MOTION FOR EXTENSION OF TIME TO FILE

PETITION FOR REVIEW ON CERTIORARI
Petitioner CIVIL SERVICE COMMISSION (CSC), by
counsel, to this Honorable Court, respectfully states:
1.
In a Decision promulgated on January 27, 2016, the
Honorable Court of Appeals Cagayan de Oro City granted the
petition filed by respondent Peter G. Cutao and reversed and
set aside the Decision dated October 2, 2012 and Resolution
dated January 28, 2013 of petitioner CSC. A copy of CA
Decision dated January 27, 2016, hereto attached as Annex
A, was served on the Office of the Solicitor General (OSG) on
March 1, 2016.
2.

Petitioner filed on March 14, 2016 a motion for

reconsideration of the CA Decision dated January 27, 2016.

However, the same was denied in a Resolution dated May 16,
2016. A copy of the CA Resolution dated May 16, 2016, hereto
attached as Annex B, was served upon the OSG on June 6,
2016.

3.
Thus, petitioner has until June 21, 2016 within
which to file a petition for review on certiorari with this
Honorable Court pursuant to Rule 45 of the Revised Rules of
Court.
4.
However, due to heavy pressure of work on the part
of the undersigned counsel and the need to further confer with
the concerned CSC officials, the petition cannot be filed on or
before its due date.
5.
Petitioner is exempt from payment of docket and
legal fees.
6.
There is no deliberate intent to unduly delay the
disposition of the instant case and this motion is solely filed
for the reasons aforestated.
PRAYER
WHEREFORE, it is respectfully prayed that petitioner
CSC be GRANTED an EXTENSION of thirty (30) days from
June 21, 2016 or until July 21, 2016 within which to file its
petition for review on certiorari pursuant to Section 2, Rule 45
of the Revised Rules of Court.
