Faruqi deals with the issues of whether the death penalty should be
imposed. He argues that the death sentences should not be imposed on
pregnant women and those below 18. Words such as abolition,
reprehensible, extenuating circumstances, primordial instincts and phrase
God gives life, only He should take it away. Its reflect bias language
through which his tone of fair and objective is conveyed as he attempt to
society, criminals and also those involved in judging the criminal case.
He begins his case by stating that the trend throughout the world is to
move away from the death penalty. The Second Optional Protocol to the
International Covenant on Civil and Political Right, which has been ratified
by 57 states, commits itself to total abolition. European and American
Conventions have also moved in that direction. He make reference from
Amnesty International, 87 countries and territories have abolished the
death penalty for all crimes. It is notable that even for war crime, crime
against humanity or genocide triable by the International Criminal
Tribunals created by The United Nation Security Council for former
Yugoslavian and Rwanda, the maximum penalty is life imprisonment.
There is overwhelming evidence that as long as the death penalty is
maintained, the risk of executing the innocent can never be eliminated.
Further, UN studies indicates that the abolitionist country do not show any
upsurge in crime.
The author then present three claims to support his own point of view on
the issue. His first claim is that although there are a lot of evidence, as
long as the death penalty is maintained, the risk of executing the innocent
can never be eliminated. Plus, he mentioned about the related case. The
second claim is that he stated that abolitionist countries do not show any
upsurge in crime according to UN studies. However, there is no evidence
to support this claim.
To sum it all up, the authors first and second arguments seems to oppose
each other, thus weakening his belief that death penalty should be
abolish. However, he managed to show some validity and credibility in
some of his earlier claims. His overall arguments against death penalty is
strong and sound due to large amount of evidence to support his belief.
