boxer in James’ hometown of
Akron, Ohio, listed the jewelry
on eBay. She says the King’s
brand will never die, even after
he left the Cleveland Cavaliers
to play for the Miami Heat.

Dozens of Cleveland-area
motorists are being blocked
from getting their driver licens-
es due to unpaid traffic tickets
even though they’ve already
paid their fines.
Cleveland Clerk of Courts
spokesman Obie Shelton says
about 100 people have com-
plained in recent weeks that
the Ohio Bureau of Motor
Vehicles is refusing to renew
their licenses because the fines
are showing as unpaid.
Shelton says date-entry
errors with a new computer
system meant that the clerk’s
office didn’t update a list
shared with the state. He says
a software change has fixed the
problem, but the office doesn’t
know if others remain on the
list due to the previous errors.
Drug charge
against Ohio
activist dropped
EAST CLEVELAND (AP)
— Prosecutors have dropped a
drug charge against a Cleveland-
area community activist in what
police had said was a drug dis-
tribution ring operating from his
barbershop.
The move came Wednesday
following an order from a state
appeals court that prosecutors
must release the name of an
informant in the case against Art
McKoy.
East Cleveland police had said
McKoy was at his Superfly bar-
bershop in February 2008 when
the informant bought heroin from
someone else and that several
undercover buys were made at
the now-closed barbershop.

directed Klimkowski to “get
rid” of the TV and order the
treasurer to do the same.

Ramsey said Frank Russo
was surprised by the indict-
ment and would deal with
the matter. He declined to
further comment.

operations and tap into the
resources of the shared
services team based in
Columbus.
Eric Slough, executive
director of the Make-A-Wish
Foundation of Northwest
Ohio, welcomes the sup-

“The merger will enable
us to leverage the team’s
expertise in all areas of our
operations including pro-
gram, development, infor-
mation technology, finance
and marketing,” he said.
“I’m excited that we will
be able to focus our atten-
tion locally on raising funds,
supporting volunteers and
granting wishes to seriously-
ill children in our region,”
Slough remarked.
The Make-A-Wish
Foundation of Northwest
Ohio has granted nearly
1,200 wishes since it was
founded in 1984.
Founded in 1983, the
Make-A-Wish Foundation
of Greater Ohio, Kentucky
& Indiana chapter is the
largest of the 65 Make-
A-Wish® chapters in the
country in both territory and
wishes granted. The new
chapter will serve 116,542
square miles and celebrate
its 10,000th wish this year.
This realignment repre-
sents the fourth name change
and the second merger
for the organization; the
Foundation merged with the
Make-A-Wish Foundation®
of Indiana in 2005.
“It makes sense to con-
solidate services and stream-
line operations, especially
during these uncertain eco-
nomic times,” said Susan
McConnell, President &
CEO of the Make-A-Wish
Foundation of Greater Ohio,
Kentucky and Indiana. “The
merger will enable our staff
in northwest Ohio to carry
out our mission of grant-
ing wishes without having
to manage operational tasks

The merger is not expect-
ed to impact jobs in the
Northwest Ohio office.

perhaps, is that the north-
west Ohio office will no
longer be a separate chap-
ter with its own Governance
Board,” said McConnell. “It
will serve as one of our six
regional offices across the
three states with its own

for contracting work.

of the Senate’s leading for-
eign policy experts expressed
doubts Wednesday about
the course of the war in
Afghanistan, further compli-
cating the Obama administra-
tion’s effort to maintain sup-
port for the nearly 9-year-old
conflict.
Sen. John Kerry, D-Mass.,
chairman of the Senate Foreign
Relations Committee, said it’s
not clear that the administra-
tion has a solid strategy for
prevailing, and the panel’s
ranking Republican, Richard
Lugar of Indiana, decried “a
lack of clarity” about U.S.
war goals.
Their complaints were
aired at a hearing in which
the administration’s special
envoy for Afghanistan and
Pakistan, Richard Holbrooke,
acknowledged that the way
ahead remains in doubt.
“There are significant ele-
ments of movement forward
in many areas, but I do not
yet see a definitive turning
point in either direction,”
Holbrooke said.
On the hopeful side,
he said, the pace at which
NATO-trained Afghan police
and army troops quit or desert
has declined, yet it is too early
to know whether that trend

With risks growing, Fed
officials at their June 22-23
meeting saw the need to explore
new options for bolstering the
economy. That’s a turnaround
from earlier this year when they
were moving to wind down
crisis-era supports.
No new specific steps were
disclosed or agreed upon at
that time.
However, if the recov-
ery were to deteriorate, Fed
policymakers have options.
They could revive programs
to buy mortgage securities or
government debt. They could
lower the rates banks pay for
emergency Fed loans. The
Fed also could create a new
program to spark more lend-
ing to businesses and con-
sumers in a bid to lure them to
ratchet up spending and grow
the economy.

gressional Democrats, fearing
disaster in the fall elections,
have expressed frustration
with the Obama team and
its efforts to help Democrats.
They also were angered when
White House press secretary
Robert Gibbs said over the
weekend that enough seats
Afghanistan next week for
an international conference
at which President Hamid
Karzai is expected to make
commitments on strengthen-
ing the rule of law, combat-
ting corruption and building
an economy.
The administration has said
it will review its Afghan strat-
egy, which was announced
last winter, at the end of
this year. But slow progress
against the Taliban, plus the
disruptive effects of the firing
of the outspoken American
commander there last month,
has stirred a growing unease
among many in Congress,
including leading members of
Obama’s own party.
Sen. Carl Levin, D-Mich.,
recently said that while there
is “solid support” for the war
among Democrats, “there’s
also the beginnings of fraying
of that support.”
Anthony Cordesman, a
military analyst at the Center
for Strategic and International
Studies, said in a report
Wednesday that it’s too late
to adopt a new approach to
the Afghan war.
“It may be interesting to
propose new strategies for
the war in Afghanistan, but
it is also pointless,” he wrote.
“The change in the military
command in Afghanistan has
occurred at a time where the
campaign is already under
way, and where present strat-
egy has to work, or else the
next set of decisions will be
the tactics of how to leave.”

However, Fed officials said
the central bank “would need
to consider whether further
policy stimulus might become
appropriate if the outlook
were to worsen appreciably,”
the document stated.
Fed officials concluded
that the “economic outlook
had softened somewhat.” In
fact, one-half of Fed officials
saw “risks to growth as hav-
ing moved to the downside.”
Against this backdrop, Fed
officials offered a more down-
beat view of the economy.
They now predict the
economy will grow between
3 percent and 3.5 percent this

“Ultimately, we need a bet-
ter understanding of exactly
what the definition of success
is in Afghanistan, and what
an acceptable state looks like
there, and how achievable it
is,” he added.
Kerry said he was not ready
to give up on Afghanistan, but
the tone of his comments was
somber.
“Some suggest this is a lost
cause,” he said. “But grim as
the statistics are, heartbreak-
ing as every death is, this is
not the time to give up.”
Lugar offered an equally
bleak assessment.
“There is substantial con-
cern about our course in
Afghanistan,” he said, “in
part because of the recent dis-
ruptions in our own military
leadership,” but also because
hoped-for gains in Afghan
military training, governance
and economic development

that boost confidence.”

stocks, and a drop in wages.

Ripken Jr. is exploring the
possibility of joining the
Baltimore Orioles as a part-
time adviser, which would
ease his transition into a
permanent position after his
son graduates high school in
2012.
Ripken, who turns 50 next
month, has been meeting on
a regular basis with Orioles’
owner Peter Angelos and
president of baseball opera-
tions Andy MacPhail. The
conversations have centered
on finding the Hall-of-Fame
infielder a position in the
front office on the team he
explained in an interview with
The Associated Press. “The
cool part is, we’re thinking
about all sorts of things. Is
there an opportunity to advise
with your free time? How
would that work? And then
what would that lead into?
Where are we going with
this? We’re examining the
possibilities in a real way.
I’m satisfied with that.”
Ripken became known as
the “Iron Man” for playing
in a record 2,632 consecutive
games. He was a full-time
player in every sense of the
word before retiring in 2001
and there’s little doubt he
would bring that same kind
of dedication to the Orioles in
the front office — when the

Ripken said. “But in the big-
ger picture, sure, I’d consider
that.”
Ripken acknowledged that
it would be foolish to be
offered the job without expe-
rience, even though his father
was a longtime manager and

coach Bobby Johnson retired abruptly
as the Commodores’ head coach for
what he called personal reasons.
Vice Chancellor David Williams
announced the news in a post on the
university’s athletic website just before
a news conference. Minutes later, the
59-year-old Johnson stepped up to a
podium and announced he was retiring
from college football.
Johnson called it a very difficult
decision but one not prompted by
health concerns for either himself or
his wife.

Former Philadelphia 76ers’ GM/presi-
dent Billy King was hired to replace Rod
Thorn as the New Jersey Nets’ GM,
owner Mikhail Prokhorov announced
in a release. Contract terms were not
immediately available.
Prokhorov personally interviewed
more than five people for the GM’s job
and met with King again on Tuesday.
Thorn is stepping aside as presi-
dent/GM on Friday, saying he simply
wants a change of scenery after a
decade of running the team, including
a final year that featured a franchise
worst 12-70 record.
NEW YORK — When searching
for this year’s Inspiration Award recipi-
ent, WNBA president Donna Orender
hoped to find a world leader.
She got one. The WNBA honored

ANAHEIM, Calif. — The family of
the late John Wooden has agreed to
continue the college basketball double-
header named for him and played in
Anaheim, Calif., for the last 16 years.
The event will be Dec. 18 at Honda
Center and feature UCLA against BYU
and St. Mary’s against Long Beach
State.
Jim Wooden and Nancy
Muehlhausen, the coach’s son and
daughter, revealed in a statement that
they’re proud the event will continue to
celebrate their father’s life and legacy.
Wooden, who coached UCLA to a
record 10 national championships, died
last month at 99. He regularly attended
the doubleheader in Anaheim and pre-
sented trophies to the winning teams.

PARIS — Nicolas Anelka claimed
today all his teammates decided to go
on strike at the World Cup after he was
sent home from South Africa for ver-
bally abusing France coach Raymond
Domenech and refusing to apologize.
The Chelsea striker told France
Soir that “everybody stuck together”
when the players decided to boycott
a training session shortly before their
World Cup ended in the group stage.
Anelka, who recently signed a
1-year contract extension with Chelsea
that will keep him with the English
club until 2012, added that a clash
would have happened even if he hadn’t
insulted Domenech.
Anelka was sent home after aiming
Thuram has called for some players,
such as former captain Patrice Evra,
never to play for the national team again
because of their decision to strike.
France midfielder Jeremy Toulalan
said last week, however, that all the
players decided to strike and that
any punishment should be collective,
prompting Anelka to praise the Lyon
player’s courage.
BASEBALL
FORT WORTH, Texas — A fed-
eral bankruptcy judge decided that the
Texas Rangers will be auctioned off
after all, despite angry creditors’ claims
that the bidding process is unfair and
still favors Major League Baseball’s
preferred buyer.
U.S. Bankruptcy Judge D. Michael
Lynn set the auction for Aug. 4 after
changing some of the team’s proposed
bidding procedures, citing a “need to
bring order from chaos.” The final hear-
ing on whether to approve the Rangers’
bankruptcy plan was set for later that
day.
After the auction, Major League
Baseball will still be able to reject
the highest bidder and approve the
next highest bid — something lenders
opposed. But if that happens, the judge
can determine if the league acted in
good faith, according to the revised
procedures.
Months ago, the league gave its
blessing to a group led by team presi-
dent and Hall-of-Fame pitcher Nolan
Ryan and Pittsburgh sports attorney
Chuck Greenberg, selected as the buy-
ers after a bidding process last year.
But because angry creditors stalled
the sale over financial concerns, the
team filed for Chapter 11 protection in
May with a plan to repay lenders $75
million and sell the club to Greenberg
and Ryan’s group.
Although lenders said that bid was
not the highest and the court-appointed
chief restructuring officer recommend-
ed a new round of bidding, only the
team and the Greenberg-Ryan group
pushed for the auction Tuesday.
Attorneys for the creditors and
restructuring officer claimed they no
longer supported an auction because
the bidding procedures and timetable
would limit a potential buyer’s abil-

part of failed bid attempts last year. The
league also will “jump through hoops”
to get any other potential bidders quali-
fied based on financing.
He added that commissioner
Bud Selig’s previous comments
about ensuring the team’s sale to the
Greenberg-Ryan group were made
before the league fully understood its
role in a bankruptcy case.
The judge did allow more time for
bidders by setting the auction for Aug.
4, two weeks after the team’s proposed
date. But Lynn said he wanted it held
before Aug. 12, when the Greenberg-
Ryan group loses its financing guar-
antee.
Andrew LeBlanc, an attorney
for the top lenders, questioned the
urgency of the team’s sale. He added
the Rangers initially wanted the team
sold and bankruptcy case wrapped up
before July 31, the nonwaiver trading
deadline.
On Friday, the American League
West-leading Rangers acquired ace
left-hander Cliff Lee from the struggling
Seattle Mariners in a trade deal.
Tuesday’s hearing came a day
after the Greenberg-Ryan group,
Rangers Baseball Express, filed a law-
suit seeking to force the long-delayed
sale and stop negotiations with other
interested parties.
But Thomas Lauria, the group’s
attorney, told the judge Tuesday he
would not argue for that suit if some
bidding procedures and other issues
could be resolved, noting his clients’
only goal was to buy the team.
Lauria added the cash portion of
his clients’ bid was now $306.7 million,
a $2.7-million increase, after it decided
not to renew the team’s aircraft lease.
In the revised procedures, starting
bids must be at least $15 million higher
than the cash portion of the Greenberg-
Ryan bid, which totals about $575 mil-
lion and includes paying the full $204
million owed to unsecured creditors.
Topping the list of unsecured credi-
tors is New York Yankees star Alex
Rodriguez, who is owed $24.9 million
in deferred compensation six years
after he was traded.

we expect to see adult Japanese
beetles start emerging in yards,
gardens pastures and farm
fields. Japanese beetles are a
brilliant, metallic green color,
generally oval in outline, 3/8
inch (10 mm) long and 1/4 inch
(7 mm) wide. The Japanese
beetle came to the United States
from Japan and was first found
in New Jersey in 1916.
Very few landscape plants
are immune to Japanese beetle
attack. The adults are skeleton-
izers, that is, they eat the leaf
tissue between the leaf veins but
leave the veins behind. Attacked
leaves look like lace that soon
withers and dies. The adults will
often attack flower buds and
fruit. The grubs can kill small
seedling plants but most com-
monly damage turf. They seem
to especially relish Kentucky
bluegrass, perennial ryegrass,
tall fescues and bentgrass.

beetles have really been a nui-
sance to homeowners across
Putnam County.
Japanese beetle larvae have
spent the winter living approxi-
mately eight inches deep in the
soil as grubs. In late April they
move upward in the soil and
feed on the roots of grass. With
the warmer weather, they mature
and the adult beetles emerge
from the soil in month of July.
On warm sunny days the new
beetles crawl onto low growing
plants and warm for a while
before taking flight. The first
beetles out of the ground seek out
suitable food plants and begin to
feed as soon as possible.
After feeding for a day or
two, the females leave feeding
sites in the afternoon and bur-
row into the soil to lay eggs at a
depth of 2 to 4 inches. Females
may lay 1 to 5 eggs scattered
in an area before leaving the

NEW YORK — The own-
ers’ box behind home plate
will be empty most nights.
Then again, it has been vacant
most games for several years.
Little figures to change in
the operation of the New York
Yankees following George
Steinbrenner’s death Tuesday
at age 80. His role for sev-
eral years had been to give
approval to decisions already
made by the pinstriped man-
agement team he put in place.
In the second season of
their $1.5 billion new Yankee
Stadium, the team has unri-
valed resources other fran-
chises can’t even dream of.
New York won its sev-
enth World Series title under
Steinbrenner’s ownership last
season, its first since 2000.
Its $206 million opening-day
payroll was $43 million high-
er than that of any other team
and the fruits of that spending
shows. The Yankees’ 56-32
record at the All-Star break
is baseball’s best and eight of
their stars were All-Stars, the
most from any team.
Steinbrenner formally
turned control of baseball’s
most famous franchise over
to son Hal in November 2008.
As managing general partner,
Hal runs the business for him-
self, older brother Hank and
sisters Jessica and Jennifer.
“He’s been slowing down
the last couple years,” Hal
Steinbrenner explained on the

Davies was involved in a car
accident in Virginia that killed
another passenger. Davies had a
broken and dislocated left elbow,
a broken right femur, tibia and
fibula and a broken nose, fore-
head and eye socket. He also
was left with a ruptured bladder
and bleeding on the brain.

Japanese beetles are easily
controlled by most of the com-
monly available garden pesti-
cides. The key is to treat at the
first signs of beetle feeding and
be prepared to treat again in a
week or so, if necessary, until
the beetle populations decline.

Transition began after
December 2003, when
Steinbrenner fainted at a
memorial service for NFL

groundbreaking of new
Yankee Stadium in August
2006, a deal spearheaded by
Levine, Steinbrenner’s public
speech had become short and
clipped. He became ill while
watching his granddaughter
in a college play in North
Carolina that October, his
walking became unsteady and
he further receded into the
eighth minute.

Elmander scored in the 50th
minute, while Jussi Jaaskelainen
and Adam Bogdan combined on
the shutout. World Cup players
Stuart Holden, Danny Shittu and
Chung-Yong Lee didn’t make the
trip.
Argentina to offer Maradona
new 4-year deal: The Argentine
Football Association announced
it will offer Diego Maradona a
new 4-year contract that would
keep him in charge of the nation-
al team through the 2014 World
Cup in Brazil.
Ernesto Cherquis Bialo, a
spokesman for the association,
told reporters Wednesday that
AFA President Julio Grondona
would meet next week with
Maradona to discuss the offer.
This is the strongest indica-
tion that Maradona is likely to
continue as the coach. It comes
two weeks after Argentina was
knocked out of the World Cup
in a humiliating 4-0 quarterfinals
loss to Germany. Maradona has
said little since then, keeping to
himself in his home in suburban
Buenos Aires.
Cherquis Bialo said the asso-
ciation did not have another
coach in mind should Maradona
turn down the deal. He also sug-
gested Argentina’s performance
in the World Cup had been
respectable, despite anything
less than a third title being seen
as a failure by many Argentines.
Argentina won the World Cup
in 1978 and 1986 but has not
won a major title since claiming
the Copa America in 1993.
Public opinion is divided
about the 49-year-old coach,
who is a national icon as a player
who led the country to the 1986
title. But he is seen by many
as a poor tactician, an unquali-
fied coach whose main asset is

Steinbrenner’s maniacal
attention was evident. Trash
was allowed to overflow a
garbage can at Legends Field.
Baseballs were scattered ran-
domly across the floor of the
indoor batting cage on after-
noons where Steinbrenner
once scolded players for leav-
ing bubble gum wrappers on
the ground. The morning after
Daylight Savings Time began,
the scoreboard clock remained
on Standard Time almost until
the gates opened. Advertising
boards outside the ballpark
twice had typos in their mes-
sages.
As Steinbrenner faded, the
Yankees became more corpo-
rate. Decisions no longer were
based on whim and emotion.
“He was a warrior,” former
commissioner Fay Vincent
said Tuesday. “I think that he
grew to be more balanced and
wise, like most of us after he
got older. I think the earlier
misjudgments and mistakes
he made disappeared as he
got older.”
A climate of fear perme-
ated the corridors of Yankee
Stadium and the team’s spring
training complexes for most
of Steinbrenner’s first three
decades. He demeaned under-
lings with profane rants, tried
to motivate players and man-
agers with anonymous quotes
in the newspapers, then made
up for unsympathetic behavior
with uncommon generosity to

to make his Red Bulls’ debut
on July 22 in an exhibition

With France, Henry won the
World Cup in 1998 and the 2000
European Championship but

The Red Bulls, previously
known as MetroStars, have a
history of signing star players in
the twilight of their careers. Italian
Roberto Donadoni played for
them in 1996 and ’97, Brazilian
great Branco was with them in
1997, German Lothar Matthaus
in 2000 and Frenchman Youri
Djorkaeff in 2005 and ’06.
None of them led the team
to a title.

FDA: Diabetes drug will stay on market

WASHINGTON — GlaxoSmithKline’s drug
Avandia should stay on the market, federal health
experts voted Wednesday, but the controversial
diabetes pill should be subject to new restrictions
due to risky heart side effects.
A panel of Food and Drug Administration
advisers voted 20-12 to keep the once blockbuster
pill available for diabetics. But 10 panelists also
called for limiting who can receive and prescribe
the much-debated medication.
The vote marks a tough win for British drug-
maker Glaxo, which is facing thousands of law-
suits from patients who say Avandia caused their
heart attacks or strokes. While the company may
fare better in court due to the panel ruling, sales of
Avandia are likely to shrink to minuscule levels.
The FDA is not required to follow the advice of
its panelists, though it usually does. FDA officials
said they would review the recommendations and
make a decision on Avandia as soon as possible.
The vote came despite an earlier ruling by the
panel that Avandia appears to increase heart attack
risk, underscoring the often contradictory evidence
for and against the drug.
Panelists voted 21-4 that Avandia is more like-
ly to cause heart attack than its closest competitor
Actos. Eight panelists said there was not enough
information to make a decision.
Ultimately though, panelists said the risks were
not severe enough to justify removing a drug used
by hundreds of thousands of patients.
“I didn’t want to take away a drug without
definitive evidence that it was bad for those few
patients who need it,” said University of Missouri
Lamont Weide, who voted to leave the drug on the
market with new restrictions.
The agency convened the two-day panel meet-
ing to help untangle over 1,000 pages of conflict-
ing evidence about Avandia’s risks.
The drug has a long, knotty history at the
FDA.
Since diabetics are already predisposed to heart
risks it is extremely difficult to tell which heart
attacks are drug-related and which are simply
caused by the disease.
The task of evaluating Avandia’s possible side
effects across dozens of studies has dragged on for
years without definitive answers.
Three years ago a similar FDA panel voted to
keep Avandia on the market and the FDA respond-
ed by adding bolder warning labels for the drug.
“In terms of what has changed since 2007, I
think the totality of evidence is much stronger,”
said panelist Clifford Rosen of the Maine Medical
Research Institute. “It’s still not absolute but it’s
stronger.”
Despite the vote on Avandia’s heart risks, pan-
elists didn’t reach a firm conclusion on whether it
is more likely to cause death than other drugs.
The panel vote to keep Avandia on the mar-
ket would appear to support FDA leadership,
who have been criticized by some members of
Congress for not pulling the drug.
But late Wednesday those critics were already
questioning the legitimacy of the meeting.
“The result of the advisory committee vote
is gravely disappointing and raises serious ques-
tions as to whether the science was presented in
an unbiased manner,” said Congresswoman Rosa
DeLauro, D-Conn., who has called for Avandia’s
withdrawal.
Panelists sat through nearly 20 presentations on
Avandia that often drew opposite conclusions.
FDA reviewer David Graham told the panel
Avandia’s risks were real enough “to put you in a
hospital or a cemetery.”
Graham, who wants the pill banned, recently
published an analysis estimating that as many as
100,000 heart-related problems may have been
caused by Avandia among seniors on Medicare.
But higher ranking FDA officials played down
the drug’s risks, pointing out that clinical trials
have not shown increased risk of heart attack or
death with Avandia. Considered the gold standard
of medical research, clinical trials randomly assign
patients to receive one of two drugs and follow
them to see how they fare.
Minutes before the final vote on Avandia,
John Jenkins, the FDA’s director for new drugs,
emphasized the high bar needed to pull a previ-
ously approved drug from the market.
“The two that have been withdrawn for car-
diovascular concerns — Vioxx and Zelnorm —
showed three, four or five fold-increase in risk,”
Jenkins said.
Panelists appeared to heed the cautionary tone.
“I would be concerned about the precedent
that would be set to have this quality of data suf-
ficient to remove a drug,” said John Teerlink of the
University of San Francisco.
The FDA first approved Avandia in 1999 and
it quickly became the top-selling diabetes pill in
the world. U.S. sales have plummeted from $2.2
billion in 2006 to $520 million last year as safety
concerns swirled around the drug.
The drug works by increasing the body’s sensi-
tivity to insulin, a key protein needed for digestion
that diabetics don’t adequately produce.
While there are more than a dozen diabetes
drugs on the market, only Actos from Japan-based
Takeda Pharmaceuticals works the same way as
Avandia. U.S sales of Actos have risen steadily
— hitting $3.4 billion last year — as Avandia’s
reputation has soured.
Critics of Avandia say there is no reason to
leave the drug on the market when Actos provides
the same benefits without the potential heart risks.
FDA is requiring GlaxoSmithKline to conduct
a definitive study comparing the safety of the two

Officers plead not guilty
in Katrina shootings

NEW ORLEANS — Three police officers charged in the
killing of two unarmed residents on a New Orleans bridge after
Hurricane Katrina and a cover-up that followed pleaded not
guilty on Wednesday.
Sgts. Robert Gisevius and Kenneth Bowen and Officer
Anthony Villavaso stood before a federal magistrate in green
prison garb, shackled at the waist and ankles. They will remain
jailed at least until a hearing Friday. A tentative trial date is set
for Sept. 13.
Magistrate Louis Moore Jr. read the counts — 13 against
Bowen, 11 against Gisevius and 10 against Villavaso. Former
officer Robert Faulcon made his initial court appearance
Tuesday in Texas, where he was arrested, but has not entered
a plea.
The charges against the four carry a maximum sentence of
life in prison or the death penalty, although U.S. Attorney Jim
Letten said the Justice Department hasn’t decided whether to
seek the latter punishment.
The family of two victims — Ronald Madison, who was
killed, and his brother, Lance, who survived — sat in the front
row of the packed courtroom. Gisevius cried quietly as he stood
with his lawyer.
“We’ll be able to pick this indictment apart,” said Frank
DeSalvo, Bowen’s lawyer. “There is a lot of fantasy there.”
Bowen, Gisevius and Villavaso were suspended without pay
after the indictments were released Tuesday, NOPD spokesman
Bob Young said on Wednesday.
Five former officers already have pleaded guilty to charges
they helped cover up the shootings. Prosecutors have said police
fabricated witnesses, falsified reports and plotted to plant a gun
to make it appear that the shootings were justified.
The shootings at the Danziger Bridge happened Sept. 4,
2005, six days after Hurricane Katrina smashed levees and left
the city flooded and in chaos. Bodies floated in filthy flood
waters. There were reports of looting and gunshots rang out
throughout the blacked-out city.
It was in this backdrop that police, desperate to regain
control, were called about 9 a.m. that morning after reports of
gunfire at the bridge.
Seven heavily armed New Orleans police officers stormed
the bridge. Prosecutors said they shot at the first people they
saw, people they say were crossing the bridge to find food.
When it was over, two men were dead and four others lay
wounded on the hot concrete.
The indictment claims Faulcon shot mentally disabled Ronald
Madison, 40, in the back as he ran away on the west side of the
bridge. Bowen is charged with stomping and kicking Madison
while he was lying on the ground, wounded but still alive.
Madison’s brother, Lance, was arrested and charged with try-
ing to kill police officers. He was jailed for three weeks before
being released without indictment.
Accused ‘Barefoot Bandit’
has US court appearance

MIAMI — The teenager dubbed the “Barefoot Bandit” by
authorities will cool his heels in a Miami jail at least two more
days while he sorts out which attorney will represent him.
At his first U.S. court appearance Wednesday since his arrest
in the Bahamas, Colton Harris-Moore, 19, told U.S. Magistrate
Judge Robert Dube he thought his mother had hired a lawyer but
he didn’t know the attorney’s name.
“I’d like to speak with my mom first,” said Harris-Moore,
dressed in a standard tan prison jumpsuit, sandals and white socks.
He added that he last spoke to his mother, Pam Kohler, “about a
week ago.”
“She said that she hired one,” he said. “I have not met with
him yet.”
Dube set another hearing for Friday morning to determine
Harris-Moore’s legal representation, whether he should be
released on bail and when he should return to Seattle to face an
alleged two-year string of crimes. Harris-Moore is suspected in
about 70 burglaries, thefts and other property crimes in eight states
and British Columbia, including thefts of aircraft — one of which
he allegedly flew from Indiana to the Bahamas.
Kohler has asked Seattle defense attorney John Henry Browne
to represent her son in the criminal case, which currently
involves the alleged theft of a plane in Idaho that was crashed
in Washington state. Browne has said he will handle it if Harris-
Moore agrees. Another attorney, O. Yale Lewis, is helping Kohler
with media and entertainment requests.
Harris-Moore was deported by the Bahamas to the U.S. on
Tuesday, shortly after pleading guilty to illegally entering the
island nation east of Miami. Harris-Moore’s long odyssey on the
lam ended Sunday after police ended a high-speed boat chase by
shooting out the vessel’s engine.
Harris-Moore’s attorney in the Bahamas, Monique Gomez,
said the U.S. Embassy there would pay the teenager’s $300 fine.
Authorities say he earned the “Barefoot Bandit” nickname by
committing some crimes while shoeless, and in February he alleg-
edly drew chalk-outline feet all over the floor of a grocery store
during a burglary in Washington’s San Juan Islands.
Harris-Moore told police in the Bahamas that he came there
because it has numerous islands, airports and docks. The teenager
claimed that he told islanders he was trying to get to Cuba so he could
throw police off his trail, but he intended to make his way to the Turks
and Caicos Islands southeast of the Bahamas, police said.
Utah agencies investigate alleged illegal immigrant list

SALT LAKE CITY — Investigators examined records at sev-
eral state agencies Wednesday to find the origins of a list being
circulated around Utah that contains the names and personal
information of 1,300 purported illegal immigrants and demands
that they be deported immediately.
Utah is looking into whether a state worker may have illegally
accessed a database containing the sensitive information to help
compile a list that has sent chills through the Hispanic commu-
nity.
The dossier — sent from an anonymous group to reporters,
state officials and politicians — marks the latest example of hys-
teria that has spread since Arizona passed its harsh immigration
crackdown this year. Immigrants liken the list to a modern-day
witch hunt.
The list contains Social Security numbers, birth dates, work-
places, addresses and phone numbers. Names of children are
included, along with due dates of pregnant women on the list.
Gov. Gary Herbert’s spokeswoman said Wednesday it will
likely be several days before it’s known whether state workers
leaked the personal information.
Arizona’s law, which takes effect July 29, directs police
enforcing other laws to ask about a suspect’s immigration status
if there is reason to believe the person is in the U.S. illegally. The
Obama administration has sued Arizona to throw out the law and
keep other states from copying it.
Conservative Utah lawmakers are considering adopting a
measure similar to that in neighboring Arizona when they meet
in January.

AUSTIN, Texas — The president of the University of Texas
will ask the school’s regents to remove the name of a former pro-
fessor and Ku Klux Klan member from a campus dormitory.
Simkins Hall, a two-story brick dorm built in the 1950s, is
named after William Simkins, who was a popular law school
professor in the early part of the 20th century but one with a dubi-
ous past. He served as a Confederate fighter and early organizer
of the Ku Klux Klan in Florida, promoting the Klan and bragging
about efforts to terrorize and harass “darkey” in campus speeches
and publications.
Simkins was a Confederate colonel in the Civil War and orga-
nized the Klan in Florida soon after the war ended. After moving
to Texas, he began teaching law at the university in 1899 and
stayed there until his death in 1929. With wavy white locks and a
fondness for chewing tobacco, he was a popular figure on campus
and his portrait still hangs in the law school.
In a campus speech in 1914 and an article two years later in
the alumni magazine, Simkins said he never drew blood as a
Klansman. He did, however, admit to assaulting a black man,
participating in a train robbery and sowing fear in Florida’s “black
belt” as a masked night rider.
When a white woman in Florida complained of being insulted
by a black man, Simkins wrote, “I seized a barrel stave lying near
the hotel door and whipped that darkey down the street.”
Russell said he took his concern to Texas officials when he
was still teaching in Austin in the 1990s but was told not to worry
about it because the dorm, now considered one of the less-desir-
able residences on campus, would soon be torn down.

regents to take his name off the dorm — a move that comes after

SAN FRANCISCO — Companies finally appear to be mus-
cling up their spending on the most expensive kinds of comput-
ers after slashing budgets during the recession, but fears of more
economic uncertainty are proving tough for the technology
industry to shake.
Intel Corp., which makes the brains for 80 percent of the
world’s personal computers, turned in blowout quarterly finan-
cial numbers on Tuesday, a sign to the rest of the industry that
better times are on the way.
But analysts caution that Americans are still expected to be
cautious with their spending for the rest of the year. So compa-
nies may just be upgrading their technology to boost productivi-
ty, not necessarily expecting a sudden, huge increase in demand.
Economic shakiness in Europe could hurt demand, too.
Intel’s results were the best in its 42-year history, including
its highest revenue and profit margins ever, at a time that is
historically the low point of the year for technology spending,
coming ahead of the back-to-school and holiday shopping.
“I think people are going to be surprised that the technology
spending budgets are robust and stable and growing,” said Doug
Freedman, an analyst for Gleacher & Co.

the most in this whole debate is just the cowardness, the intoler-
ance.”
Herbert spokeswoman Angie Welling said the governor did
not set a timeframe for the investigation, but that it is a priority.
The state’s technology department is assisting to see which state
agencies have records that match those on the list.
“Obviously they’re working on it now and we’re interested in
hearing the results,” Welling said. “It’ll take several days. This is
a lot of information and it will take some work to really get down
to it because, obviously, those data are accessed for legitimate
purposes on a daily basis.”
While each state agency is being reviewed, Welling said most
of the focus is on the Department of Workforce Services, the
Department of Health and the Department of Human Services.
If there’s an indication that a law might have broken, the Utah
Attorney General’s Office will investigate, Welling said.

ishable by up to six months in jail and a $1,000 fine. If someone
stole a protected record, it could be prosecuted as a felony with
a penalty punishable by up to five years in prison and a $5,000
fine.

They tell the magazine they reconnected while working
out a custody plan and got engaged two weeks ago. Bristol
Palin said she found the idea of telling her mother about the
engagement “intimidating and scary” but hoped she’d “jump
on board.”
Johnston, who answered the door at Bristol Palin’s condo
in Anchorage on Wednesday afternoon, confirmed the engage-
ment to The Associated Press but declined to provide further
comment on it. He said he wasn’t living at the condo.

Police and FBI investigators say no one has been arrested
for Monday’s heist at a Comerica Bank. The thief’s face was
covered by a green paisley bandanna and his beanie, sweat
shirt, gloves and pants were black.
Not surprisingly, he’s been dubbed the skateboard bandit.
The FBI released a photograph showing the thief holding
his skateboard.
