(EuropeAid/151888/DD/ACT/MD),
Geographical Zone - x and now is intending
to apply for the EIDHR 2016 Global Call for
Proposals,
EuropeAid/152550/DH/ACT/Multi.

A similar question was already answered. Please refer to


question n23 of the document "Questions and Answers
III" published on the web page of the EIDHR 2016 Global
Call for Proposals.

In this respect, I wanted to ask if our


organization is eligible to apply for this
specific call and if it is not considered as

applying for two times?

According to point 2.1.4. of the guidelines


(Number of applications and grants per
applicants / affiliated entities): 'An
organisation may not be participating more
than once in the present call for proposals as
lead applicant or co-applicant. Should this
be the case, the EC will only consider the
first proposal arrived (based on the date and
hour of submission) and any other additional
proposal will be rejected. It is the
responsibility of each lead applicant to
verify that its co-applicants are not involved
as lead applicant or co-applicant in other
proposals).

Organisations sharing a common funding structure can


participate in different proposals under this call as long as
they are separate legal entities and each of them meets the
eligibility criteria related to applicants, co-applicants or
affiliated entities.

Following this requirement my question is:


Can distinct organisations, all legally
registered in different countries, but who
share a common funding structure,
participate in different proposals, regardless

Grant Applicants, the application requires
that, to be eligible, an action must include
at least one local organisation, as lead
applicant or co-applicant. A local
organisation (with or without legal
personality) must be understood as
established in the country or one of the
countries outside EU where the action is
taking place. An organisation is considered
"local" when its charter demonstrates that
the organisation has been established by an
instrument governed by the national law of
the country concerned (only for entities with
legal personality) and that its head office is
located in that country.

The countries in which the action takes place shall be


understood as those whose human rights challenges in
relation to the theme of the Lot are being addressed by the
action.

Also note that as per section 1.2., "For actions covering


more than one country, the participation of local
applicants (as lead or co-applicants) in at least half of
the countries where the action will take place will be

Our organization will be applying for an


international project addressing impunity in
selected target countries in Africa, the
Americas, Asia and the Pacific, the Middle
East and North Africa (MENA) and Eastern
Europe (outside the EU). One of our target
countries for advocacy in addressing
impunity and supporting transitional
justice will be the one where our
organization has its headquarters. For this
reason, we are asking if we would meet the
EU guidelines for being a local organization
and may be entitled to apply as the sole
applicant for this call for proposals.

programmes and campaigns. This global

not have, as such, local offices, we hope that
the local expertise and grassroots access that

I am confused about the various statements


regarding locations for the actions and
applicant organisations. Our proposal will
focus on torture taking place in a country
where there is no civil society organisation
and where it is unsafe for them to work. The
lead applicant and two additional coapplicants, are in another country where
many asylum seekers from the focus country
currently reside. This country is outside of
the EU. We will be doing the work of
'support for rehabilitation of victims of
torture' and some work of 'accountability'.
However, we are in need of partners to be
co-applicants to work on the 'prevention'
element. Can this co-applicant or applicants
be from EU countries?

Regarding the question of the location of eligible actions,


section 2.1.4 states:
"Actions must take place in one or more countries
outside the European Union.
Nevertheless, punctual activities may, if duly justified in
the description of the action, take place in EU countries
when they are directly related to situations arising in third
countries and for the benefit of those countries, e.g. a
seminar or conference, a visit to the European Institutions,
an opening or closing of a campaign in an EU Member
State, a specific exhibition or other similar single events.
These reasons will be examined during the evaluation
process."
Concerning the eligibility of applicants, you can refer to
section 2.1.1 of the Guidelines, which states:
"The lead applicant may act individually or with coapplicant(s). However, to be eligible, an action must
include at least one local organisation, as lead applicant
or co-applicant (emphasis added).
A "local organisation" (with or without legal personality)
must be understood as "established" in the country or one
of the countries outside EU where the action is taking place
(emphasis added). An organisation is considered "local"
when its charter demonstrates that the organisation has
been established by an instrument governed by the national
law of the country concerned (only for entities with legal
personality) and that its head office is located in that
country.
In situations where registration in the concerned country is
made impossible or might put the applicant or co-applicant
in danger, the applicant or co-applicant may be registered
in another country (emphasis added). The applicant or coapplicant must prove in its statutes or through other
supporting documents that the objectives and activities of
the said organisation are for the benefit of the targeted
country. In the absence of any justification, the proposal
will be rejected. The validity of the justification provided

will be examined during the evaluation procedure. Should


the justification not be deemed valid, the proposal may be
rejected on that sole basis."
Also note that as referred in section 1.2 of the Guidelines:
"Priority will be given to proposals submitted by local
organisations3 as lead applicants in order to promote
ownership and local leadership"

Our organisation considers trafficking in


human beings to be a form of torture and ill
treatment as per the Convention against
Torture and Other Cruel, Inhuman or
Degrading Treatment or Punishment. In this
respect please can you confirm if activities
contributing to the reduction in trafficking in
human beings and rehabilitation of victims
of trafficking in human beings is a theme
eligible under lot 2?

As per section 2.2.4 of the Guidelines, in the interest of


equal treatment of applicants, the European Commission
cannot give a prior opinion on the eligibility of an
applicant, a co-applicant, an affiliated entity, an action or
specific activities.

In 1.2.1 in the concept note guidelines, it is


mentioned in iii) to "Describe which of the
expected results referred to in the guidelines
for applicants will be addressed." For Lot 4,
we cannot find any referrals to "expected
results" in the guidelines. Please elaborate
on what the "expected results referred to in
the guidelines from applicants" refers to for
Lot 4.

The expected results have to be defined specifically and


individually in each proposal drawing from the objectives
and priority issues to be addressed in this call for proposals
and in the lot for which the organisation is applying.

Defenders (HRDs) adopted by the EU, Lot 1 of this call for
proposals specifically addresses individual HRDs (i.e.
women Human Rights Defenders and/or Human Rights
Defenders working on women and girls' rights where they
are most at risk). However, these individual HRDs do not
work in total isolation and often operate under the umbrella
of civil society organisations. Strengthening the individual
capacities of HRDS means also reinforcing their
organisations' role/position and capacities.

As per section 2.2.4 of the Guidelines, in the interest of

cannot give a prior opinion on the eligibility of an
applicant, a co-applicant, an affiliated entity, an action or
specific activities.

Our organisation is based in Y, with another


office also in Z, and that is where our
campaigners are also based and conduct the
majority of the work described above,
though much of it involves frequent travel to
areas where natural resources are found and
traded, mainly outside of the EU, as well as
to the countries where companies are based
(US and China). Our due diligence work as
detailed above spreads out along the length
of the supply chains we are trying to change;
from mines in certain countries; to trading
centres in other countries; to other different
countries. For this reason, we think our work
is well aligned with the purpose of this call
for proposals.
As one of the criteria for the eligibility of an
application is that activities take place

simultaneously comprehensive and country specific
approaches proved to be more successful and with bigger
impact on the ground. Inevitably those projects required

happy with our work at present and believe

proposals.

Unfortunately, in the guidelines there is a


requirement for our organisation to work
with a local organisation. This has been an
ongoing issue for us; due to our unique
