PETITION
PETITIONER, to this Honorable Office most respectfully states:
1. The petitioner, JENNIFER S. CAHULOGAN, Filipino, single, of legal
age, and a resident of Purok 4, Tablon, Cagayan de Oro City,
Philippines;
2. That petitioner is the owner in few simple of the parcel of land,
covered by Transfer Certificate of Title No. T-12208, and more
particularly described as follow:
a. Portion of Lot: 2527, Cad-298, Laguindingan Cadastre
Location: Kurung, Laguindingan, Island of Mindanao
Boundaries: NE., along line 1-2 by Lot 3521, Cad-296
SE., along line 2-3 by Lot 4524-D, Psd-10-022534
SW., along line 3-4 by Lot 3529-E Psd-10-042538
along line4-5 by Lot 3529-H Psd-10-042538
3. Annotated in the said Title is the two (2) year lien covered by Sec.
4, Rule 74 of the Rules of Court which was annotated on
February 5, 2006. That the liabilities imposed under Section 4, Rule
74 of the Rules of Court of the Philippines which appears on page 1
thereof had long expired without anybody having presented any claim
whatsoever against the said properties; and
4. The two (2) year period under Sec. 4, Rule 74 for the filing of claims
against the estate of the decease already lapsed without any claim
having been filed, thus the petitioner desire to have the said lien or
annotation cancelled after payment of the legal fee therefore.
PRAYER
WHEREFORE, premises considered and by virtue of the
provisions of LRA Circular No. 119, petitioner respectfully prays for
the cancellation of the annotation pertaining to Sec. 4, Rule 74 of the
Rules of Court on TCT No. T-12208, without any judicial
pronouncement.
