GeneralProvisions
Article1
ThisLawshallbecalledtheLaborLaw.
Article2
TheprovisionsofthisLawshallapplyto:
a.Anycontractunderwhichanypersonundertakestoworkforthe
accountofanemployerunderthelatter'sdirectionorcontrolin
considerationofawage.
b.Contractsofapprenticeship(industrialindentures).
c.WorkmenoftheGovernment,localauthorities,charitable
institutions,andpublicorganizations.
Article3
Bywayofexception,theprovisionofthisLawshallnotapplyto:
a.Workmeninfamilyenterpriseswhichincludeonlymembersof
theemployer'sfamily.
b.Personsworkinginpasturesoragriculture,withtheexception
of:
1.Personsworkinginagriculturalestablishmentswhich
processtheirownproduce.
2.Personswhoarepermanentlyengagedintheoperationor
repairofmechanicalequipmentrequiredforagriculture.
c.Domesticservantsandpersonsregardedassuch.
Article4
Intheabsenceofaspecialprovisiontothecontrary,theprovisionsof
ChapterEightandArticles164,165,and166shallnotapplytothe
following:
a.Workmenemployedinnonmechanizedestablishmentswhich
normallyemploylessthanfiveworkmen,wheretheworkdoes
notcauseanyoftheoccupationaldiseasesincludedinthe
ScheduleofOccupationalDiseases.
b.Seamenandskippersemployedonshipsoflessthan500tons,
whoaresubjecttotheprovisionsofPart11oftheCommercial
Regulations(MaritimeTrade)sanctionedbyRoyalOrderNo.32,
dated15Muharram1350[3June1931].
Article5
TheMinisterofLabormayconsideralloranyofthefollowing
establishmentstobegovernedbytheprovisionsoftheArticlesand
ChaptersmentionedinArticle4ofthisLaw:
a.Anyestablishmentemployingjuveniles.
b.Anyestablishmentemployingwomen.
Article6
ItisillegaltoviolatetheprovisionsofthisLawortoprejudiceany
otherrightsacquiredbytheworkmenbyvirtueofanyother
regulationsorconcessionagreements,Laborcontractoranyother
agreements,orbyvirtueofanyarbitrationawardorRoyalOrder,or
inaccordancewithgenerallyacceptedpracticeorwithwhathasbeen
habituallygrantedbytheemployertohisworkmeninagivenareaor
areas.
Anystipulationinacontractoragreementwherebytheworkman

Anystipulationinacontractoragreementwherebytheworkman
waivesanyrightestablishedinhisfavorbyvirtueoftheprovisionsof
thisLawshallbenullandvoid,evenifsuchstipulationwasmadeprior
totheeffectivedatehereof.
Article7
InthisLaw,thefollowingtermsandexpressionsshallhavethe
meaningssetforthbelow:
1.An"Adult"isapersonwhohascompletedeighteenyearsofage.
2.An"Adolescent"isapersonwhoismorethanfifteenyearsold
buthasnotcompletedeighteenyearsofage.
3.A"Juvenile"isapersonwhohasnotcompletedfifteenyearsof
age.
4.The"Commission"istheCommissionfortheSettlementofLabor
DisputesformedundertheprovisionsofChapterElevenofthis
Law,andthe"ChairmanoftheCommission"istheofficialwho
headsthisCommission.
5."ContinuousService"istheuninterruptedservicewiththesame
employerorhislegalsuccessorfromthedateofcommencement
ofservice.Serviceshallberegardedascontinuousinthe
followingcases:
(a)Regularvacationsorleavesauthorizedbythe
employer.
(b)Where,forlegitimateexcuse,theworkmanabsents
himselffromworkforintermittentperiodstotalingnot
morethanthirtydaysayear.
(c)Wheretheworkmanstopsworkingforareason
imputabletooremanatingfromtheemployer,withwhich
theworkmanhadnothingtodo.
6."Wage"isallthatisgiventotheworkmaninconsiderationofhis
workunderalaborcontract,whetherwrittenorunwritten,
regardlessofthenatureofthewage,whetheritisincashorin
kindandpayablemonthly,weekly,daily,oronapiecework
basis,oronthebasisofthenumberofworkhoursorthe
amountofproductionregardlessofwhetheralloranypartof
suchwageconsistsofcommissionsortipswherethelatterare
paidinaccordancewithgenerallyacceptedpracticeandwhere
therearerulespermittingtheaccuratecalculationthereof.
7.Ingeneral,wagesshallincludeallincreasesandallowanceof
anykind,includingthehighcostoflivingallowanceandthe
familyallowance.
8.A"Workman"isanypersonworkingfortheaccountofan
employerunderthelatter'sdirectionorcontrol,eventhoughhe
maynotbeundertheemployer'sdirectsupervision,in
considerationofawage.
9.An"Employer"isanynaturalorjuristicpersonemployingone
workmanormoreinconsiderationofawage.
10.An"Apprentice"isanypersonwhojoinstheserviceasan
employerforthepurposeoflearningatradeorcraft.
Article8
Iftheemployerentruststoanaturalorjuristicpersononeofhis
principaloperationsoranypartthereof,thelattershallgivehis
workmenalltherightsandprivilegesgrantedbytheemployertohis
ownworkmen,andbothshallbejointlyandseverallyresponsiblefor
suchrightsandprivileges.
Article9
Boththeemployerandtheworkmanshallknowallthecontentsofthe
LaborLawsothateachshallknowwherehestandsandbeawareof
hisrightsandobligations.Inaddition,thereshallbedisplayedata
conspicuousplaceineveryestablishmentemployingtwentyormore
workmenasetofrules,dulyapprovedbytheMinistryofLabor,for
thepurposeofregulatingtheworkintheestablishment,and
containingthefollowing:
a.Classificationoftheworkmenaccordingtotheiroccupational
categories.
b.Workperiodsandhours,officialholidays,weeklydayofrest,
andpaydaysforthevariouscategoriesofworkmen.
c.Workshifts.
d.Rulesgoverningattendance,tardiness,absence,entryintoand
exitfromtheplacesofwork,andinspection.
e.Vacationsandeligibilitytherefor.
f.Anyotherdetailsrequiredbythenatureofworkinthe
establishment.
g.Thereshallalsobedisplayedataconspicuousplaceinthe
establishmentasetofdisciplinaryruleslistingtheacts,
offences,actsofinsubordinationandtheworkman'sobligations,
andthecorrespondingcashpenaltiesordisciplinaryactions,in
accordancewiththestandarddisciplinaryrulestobeissuedby
theMinisterofLabor.Suchrulesandanyamendmentsthereto
shallnotbecomeeffectiveexceptaftertheyhavebeenapproved
bytheMinistryofLabor.
Article10
Theemployerorresponsiblemanagershallkeepattheplaceofwork
recordsandrostersshowingthefullnameofeachworkmanaswellas
hisnationality,tradeoroccupation,hisdateofbirthorage,placeof

hisnationality,tradeoroccupation,hisdateofbirthorage,placeof
residence,familystatus,dateofcommencementofhisservice,his
wagesandwagesupplements,anychangesintheworkman'sstatus,
andanypenaltiesimposedonhimandtherelativeinvestigation
reports,hisregularworkhoursandovertime,thevacationsand
benefitsincashorinkindthathereceives,thedateofterminationof
hisservicesandthereasonsforsuchtermination,theindemnities
receivedbytheworkmanonaccountofsuchtermination,andsuch
othernecessaryinformationasrelatetotheimplementationofthe
provisionsofthisLaw,particularlythosepertainingtotheemployment
ofjuvenilesandwomenandtolaborinjuriesandoccupational
diseases.
Article11
Intheeventthereareseveralpartnersormanagersinany
establishment,oneofthem,whoisaresidentoftheplaceofwork,
shallbeappointedtorepresenttheemployerandberesponsiblefor
anyviolationoftheprovisionsofthisLaw.TheappropriateLabor
Officeshallbeinformedofthenameofsuchpartnerormanagerwho
shallremainresponsiblebeforethesaidLaborOfficeuntilitis
informedofhisreplacementbyanothernotice.
Article12
Intheeventofanycomplaintagainstanyoftheofficialswhoare
chargedwiththeenforcementoftheprovisionsofthisLawin
connectionwiththedischargeoftheirofficialduties,suchcomplaint
shallbeinvestigatedbyaCommissionofthree,oneofwhomshallbe
selectedbytheMinisterofLabor,whilethesecondshallbefromthe
PersonnelBureauandthethirdanadministrativeinvestigator
designatedbytheGrievanceBoardorbyanyjudicialauthority
replacingit.
Iftheinvestigationrevealsthatcomplaintisfalseorvexatious,the
complainantshall,byadecisionoftheCommission,bepunishedwith
afineofnotlessthanfivehundredriyalsandnotmorethantwenty
thousandriyals.Ifthecomplaintagainsttheofficialiffoundtobe
valid,theCommissionshallsubmitareporttothiseffecttothe
MinisterofLaborsothathemayissuehisinstructionsforthe
necessaryactiontobetakeninaccordancewiththestatutory
provisionsinforce.
Article13
NocomplaintshallbeheardbyanyCommissioninrespectof
violationsoftheprovisionsofthisLaworoftherules,decisionsor
ordersissuedinaccordancetherewith,afterthelapseoftwelve
monthsfromthedateoftheoccurrenceofsuchviolation.Nocaseor
claimrelatingtoanyoftherightsprovidedforinthisLawshallbe
heardafterthelapseoftwelvemonthsfromthedateofterminationof
thecontract.Also,noactionorclaimrelatingtoanyoftherights
providedforinanypreviousregulationsshallbeheardafterthelapse
ofonefullyearfromtheeffectivedateofthisLaw.
Article14
ActionsarisingundertheprovisionsofthisLawshallbeheard
expeditiously.TheCommissionmayorderthelosingpartytopaythe
otherpartyallorpartoftheexpensesincurredbythelatter.
Article15
Theamountstowhichtheworkmanorhisdependentsareentitled
undertheprovisionsofthisLawshallbeconsideredfirstclass
privilegeddebts,andfortherecoverythereoftheworkmanorhis
heirsshallhaveapriorityrightoveralltheemployer'sproperty.Inthe
eventoftheemployer'sbankruptcyortheliquidationofhis
establishment,suchamountsshallberecordedasprivilegeddebts,
andtheworkmanshallbepaidimmediatelyaportionequivalentto
onemonth'spaybeforepaymentofanyothercosts,includingjudicial
bankruptcyorliquidationcosts.
Article16
Arabicisthelanguagetobeusedinallresolutions,records,registers,
files,statements,andotherdocumentsprovidedforinthisLaw,orin
anydecisionororderissuedinapplicationoftheprovisionshereof,as
wellasinanyinstructionsorcircularsissuedbytheemployertohis
workmen.Intheeventaforeignlanguageisusedbytheemployer
alongwiththeArabiclanguage,theArabictextshallprevailatall
times.
Article17
AllperiodsandtimelimitsprovidedforinthisLawshallbecomputed
onthebasisoftheHijrahCalendar,unlessanothercalendarisagreed
upon.
Article18
Beforethecommencementofworkinanyestablishment,theemployer
shallfurnishtheappropriateLaborOfficewiththefollowing
informationinwriting:
a.Nametypeandlocationoftheestablishmentandtheaddressto
whichcommunicationsshallbesent.
b.Natureoftheworktobecarriedoutorlikelytobecarriedout
bytheestablishment.
c.Thenumberofworkmentobeemployedintheestablishment.
d.Nameoftheresponsiblemanageroftheestablishment.
e.Anyotherinformationrequiredfortheproperenforcementof
thisLaw.
InformationconcerningestablishmentsexistingatthetimethisLawis
putintoeffectshallbesentwithinthreemonthsfromtheeffective
datehereof.

Article19
Intheeventtheresponsiblemanagerisreplaced,theemployershall
notifytheappropriateLaborOfficeinwritingofthenameofthenew
managerwithinsevendaysfromthelatter'sassumptionofhisduties.
Ifnoonehasbeenappointedasaresponsiblemanagerofthe
establishment,orifthepersonsoappointedhasnotassumedhis
duties,thenthepersonwhoactuallyperformsthemanager'sdutiesor
theemployerhimselfshallberegardedasaresponsiblemanagerof
theestablishment.
Article20
WithinthemeaningofthisLaw,amonthshallbereckonedasthirty
daysunlessotherwiseprovided.
Article21
Physiciansfortheissuanceofthenecessarycertificatesshallbe
selectedbyconsultationbetweentheMinisterofLaborandtheMinister
ofHealth.
Article22
Itisillegalforanyworkmanoremployertodoanyactthatmay
constituteanabuseofanyoftheprovisionsofthisLaw,orofthe
decisionsandrulesissuedinexecutionoftheprovisionshereof.Itis
alsoillegalforanyworkmanoremployertodoanyactthatmaybring
pressuretobearonthefreedomoftheotheroronthefreedomof
otherworkmenoremployerswiththeobjectofrealizinganyinterest
orsupportinganypointofviewwhichtheyadoptandwhichis
inconsistentwiththefreedomofworkandthejurisdictionofthe
authoritiesconcernedwiththesettlementofdisputes.
AnyoffendershallbeliabletothepenaltiesprovidedforinthisLaw
andinthegeneralregulations.
ChapterTwo
LaborInspection
Article23
Laborinspectionshallbeundertakenbycompetentinspectorstobe
designatedbydecisionoftheMinisterofLabor.
TheyshallhavethepowersandfunctionsprovidedforinthisLaw.
Article24
Laborinspectionshallhavethefollowingfunctions:
a.Supervisingtheproperenforcementoftheprovisionsofthe
LaborLaw,particularlyasregardsworkconditions,wages,
controlandprotectionofworkmenonthejob,theworkmen's
healthandsafety,andtheemploymentofjuveniles.
b.Furnishingemployersandworkmenwiththeinformationand
technicalguidancethatwillenablethemtoadoptthebestmeans
fortheenforcementoftheprovisionshereof.
c.Informingthecompetentauthoritiesofthedeficiencieswhichthe
provisionsinforcefailtoremedy,andsuggestingthenecessary
action.
d.RecordingviolationsoftheprovisionsoftheLaborLawandof
thedecisionsissuedinapplicationhereof.
Article25
Laborinspectors,shall,beforeassumingtheirofficialduties,takethe
oathbeforetheMinisterofLabortodischargetheirdutieshonestlyand
faithfullyandnottodisclosethesecretofanyindustrialinventionor
anyothersecretwhichmaycometotheirknowledgebyreasonof
theiroffices,evenaftertheyceasetohaveanyconnectionwithsuch
offices.Laborinspectorsshallcarryidentificationcardstobeprovided
thembytheMinistry.
Article26
Employersandtheiragentsshallextendtoinspectorsandother
officialschargedwithLaborinspectionthenecessaryfacilitiesto
enablethemtoperformtheirduties,andshallfurnishthemwithany
informationtheymayrequire,respondtoanysummonstoappear
beforethem,andsendadelegatetoappearontheirbehalfiftheyare
sorequired.
Article27
Laborinspectorsshallhavetherightto:
a.Enteranyestablishmentthatissubjecttotheprovisionsofthe
LaborLawatanytimeduringthedayornightwithoutprior
notice,providedthatsuchentryshallbemadeduringworking
hours.
b.Conductanyexaminationorinvestigationthatmaybenecessary
toascertainheproperenforcementoftheLaw.
Theymayinparticular:
First:Questiontheemployerortheworkmenseparately
orinthepresenceofwitnessesaboutanymatterrelating
totheenforcementoftheprovisionsoftheLaw.
Second:Examineallbooks,records,anddocuments
requiredtobekeptundertheprovisionsotheLaborLaw
andofthedecisionsissuedhereunder,andobtainany
copiesorextractstherefrom.
Third:Takeasampleorsamplesofthematerialsusedor
handledintheindustrialandotheroperationsthatare
subjecttoinspection,ifsuchmaterialsarebelievedto
haveaharmfuleffectonthehealthorsafetyofthe
workmen,forthepurposeofhavingsuchsamples
analyzedinGovernmentlaboratoriesanddeterminingthe

analyzedinGovernmentlaboratoriesanddeterminingthe
extentofsucheffect,dulynotifyingtheemployerorhis
representativeoftheiraction.
Fourth:Ascertainthatnoticesandcommunications
requiredtobepostedundertheLawaredulyposted.
Article28
TheMinistryofLaborshallpreparetheappropriateRulesof
implementationforthecontrolandregulationoftheinspection
operationsprovidedforintheprecedingArticle,andsuchRulesshall
beissuedbyadecisionoftheCouncilofMinisters.
Article29
Thepersonperformingtheinspectionshallnotifytheemployerorhis
representativeofhispresence,unlesshebelievesthatthematterfor
whichheismakingtheinspectioncallsforadifferentcourseofaction.
Article30
Alaborinspectorshallhavetherighttoorderemployersortheir
agentstomakemodificationsintheoperatingrulespertainingtothe
plantandequipmentusedintheirestablishmentwithintheperiods
prescribedbytheinspectorinordertoinsuretheproperapplicationof
theprovisionpertainingtothehealthandsafetyoftheworkmen.
Wherethereisanimminentdangerthreateningtheworkmen'shealth
andsafety,theinspectormayrequiretheimmediateadoptionof
whatevermeasureshemaydeemnecessarytoforestallsuchdanger.
Article31
Laborinspectorsshalltreatanycomplaintsreachingtheminrespectof
anydeficiencyintheplantoranyviolationoftheprovisionsoftheLaw
asstrictlyconfidentialandshallnotdisclosetotheemployerorhis
representativetheexistenceofsuchcomplaints.
Article32
If,inthecourseofhisinspection,theinspectorfindsthata
contraventionoftheLaborlaworofanydecisionsissuedhereunder
hasbeencommitted,heshallprepareareportinduplicatesetting
forththecontraventionandshallsubmitsuchreporttotheDirectorof
theLaborOfficefornecessaryactionagainsttheoffender.
Article33
TheDirectorandinspectorsoftheLaborOfficemay,wherenecessary,
calluponcompetentadministrativeauthoritiesandmembersofthe
policeforcetoprovidewhateverassistancemayberequired.
Iftheinspectionrelatestothehealthaspectsofthework,the
inspectorshall,withtheapprovaloftheDirectoroftheLaborOffice,
takewithhimacompetentphysicianfromtheMinistryofLabororthe
MinistryofHealth.
Article34
TheChiefofLaborInspectionintheareashallprepareamonthly
reportonthelaborinspectionactivities,theaspectsofinspection,the
establishmentsinspectedandthenumberandnatureoftheviolations
committed.Heshallalsoprepareanannualreportoninspectioninthe
areaandtheresultsandeffectsthereof,inwhichheshallincludehis
commentsandsuggestions.Acopyofboththemonthlyandtheannual
reportsshallbesenttotheMinistryofLabor.
Article35
TheDeputyMinistryforLaborshallprepareanannualreporton
inspectionintheKingdom.Suchreportshallincludeallmatters
relatingtotheMinistry'scontrolovertheenforcementofthe
provisionsoftheLaborLaw,particularlythefollowingmatters:
1.Astatementoftheprovisionscoveringinspection.
2.Alistoftheofficialsinchargeofinspection.
3.Statisticaldataontheestablishmentsthataresubjectto
inspectionndthenumberofworkmentherein.
4.Statisticaldataonthenumberofvisitsandinspectiontours
madebytheinspectors.
5.Statisticaldataonthecontraventionscommittedandthe
penaltiestowhichtheoffendersweresentenced.
6.StatisticaldataonLaborinjuries.
7.Statisticaldataonoccupationaldiseases.
Article36
TheMinistryshallprepareformsforcontraventionreports,inspection
records,noticesandwarnings,andshalllaydownthenecessaryrules
forthesafekeepinganduseofsuchformsandfortheirdistributionto
alltheLaborofficesinthevariousareas.
Article37
Inadditiontothegeneralrequirementsfortheemploymentof
Governmentemployers,theLaborinspectorsmustsatisfythe
followingrequirements:
a.Theyshallbecompletelyimpartial.
b.Theyshallnothaveanydirectinterestintheestablishments
inspectedbythem.
c.Theyshallpassaspecialprofessionalexaminationfollowinga
trainingperiodofnotlessthanthreemonths.
Article38
Thetrainingoflaborinspectorsandcontrollersshallbeconductedin
specialtrainingcoursestobeorganizedbytheMinistry.Attentionshall
begiveninthosecoursestotrainingtheinspectorsinthefollowing
mattersinparticular:
a.Principlesoftheorganizationofinspectionvisitsandofcontacts
withemployersandworkmen.
Principlesofauditingbooksandrecords.

b.Principlesofauditingbooksandrecords.
c.Principlesofcounselingtheemployersintherequirementsofthe
statutoryprovisionsandthebenefitstobederivedfromtheir
application,andassistingtheemployersinsuchapplication.
d.Fundamentalprinciplesofindustrialtechnologyandmeansof
protectionagainstlaborinjuriesandoccupationaldiseases.
e.Fundamentalprinciplesofproductivityandtherelationitbears
totheextentofprovidingthefavorableconditionsforthe
performanceofthework.
ChapterThree
CombatingUnemployment,
andtheVocationalRehabilitationoftheDisabled
First:EmploymentOffices
Article39
TheMinistryshallsetupemploymentofficesinlocationssuitablefor
boththeemployersandworkmen.Suchofficesshallbeunderthe
supervisionoftheMinistryandshalloffertheirservicesfreeofcharge
forthepurposeofassistingworkmeninfindingsuitablejobsand
assistingemployersinfindingsuitableworkmen.
Theemploymentofficesshallcollectandanalyzethenecessary
informationonthepositionanddevelopmentofthelabormarketso
thatsuchinformationmaybeavailabletothevariouspublicand
privateorganizationsconcernedwitheconomicandsocialplanning.
Suchofficesshallperformthefollowingduties:
a.Recordingthenamesofapplicantsforjobs,indicatingtheir
vocationalqualificationsandexperience,aswellastheirduties.
b.Obtaininginformationonvacantjobsfromemployers.
c.Referringworkmen'sapplicationstosuitablevacancies.
d.Extendingadviceandassistancetojobapplicantsconcerning
vocationaltrainingorretrainingrequiredtoobtainthevacant
jobs.
e.Facilitatingthetransferoftheworkmanfromoneoccupationto
another.
f.SuchothermattersasmaybedeterminedbytheDeputy
MinisterforLabor.
Article40
Nopersonshallactasanemploymentagentorasacontractorto
supplyworkmenunlessheispermittedtodosobytheDeputyMinister
forLaborandisinpossessionofanannuallicensewhichshallbe
renewableatthediscretionofthecompetentauthoritywhichshall
controlhisactivity.Nosuchlicenseshallbegrantedwherethereisan
employmentofficebelongingtotheMinistryortoanorganization
approvedbytheMinistryoperatingintheareaandcapableofacting
asanintermediaryforthesupplyofthenecessarylabor.
Article41
Theemploymentagentorthelaborsuppliermaynotdemandor
acceptfromanyworkman,whetherbeforeorafterhisemployment
underalaborcontract,anymoneyormaterialrewardinreturnforthe
workman'semployment,ortocollectfromtheworkmananycosts
exceptasmaybedecidedandapprovedbythecompetentauthorities.
Theworkmensuppliedbytheemploymentagentorlaborcontractor
(laborsupplier)shall,immediatelyupontheirengagementbythe
employer,beregardedasemployedbythelatteranshallhaveall
rightsandprivilegesoftheoriginalworkmenoftheestablishment.The
relationshipbetweenthemandtheemployershallbedirectwithout
anyinterventionbythelaborsupplierwhosemissionandrelationwith
theworkmenshallendimmediatelyuponpresentingthemtothe
employer.
Article42
TheemployershallinformtheappropriateLaborOffice,byregistered
letterorbyanyothermeansprovingreceipt,ofvacanciesandnewly
createdjobsofanykind,andshallgivethekindandlocationofeach
job,thewageallottedtoit,thejobrequirementsandthedatefixedfor
fillingit.Suchnoticeshallbegivenwithinaperiodnotexceedingten
daysfromthedateonwhichthejobbecomesvacantoriscreated.
Article43
TheemployershallsendtotheappropriateLaborOfficeduringthe
monthofDhualHijjahofeachyearthefollowingannualstatements:
1.Astatementshowingthenumberofhisworkmen,andthe
names,job,occupation,rateofpay,age,nationality,andthe
numberanddateofworkpermitofeach.
2.Astatementofthevacantandnewlycreatedjobsandpositions,
andthekindandrateofpayofeach,thejobsthathavebeen
filledandthereasonsfornotfillingtherestduringtheyear
precedingthedateofsuchstatement.
3.Areportonthecondition,circumstances,andnatureofthe
work,andtheexpecteddecreaseorincreaseinthenumberof
jobsduringtheyearfollowingthedateofsuchreport.
Article44
Withoutprejudicetotheconditionslaiddowninconcessionandother
agreementsandordersregardingtraining,education,and
scholarships,everyemployeremployingonehundredormore
workmenshalltrainintechnicaljobsanumberofhisSaudiworkmen
thatisnotlessthan5%ofthetotalnumberofhisworkmen,in
accordancewithatrainingprogramtobepreparedbytheMinistryof

accordancewithatrainingprogramtobepreparedbytheMinistryof
Labor.
TheMinisterofLaborshall,bydecision,prescribetherulesand
conditionstobeobservedinsuchtrainingandshallindicatethe
minimumandmaximumtrainingperiods,andsetforththecurriculaof
thetheoreticalandpracticaltraining,themethodoftestingandthe
certificatestobegrantedinthisregard.
Article45
ThenumberoftheSaudiworkmenoftheemployershallnotbeless
than75%ofthetotalnumberofhisworkmen,andtheirwagesshall
notbelessthan51%ofthetotalwagesofhisworkmen.
Iftechnicalskillsoreducationalqualificationsarenotavailable,the
MinisterofLabormayreducethisratiotemporarily.
Article46
TheMinisterofLabormay,ifnecessary,requireemployersincertain
industriesoroccupationsorincertainareasnottohireworkmen
exceptthroughtheemploymentoffices,subjecttothetermsand
conditionsheshallprescribeinadecision.
Article47
AdecisionoftheMinistershalldeterminetherulesandprocedures
governingtheconductofbusinessattheemploymentoffices,andshall
prescribetheformsoftheRecords,noticesandotherdocuments
handledbysuchoffices,aswellasjobclassificationschedulesin
accordancewiththeinternationaljobclassifications,whichshallserve
asbasisfortheorganizationofemploymentoperations.
Second:EmploymentofForeigners
Article48
WorkisarightoftheSaudinationalandmaynotbeexercisedby
otherexceptafterfulfillmentoftheconditionsprovidedforinthis
Chapter.Saudiworkmenareequalintheirrighttoworkinallareasof
theKingdomwithoutdiscrimination.
Article49
Noforeignersshallbebroughtintothecountrytoworknormayhebe
permittedtoworkwithcompaniesandprivateestablishmentsexcept
aftertheapprovaloftheMinisterofLaborandaftersecuringawork
permitinaccordancewiththeform,procedures,andrulestobe
prescribedbytheMinisterofLabor.Suchpermitshallnotbegranted
exceptafterfulfillmentofthefollowingconditions:
1.Thattheworkmanshallhaveenteredthecountryinalegal
mannerandshallhavesatisfiedtheconditionsprescribedinthe
ResidenceRegulations.
2.Thatheshallpossessthevocationalskillsandeducational
qualificationsofwhichtheCountryisinneed,providedthatthe
nationalspossessingsuchqualificationsareeitherlackingor
insufficientinnumber.
3.ThatheshallbeundercontractwithandguaranteedbyaSaudi
employer,oranonSaudiemployerauthorizedunderthe
RegulationsfortheInvestmentofForeignCapital,orshallbea
memberofaliberalprofession,guaranteedbySaudinational,or
undercontractwithandguaranteedbyaconcessionaire
company.
Theterm"work"asusedinthisArticleshallmeananyindustrial,
commercial,agricultural,financial,orotherwork,andanyservice,
includingdomesticservice.
Article50
Inaccordancewiththeconditions,rulesandperiodstobedetermined
bytheMinisterofLabor,everyemployershallvocationallypreparehis
SaudiworkmentoreplacenonSaudis,byimprovingtheirstandardin
technicaljobsperformedbynonSaudissothattheSaudiworkman
maybeabletoreplacethenonSaudi.Theemployershallkeepa
registerinwhichheshallrecordthenamesoftheSaudiworkmenwho
havereplacednonSaudis.
Third:VocationalRehabilitationoftheDisabled
Article51
Adisabledpersonisanypersonwhosecapacitytoperformand
maintainasuitablejobhasactuallydiminishedasaresultofa
physicalormentalinfirmity.
Article52
"Vocationalrehabilitation"shallmeantheservicesprovidedtothe
disabledpersonaltoenablehimtoregainhiscapacitytoperformhis
originalworkoranyotherworkwhichsuitshiscondition.
Article53
TheMinisterofLaborshall,inagreementwiththeMinistriesand
establishmentsconcerned,setupandorganizetheinstitutions
necessarytoprovidevocationaltrainingservices.Suchinstitutions
shallgivethedisabledworkmanwhohasbeenrehabilitateda
certificateconfirmingsuchrehabilitation.Theinformationtobe
containedinsuchcertificateshallbedeterminedbyadecisionofthe
MinisterofLabor.
Article54
Anyemployerwhoemploys50ormoreworkmen,andthenatureof
whoseworkallowshimtoemploydisabledworkmenwhohavebeen
vocationallyrehabilitated,shallemploysuchworkmentotheextentof
2%ofthetotalnumberofhisworkmen,whetherthroughnomination
bytheemploymentofficesorotherwise.Heshallsendtothesaid
officeastatementindicatingthejobsandpositionsoccupiedby

bytheemploymentofficesorotherwise.Heshallsendtothesaid
officeastatementindicatingthejobsandpositionsoccupiedby
disabledworkmenwhohavebeenvocationallyrehabilitatedandthe
payrateofeachsuchworkman.
Article55
Ifaworkmansustainsaninjuryresultingindisablementwhichdoes
notpreventhimfromperformingajobotherthanhispreviousjob,the
employerinwhoseservicetheinjuryoccurredshallassignsuch
workmantoasuitablejobatthesalaryfixedforsuchjob,within1%
ofhistotalworkforce,andwithoutprejudicetotheworkman'srightto
compensationforhisinjury.
Fourth:ContractsofApprenticeship
Article56
Acontractofapprenticeshipisacontractwherebyanemployeragrees
toemployayoungworkmaninordertotrainhimmethodicallyina
certaintradeorcraftwithinaspecifiedperiodduringwhichthe
apprenticeisboundtoworkundertheemployer'ssupervision.
Article57
Theemployerwhoemploysapprenticesshallbeatleast21yearsold,
ofgoodreputation,andhe,orthepersoninchargeoftraining,shall
possessadequatequalificationsandexperienceinthesubjecttradeor
craft.Theestablishmentitselfshallsatisfytheappropriatetechnical
requirementstoprovidetheapprenticeswiththenecessaryfacilities
fortrainingintheparticulartradeorcraft.
Article58
Theapprenticeshipcontractshallbemadeinwriting,andshallindicate
theperiodofapprenticeship,itssuccessivestagesandthewagesdue
ateachstage.Wagesatthelaststageshallnotbelessthanthe
minimumwagespaidforsimilarwork,andshallunderno
circumstancesbedeterminedonapieceworkorproductionbasis.
Article59
Theapprenticeshipcontractshallbedrawnupinatleastthreecopies,
onecopyofwhichshallberetainedbyeachparty,andthethirdcopy
shallbedepositedattheappropriateLaborOfficewithinoneweek
fromthedateofsigningthecontract.Theofficialindisputabledateof
thecontractshallbeheldtobethedateonwhichthiscopyis
depositedandrecordedattheLaborOffice.Thecontractshallbe
signedbytheemployerorhisofficialrepresentative,andbythe
apprenticeorhislegalortestamentaryGuardianwheretheapprentice
isunder16yearsofage.Apprenticeshipcontractsshallbeexempt
fromregistrationfeesandstampduty.
Article60
TheMinisterofLabormaysubmitaproposalfordeterminingthose
tradesandcraftsinwhichapprenticesshallbeaccepted,theperiodof
apprenticeshipineachtradeorcraft,thetheoreticalandpractical
programstobefollowed,theconditionsgoverningexaminationsand
thecertificatetobegivenattheendoftheapprenticeshipperiod,
providedthatsuchproposalshallbeapprovedbythePresidentofthe
CouncilofMinisters.
Article61
TheMinisterofLaborshallhavetherightinallcasestodesignateone
expertormoreinthetradeorcraftinwhichapprenticeshipistobe
organized,inordertoavailhimselfoftheexpert'sreportinsuch
organization.
Article62
Beforecommencinghisapprenticeship,theapprenticeshallsubmitto
amedicalexaminationforthepurposeofdetermininghisstateof
healthandhisabilitytoperformtheworkofthetradewhereinhe
wishestobeapprenticed.Wherethetraderequiresspecialphysical
andhealthconditions,themedicalreportshallindicatethatthe
candidatefulfillssuchspecialconditions,whethertheybephysicalor
psychological.
Article63
Theemployershalltreattheapprenticeasagoodfather,guidinghim
andsupervisinghisconduct.Heshalladvisehislegalortestamentary
guardianoftheseriouserrorscommittedbytheapprentice,aswellas
ofhismoralandtemperamentalaberrations.Theemployershallnotify
suchguardianwithoutdelayincaseoftheapprentice'sillnessor
absenceandinanyothercasesrequiringtheguardian'squick
intervention.Heshallnotusetheapprenticeexceptintheoperations
andservicesrelatingtohispracticingandlearningthetradeorcraft.
Article64
Theemployershallinstructtheapprenticegraduallyandfullyinthe
principlesandtechniquesofthetradeorcraftstipulatedinthe
apprenticeshipcontract,andshallattheendofhisapprenticeship,
delivertohimadocumentacknowledgingcompletionofthe
apprenticeship.
Article65
Theapprenticeshallobservehismaster'sinstructionsandadvicewith
duerespectandpoliteness,andheshallcooperatewithhimandassist
himwithinthelimitsofhiscapacityandability.
Article66
Theemployermaycanceltheapprenticeshipcontractifhefeelsthat
theapprenticedoesnothavetheaptitudeorabilitytousefully
completehisapprenticeship.Theapprenticeandhislegalguardian
shallalsohavethisright.Thepartywishingtocancelthecontractshall
sonotifytheotheratleastoneweekbeforethedateofcessationof
thework.

Article67
Intheestablishments,industriesandtradestobespecifiedby
decisionsoftheMinisterorLabor,thelattermayobligesuch
establishments,industriesandtradestoaccept:
a.Anumberandspecifiedproportionofapprenticesinaccordance
withtheterms,periodsandconditionsdeterminedbythe
MinisterunderArticles60and61.
b.Anumberandspecifiedproportionofstudentsorgraduatesof
industrialandvocationalinstitutes,fortrainingandpursuanceof
practicalexperience,inaccordancewiththeterms,conditions,
periodsandwagestobespecifiedinanagreementtobe
concludedbetweentheMinistryandthemanagementofthe
establishmentconcerned.
Article68
TheCouncilofMinistersmay,bydecision,imposeafiscalcharge
called"theVocationalTrainingtax"ontheindustrialandtrade
establishmentswhoseoccupationalfieldsandnumberofworkmen
shallbedeterminedinsuchdecisionontherecommendationofthe
MinisterofLabor.Theproceedsofthevocationaltrainingtaxshallbe
appropriatedtofinancetheexistingtrainingestablishmentsandtheir
institutes,andtocreatenewestablishmentsaninstituteswhere
necessary.
Article69
Theemployershallhavetherighteithertoretaintheapprenticeinhis
serviceaftercompletionofhisapprenticeshipperiod,ornottoemploy
him.Similarly,theapprenticeshallhavetherighteithertoremainin
theemployer'sserviceaftercompletionoftheapprenticeshipperiod,
ortoleavesuchservice,unlessotherwiseprovidedinthe
apprenticeshipcontract.
