In the article, Death Penalty Losing Appeal , the author, Shad Saleem

Faruqi deals with the issues of whether the death penalty should be
imposed. He argues that the death sentences should not be imposed on
pregnant women and those below 18. Words such as abolition,
reprehensible, extenuating circumstances, primordial instincts and phrase
God gives life, only He should take it away. Its reflect bias language
through which his tone of fair and objective is conveyed as he attempt to
society, criminals and also those involved in judging the criminal case.

He begins his case by stating that the trend throughout the world is to
move away from the death penalty. The Second Optional Protocol to the
International Covenant on Civil and Political Right, which has been ratified
by 57 states, commits itself to total abolition. European and American
Conventions have also moved in that direction. He make reference from
Amnesty International, 87 countries and territories have abolished the
death penalty for all crimes. It is notable that even for war crime, crime
against humanity or genocide triable by the International Criminal
Tribunals created by The United Nation Security Council for former
Yugoslavian and Rwanda, the maximum penalty is life imprisonment.
There is overwhelming evidence that as long as the death penalty is
maintained, the risk of executing the innocent can never be eliminated.
Further, UN studies indicates that the abolitionist country do not show any
upsurge in crime.

The world is now developing to eliminate the death sentences as they


state that there must be a right appeal to the higher courts and the right
to apply for pardon. He also voice that the quality of our civilisation is
judge as much by how we honour our heroes as by how we treat the worst
in our midst. In addition, he present more claims that emphasize the
objectionable feature of death penalty, such as

Drug offenses are not regarded as sufficiently serious to warrant a


death penalty in most country of the world, .
In drug trafficking case, people who get caught are often not
involved in high ranks of the supply chain. The main players are
neither apprehended nor deterred.
Capital punishment is mandatory and the court has no choice but to
impose the penalty of death for crimes such as murder and drug
trafficking.
Many judges in their private moments have spoken with remorse of
death sentences they had to impose even though there were
extenuating circumstances.
Abolitionist countries do not show any upsurge in crime.
Having stated all the objection towards death penalty, the author
immediately state a counter-current argument that death penalty may be
imposed in certain situations such as,

The death sentence may be imposed only for serious crimes.


The death sentence should not be imposed on pregnant women and
those below 18.
Eleven countries have abolished it for all but exceptional crimes
such as war-time betrayals.

The author then present three claims to support his own point of view on
the issue. His first claim is that although there are a lot of evidence, as
long as the death penalty is maintained, the risk of executing the innocent
can never be eliminated. Plus, he mentioned about the related case. The
second claim is that he stated that abolitionist countries do not show any
upsurge in crime according to UN studies. However, there is no evidence
to support this claim.

The author generally appears to be inductive in his reasoning, as he


provides proves all the specific support as to why death penalty should be
abolished. For instance, he claims that at the moment in Malaysia, the
death penalty can be imposed for a large number of offences such as
waging war against Yang di-Pertuan Agong, offences against a Ruler or
Govenor and etc. Paragraph XI state all the example of inductive
reasoning.

To sum it all up, the authors first and second arguments seems to oppose
each other, thus weakening his belief that death penalty should be
abolish. However, he managed to show some validity and credibility in
some of his earlier claims. His overall arguments against death penalty is
strong and sound due to large amount of evidence to support his belief.
