LaMor Captain / Designee Date (Case Number EHPT16-30-007 Page Number 3 sv 62701 (Re 0008) ASSIGNMENT On Sunday May 8, 2016, at 4:59 P.M., I was notified by the Florida Highway Patrol Jacksonville Regional Communications Center of a fatal traffic crash. 1 arrived on the scene at 5:41 P.M. to conduct a traffic homicide investigation. The crash was located on US Highway 27 (US 27) at the intersection of NE 140" Court, 1 mile west of Williston within Levy County, Florida. This angular type collision involved two vehicles resulting in one fatality. ROADWAY In the area of the crash, US 27 is a four lane roadway that traverses east and west divided by a gas median. There are two lanes traveling eastbound divided by a white dashed line, and a left turn lane. The inside edge line is a solid yellow painted line, The outside edge line is a solid painted white line. The left travel lane measures 11 feet, 6 inches in width. The right travel lane measures 11 feet, 11 inches in width. The left turn lane measures 12 feet, 1 inch in width. There are two westbound lanes divided by an intermittent white line and a left tum lane. The right travel lane measures 11 feet, 7 inches in width, and the left travel lanes measures 11 feet, 11 inches in width. The left tum lane measures 11 feet, 9 inches in width. The grade is -2 % to the east and the superelevation of the roadway is level. The coefficient of friction for the roadway is .83. The speed limit is 65 miles per hour and is so posted 3.2 miles west of the area of collision for eastbound traffic, and .5 miles east of the area of collision for westbound traffic. ‘The weather was clear and the roadway was dry. The traffic crash occurred during daylight hours. The roadway and traffic conditions did not contribute to the crash. VEHICLE: V-1 V-1 was a red 2014 Freightliner Cascadia tractor. The vehicle identification number was 3AKIGHDV4ESFN1249 and displayed Florida tag number F5619T. V-1 was equipped with a (Case Number FHP716:39-007_ Page Number 4 My 62703 (Rev 00108) manual transmission, power assisted disc brakes, and power assisted steering. V-1 was equipped with standard occupant restraints, which consisted of lap belts and shoulder hamesses for the ‘occupants. The driver side airbag did not deployed during the traffic crash. Okemah Express LC, ES EES 2s the registered owner of V-1. Attached to V-1 was a 53 foot refrigerated trailer registered to Okemah Express LLC. The vehicle identification number was 1UYVS25303U087802 and displayed Florida tag number 3535CP. The trailer is equipped with air brakes. Qceupant V-1: Driver (D-1): Frank A. Baressi is a 62 year old male who resides at J MRS > 2 2s Pda ras “A” Commercial Driver license, with his medical certification valid until September 28%, 2017. D-1 was wearing his seatbelt/shoulder harness at the time of the traffic crash. D-1 was familiar with V-1, the roadway and the route he had taken. D-1 was traveling west on US 27 en route to deliver a load of blueberries to Red White and Blues farm located at 3250 NE 140 Avenue., Williston, FL. D- 1 was not injured in the traffic crash. MI 2 \V-2 was a black 2015 Tesla Model $700 4 door passenger vehicle. The vehicle identification number was and displayed Ohio tag number GPN3834. V-2 was equipped with an electric transmission, power assisted disc braking in the front and rear, and power assisted steering. V-2 was equipped with standard occupant restraints, which consisted of lap belts and shoulder hhamesses for the front and rear seat occupants with front and side airbags. All airbags deployed in the traffic crash. V-2 is also equipped with Autopilot (Driver Assistance) capabilities. According the Tesla Model $ owner’s manual; Page 68, the forward looking camera and the radar sensor are designed to determine when there is a vehicle in front of you in the same lane. (Case Number FHP716-39-007_ Page Number 5 HSMV 62703 (Rev 08/08) If the area in front of Model $ (V-1) is clear, the Traffic-Aware Cruise Control maintains a set driving speed. When a vehicle is detected, Traffic-Aware Cruise Control is designed to slow down Model $ as needed to maintain a selected time-based distance from the vehicle in front, up to the set speed. Traffic-Aware Cruise Control does not eliminate the need to watch the road in front of you and to apply brakes when needed. Joshua D, Brown im! (ERR 2s the registered owner of V-2. Occupant V.2: Driver (D-2): Joshua D. Brown was a 40 year old male who resided at RS. -2 bed a valid Ohio Class D license with no restrictions and has a motorcycle endorsement. D-2 was using the occupant restraint device at the time of the crash. D-2 was familiar with V-2, but unknown if D-2 was familiar with the roadway and the route he had taken. D-2 was traveling east on US 27 from Cedar Key, FL and was en route to Daytona Beach or St. Augustine, FL. D-2 sustained fatal injuries from this crash ‘and was pronounced deceased on the scene at 4:51 P-M., by Levy County Fire Rescue Paramedic Gonzalez. INVESTIGATION ‘Trooper Darin M. Fulton arrived on scene at 5:10 P.M. and was the traffic crash investigator. 1 arrived on the scene at 5:41 P.M. and began to investigate and document the scene. Corporal Shaun Lattinville arrived on the scene at 6:02 P.M. to assist with the documentation of the scene. 1 met with Trooper Fulton who advised that the crash involved two vehicles and 2 occupants resulting in one fatality. While surveying the scene, I observed debris within the intersection which extended east along the south shoulder of US 27. I observed a tire mark within the right travel lane of eastbound US 27 that lead southeast toward the south grass shoulder. V-1 was ‘Case Number FHP716-39-007_ Page Number 6 SMV 62703 (Rev.08/08) located on NE 140" Court. V-2 was located 898 feet 6 inches east of the area of impact on the south shoulder facing north. Corporal Lattinville documented the scene utilizing Photogrammetry. Trooper Jeremy Faul responded to the scene due to a Commercial Vehicle being involved in the crash, Trooper Faul arrived at 6:30 P.M. Trooper Faul made contact with D-1 to obtain his commercial motor vehicle driver logs and proper documentation of travel. Trooper Faul’s findings are included in this report. ‘V-1 was traveling west on US 27 within the left tum lane for NE 140 Court D-1 was delivering 4 shipment of blueberries to Red and White and Blues Farm located at 3250 NE 140" Avenue, Williston, FL 32696. V-2 was traveling east on US 27 in the right travel lane approaching the intersection of NE 140 Court, D-1 failed to observe V-2 approaching and proceeded forward to make a left tum crossing the eastbound travel lanes of US 27. As V-1 was tuming left, and for unknown reasons, D-2 failed to observe V-1 making the left tum and took no evasive action based on physical evidence at the scene. V-2 collided with V-1’s trailer’s right side in the middle area, with the windshield and roof of V-2. Upon impact, V-1 continued to make the left tum onto NE 140" Court and came to rest facing south on NE 140" Court partially within the southbound travel lane and partially on the west shoulder. Post-collision, V-2 was redirected to the southeast and traveled 337 feet, 4 inches, prior to traveling onto the south grass shoulder for another 271 feet. V-2 then collided with a wire fence line. After colliding with the wire fence line, V-2 continued 187 feet, 2 inches before colliding with a second wire fence line. After colliding with the second wire fence line, V-2 traveled an additional 51 feet, 7 inches and collided with a wooden utility pole with the front left of V-2, which upon impact broke the pole. The bottom portion of the wooden pole traveled 36 feet, 9 inches to its final rest. Upon ‘Case Number FHP716-30.007_ Page Number 7 HSMV 62703 (Rev.00108) impacting the wooden pole, V-2 traveled 60 feet, 6 inches rotating counterclockwise and came to final rest facing north in a grass field. ‘Trooper Fulton made contact with D-1 during his crash investigation to obtain a brief statement about the crash, and gather D-1’s driver license, registration and insurance for the crash report. While speaking with D-1, Trooper Fulton did not observe any signs of impairment of D-1. With this observation in mind, Trooper Fulton asked if D-1 would submit to a voluntary blood draw, to which D-1 agreed. At 6:11 P.M,, Paramedic James A. Foran, with the Levy County Fire Rescue, drew two vials of human blood from D-1’s left arm. Trooper Fulton took possession of D-1’s blood sample at 6:21 P.M. ‘On May 8%, 2016, at 5:50 A.M., Trooper Jesse R. Moore received D-1’s blood sample from Trooper Fulton. At 6:20 A.M., Trooper Moore placed D-1’s blood sample into the Temporary Storage Facility at the Florida Highway Patrol Station in Cross City, FL. ‘On May 8", 2016, at 11:20 A.M., an autopsy was performed on D-2 by William F. Hamilton, MD, 8 District Medical Examiner's Office in Gainesville, FL. It was determined that the cause of death for D-2 was from massive head trauma sustained in a motor vehicle crash. A blood sample from D-2 was forwarded to the University of Florida Pathology Laboratories. ‘The results were negative for drugs and ethanol. On May 9%, 2016, at 11:30 A.M., I met with Connie Donely, the store manager of the BP gas station on NW 140 Court at US 27. Ms. Donely gave me access to the stores camera footage. Ms. Donely advised that she is not well versed in the usage of the system and was not sure if the date and time were correct. I accessed the footage available for the date of the crash. 1 viewed 20 minutes prior and 20 minutes after the time of the crash. I did not observe any footage that would be consistent with the vehicles involved in this crash, Case Number EHP716.39.007_ Page Number @ HSM 62709 (Rev.0908) On May 9, 2016 at 10:28 A.M., Lieutenant Patrick V. Riordan retrieved D-1's blood sample from the Temporary Storage Facility and transferred them to the Cross City Evidence Room at 10:34 AM. On May 9", 2016 at 11:50 A.M., Evidence Custodian Judy Morelan retrieved D-1’s blood sample from the Cross City Evidence Room and transferred them to the Florida Highway Patrol station in Lake City where she placed them into the Evidence Room at 1:40 P.M. At 4:00 P.M., Ms. Morelan retrieved D-1’s blood sample from the Evidence Room and forwarded them to the Florida Department of Law Enforcement in Tallahassee for analysis to determine the presence of alcohol or controlled substance. On May 10, 2016 at 2:41 P.M., D-1’s blood sample was received by the Florida Department of Law Enforcement in Tallahassee by Jan Whitfield, FDLE Analyst. ‘On May 11%, 2016 I was in contact with Matthew Schwall, Ph.D. and is the Director of Field Performance for Tesla. After several phone calls and emails, Mr. Schwall requested a subpoena from this investigator in order to assist with the retrieval and download of the SD Card from V-2. The SD Card would offer information as to performance of the vehicle prior to and at the point of impact, as to the speed, mode of transportation, and braking as it relates to the crash. ‘On May 11%, 2016, I made contact with Assistant State Attorney Brian S, Kramer, with the 8° District State Attorney's Office located in Bronson, FL, reference the subpoena needed. Mr. Kramer and Mr. Schwall made contact with one another to arrange the subpoena needed. ‘On May 12, 2016, Trooper Jeremy Faul, with Commercial Vehicle Enforcement, and 1 responded to the Red White and Blue farm located at 3250 NE 140 Ave, Williston, FL to Process V-1. V-I's trailer sustained damage to the trailer at mid length from V-2 impacting and (Case Number FHP716-39-007_ Page Number 9 SMV 62703 (Rev 09108) exiting underneath the trailer. ‘The damage measured 57 inches in width and measured 40 inches up from the ground. The lateral support beams in the area of impact also sustained damage. ‘On May 17, 2016, the subpoena requested to obtain the SD card for V-2 was received by Mr. Schwall. ‘On May 18%, 2016, Mr. Schwall and I arrived at Bronson Lube located at 555 N Hathaway Ave, Bronson, FL 32621 to retrieve the SD memory card from V-2. Upon retrieving the SD card, Mr. ‘Schwall transferred the information from the SD card onto his laptop to be returned to his office in California and interpreted. After the transfer of information, Mr. Schwall tured the SD card ‘over to me and the SD card was placed into the temporary storage facility at the Ocala Florida Highway Patrol station at 1:24 PM. 1 then proceeded to process V-2. V-2 sustained the following damage from the traffic crash. The front bumper cover was separated from V-2. The left front light assembly was separated from V-2. The left front fender was crushed inward up to 15 inches and buckled outward. The Jeft front of the hood was buckled downward. The front right door was out of alignment and has a gouge at the bottom of the door. The left outside mirror was scraped and broken at its base. ‘The right rear door was out of alignment and buckled outward. The right rear, rear and the left rear has scratches and scrapes. Both left side doors were out of alignment. The left rear door was buckled due to the extrication of D-2. The roof was sheared off at the front and folded to the rear upon impacting the right side of V-I’s trailer. The pillars have been bent to the rear from traveling beneath and exiting from under the trailer. ‘The trunk was lifted and folded to the rear, but still attached at the rear. All the windows were broken. All airbags had deployed during the traffic crash. The left front rim was broken, ‘Case Number FHP716.39-007_ Page Number 10 HSM 62703 (Rev.09108) c ‘On May 18, 2016, at 1L24 P.M, V-2's SD card was placed into the temporary storage facility at On May 19", 2016, at 6:10 P.M., Evidence Custodian Judy Morelan retrieved V-2's SD card and relayed it to the Evidence Property Room at the Lake City Florida Highway Patrol station at 8:30 P.M. ‘On May 23%, 2016, Crime Laboratory Analyst Crystal Wells, analyzed D-1’s blood sample for Ethyl alcohol. The result was negative, On June 22, 2016, Crime Laboratory Analyst Lauren Huene analyzed D-1’s blood sample for controlled substance. The result was positive for Delta-9-tetrahydrocannabinol (THC) and 11- Nor-9-carboxy-delta-9-tetrahydrocannabinol. Based on this finding, I consulted with Dr. Bruce ‘A. Goldberger at the University of Florida Pathology Laboratories about quantifying D-1’s blood sample results. On July 134, 2016, Captain Gregory S. LaMont and I met with a team of personnel from the ‘National Transportation Safety Board and Mr. Schwall. Mr. Schwall explained the SD card data from V-2. The data represented that V-2 was in auto cruise mode and was traveling at 74 miles per hour in a 65 mile per hour zone. Mr. Schwall stated that upon V-2 impacting V-1 and the incapacitation of D-2, V-2's battery pack and navigational system was compromised and therefore no longer operational, which placed V-2 into a coasting mode. ‘On July 14, 2016, at 9:30 A.M., Ms. Morelan received D-1’s blood sample from FDLE and retumed it to the Florida Highway Patrol station evidence room in Lake City. On July 19, 2016, at 3:00P.M., Ms. Morelan retrieved D-1’s blood sample from the Lake City evidence room and forwarded it to Dr. Bruce Goldberger at the University of Florida Pathology ‘Case Number FHP716-30-007_ Page Number 11. HSM 62703 (Rev.08108) Laboratories for further quantitative analysis to determine if the resulting levels of THC would cause impairment of the normal faculties. ‘The University of Florida Pathology Laboratories received D-1’s blood sample on July 20%, 2016 at 12:39 P.M. and assigned to Clerk Melissa Bambrick. The results found 2.7 ng/mL of blood of 11-Hydroxy Delta-9 THC, 70 ng/mL of blood of Delta-9 Carboxy THC and 5.6 ng/mL of blood of Delta-9 THC. After consulting with Dr. Goldberger about his findings, he found that the levels of THC present in D-1’s blood sample are impairing levels, however, no signs of impairment were observed of D-1 during the crash investigation. D-1's driver license record was searched and certified through the State of Florida, D-2's driver license record was searched and certified through the State of Ohio. ‘SUMMARY ‘On May 7, 2016, V-1 was traveling west on US 27 in the left tum lane approaching the intersection of NE 140 Court. V-2 was traveling east on US 27 in the right travel lane approaching the intersection of NE 140 Court. D-1 failed to see V-2 and continued to make the left tum onto NE 140 Court. D-2, having V-2 placed in autopilot mode was not attentive and failed to observe V-1, therefore failed to take any evasive action and V-2 collided with the right ‘side of the trailer of V-1 with V-2's windshield and roof line. V-2 continued underneath V-1 and traveled 908 feet, 4 inches from the area of collision to V-2's final rest. After presenting this case to the State Attorney, and their review of the report and discussion with Dr. Goldberger the State Attomey’s Office does not intend to file a criminal information based on the information provided. ‘Case Number FHPT16:39-007_ Page Number 12 Hasty 62703 (Rev 0808) Itis determined that D-1, Frank A. Baressi is in violation of: Florida State Statute 316.122 (1)(c)(1) Violation of Right of Way Left Turn As a result of these violations, D-1, Frank A. Baressi, caused this crash and is responsible for the death of D-2, Joshua D. Brown and the damage to V-2.
