Introduccin

El tema de este curso permite inferir que puede considerarse que en el mbito
del derecho penal puede haber una influencia o intervencin de la suerte. La
discusin es si esa suerte puede computarse en los juicios de atribucin de
responsabilidad penal.
Si la suerte juega un rol relevante, la responsabilidad ya no ser
fundamentada, exclusivamente, como dependiente de la conducta del autor
del hecho. Entonces se le imputar algo que no le pertenece, que proviene del
azar. En ese aspecto se castiga a quien es, cuanto menos, parcialmente,
inocente.
Es posible solucionar esta interferencia? Si la respuesta es afirmativa, la
siguiente pregunta es cmo?
Este problema est vinculado, aunque no exclusivamente, con el disvalor de
resultado. Este es un campo de discusin ya clsico en el mbito de la
dogmtica penal continental.
Para responder estas preguntas analizaremos esa respuesta de la teora del
delito, pero tambin distintos sistemas normativos como el de la moral y la
epistemologa para analizar qu respuestas se encuentran all y si ellas
permiten vislumbrar soluciones nuevas en el mbito penal.

Clase 1. La suerte en los sistemas normativos: el concepto de suerte y sus

componentes.
Clase 2. La suerte moral. Suerte y control. Significados de control. El control
en Kant.
Clase 3. Psicologa social. La teora de la atribucin. El anlisis contrafctico,
Control e ilusin de control.
Clase 4. Suerte y epistemologa. Escepticismo, infalibilismo y suerte.
Contextualismo y falibilismo. El principio de sensibilidad. El principio de
seguridad, Derrotadores epistmicos.
Clase 5. Suerte penal. El resultado. La identidad o equivalencia entre tentativa
y consumacin. Subjetivismo alemn. Subjetivismo anglo-americano. Anti
resultatismo

penal).

Subjetivismo

a-causal,

subjetivismo y control.
Clase 6. La tesis de la diferencia punitiva. Responsabilidad moral y diferencia
punitiva. Ventaja injusta y proporcionalidad. Transitividad entre tentativa y
consumacin. Anlisis econmico del derecho y tentativa.
Clase 7. La diferencia como postura intermedia. Responsabilidad frente a la
obligacin. Historial moral frente a valor moral. Identidad y carcter
Clase 8. La postura social a favor de la diferencia entre tentativa y
consumacin, La suerte por los resultados en Adam Smith, Lenguaje y
resultado.

Clase 9. El principio del dao. Relacin del principio del dao con la suerte
penal. Concepciones del principio de dao. El principio de neutralidad.
Resultado e imputacin del resultado. Aplicacin de criterios contrafcticos
(mundos posibles). Conclusiones.

III.

Mtodo de evaluacin

La evaluacin se efectuar mediante la entrega de un trabajo sobre un

fragmento de un texto, a determinar por el docente, el que debern interpretar
y criticar con las herramientas conceptuales obtenidas durante el curso.
