On A ugust5,20l6,an lndictm entw as filed charging the D efendantwith one count

ofconspiring to distlibute five (5)kilograms ormore ofcocaine knowing thatitwould be

unlawfully im ported into the U nited States,in violation of Title 21,United States Code,Sections
959 and 963.
The Govenzm ent originally sealed the lndictm ent on the belief that such sealing

w ould assistin arresting the D efendant. How ever,the G overnm entno longerbelievesthatkeeping
the lndictm entunder sealw illhelp w ith the arrest.
