PRETRIAL SCHEDULING ORDER


This cause came before the Court for a telephonic scheduling conference on October
31, 2016. Counsel of record for all parties participated in the conference. After hearing
from the parties and by their agreement, the Court sets the following pretrial deadlines for
the bench trial on the Gardendale City Board of Educations motion for leave to operate its
own school system:
1. Gardendales motion is set for a bench trial on December 1-2 and December 7-9,
2016, beginning at 9 A.M. in Courtroom 7A at the Hugo L. Black Courthouse in
Birmingham, Alabama.
2. The parties shall serve on each other their pretrial witness lists by Thursday,
November 10, 2016.

3. The parties shall serve on each other their pretrial exhibit lists by Monday,
November 14, 2016.
4. The parties shall serve on each other any demonstratives or visual aids they intend to
use at trial by Tuesday, November 29, 2016.
5. The parties shall file any motions in limine and other pretrial briefs or motions by
Wednesday, November 16, 2016. Motions in limine are limited to no more than twenty
pages in length. No further briefing and no responses to any motions in limine shall be filed
before trial without special leave of Court.
6. A hearing on any motions in limine is set for Friday, November 18, 2016, at 1:30
PM . If the parties are able to resolve pretrial issues without a ruling by the Court, they are
to advise the Court immediately that a hearing is no longer necessary.
7. The parties shall prepare and file a joint stipulation of facts as to which there will be
no dispute at trial, no later than Tuesday, November 29, 2016. Any fact stipulated to will
conclusively be deemed as established for all purposes.
8. If the parties intend to offer exhibits or visual aids electronically, they are to contact
Court staff in advance to coordinate the use of courtroom technology so as to avoid delays
at trial.
