THIS DEED OF ABSOLUTE SALE IS MADE AND EXECUTED ON THIS THE EIGHTEENTH
DAY OF MAY, YEAR TWO THOUSAND FIFTEEN (18-05-2015)

hereinafter together called and referred to as SELLER (which term unless repugnant
to the context, shall mean and include their successors-in-interest, executors,
administrators, nominees, agents, assigns) OF THE ONE PART
IN FAVOUR OF:-

hereinafter called the "PURCHASER" (which expression wherever it so requires shall


mean and include all their legal successors, representatives, administrators, executors
and assigns etc.,) OF THE OTHER PART:

WHEREAS the SELLER herein represents that the SELLER is the absolute
owner by title and in actual possession and enjoyment of all that Residential Site
bearing No: 60, measuring East to West: 6.00 Meters & North to South: 9.00 Meters in
Vinayaka Enclave carved out from Survey Nos: 321, 322, and 323 having a total
extent of 04 Acres 37 Guntas situated at Belvadi Village, Yelawala Hobli, Mysore Taluk,
morefully described in the Schedule and referred to as Schedule Property hereinafter.
Title of the Property WHEREAS Shree Vinayaka Developers having purchased 04 Acres 37 Guntas
of land in Sy. No: 321, 322 & 323 situated at Belvadi Village, Yelwala Hobli, Mysore
Taluk from its respective vendors formed a residential layout in the name and style of
Vinayaka Enclave after having obtained the approval of Layout Plan from the Mysore
Urban Development Authority vide., No: 70/2014-15 on 07.11.2014 and having
executed Deed of Relinquishment on 31st day of October, 2014 vide MDA-1-013452014-15 and stored in CD No: MDAD52 in favour of Governor, Government of
Karnataka represented by Commissioner of MUDA and developed the layout as per the
specifications subsequent to MUDA having released the Schedule Property vide its
order No: //S/1013/2014-15 dated 01.12.2014.

WHEREAS the SELLER purchased the Schedule Property from his vendors
Shree Vinayaka Developers vide a registered sale deed dated 30.03.2015, registered as
No: MYW-1-11439-2014-15 and stored CD No: MYWD45 on 30.03.2015.
WHEREAS the SELLER had offered to sell and the PURCHASER have agreed to
purchase the Schedule Property for a consideration of 4,00,000/- (Rupees Four Lakh
only) free from all encumbrances.
NOW THIS DEED OF ABSOLUTE SALE WITNESSETH AS FOLLOWS
1. ABSOLUTE SALE:
The SELLER assures the PURCHASER that the SELLER have absolute right to
sell the Schedule Property to the PURCHASER and the SELLER do hereby grant,
transfer, assign and convey the Schedule Property by ABSOLUTE SALE.
2. CONSIDERATION:
The sale consideration of 4,00,000/- (Rupees Four Lakh only) being the full
sale consideration of the Schedule Property is fully paid by the PURCHASER to the
SELLER through cheque bearing No: 069279, dated 01.05.2015 drawn on IDBI Bank,
Jayalakshmipuram Branch, Mysuru. The SELLER hereby acknowledge and confirm
the receipt of the entire sale consideration of 4,00,000/- (Rupees Four Lakh only) as
enumerated above in full satisfaction and final settlement of entire Sale Consideration
towards the sale of the Schedule Property.
3. MARKETABLE TITLE:

That the SELLER assures the PURCHASER that they have got a good and
marketable title over the Schedule Property and thereby have the right to transfer the
same and to give possession. Further, the SELLER assures the PURCHASER that the
Schedule property is free from all encumbrances, lis-pendense, Court attachments,
fraudulent transfer, minor claims etc.
4. TITLE FOR EVER:
That the SELLER grants to the PURCHASER, TO HAVE AND TO HOLD the
Schedule property for the use of the PURCHASER absolutely and forever together with
writings and other evidences of the Title.
5. OUTGOINGS:
That the SELLER assures the PURCHASER that there is no amount due to any
Government or semi Government or other statutory bodies in the form of taxes, rates,
cess, etc., and are duly paid till this date. By oversight if any of the dues payable to the
aforesaid bodies are not paid till this date, the SELLER assures the PURCHASER that
the SELLER will be liable for such payment.
6. DELIVERY OF DOCUMENTS:
That the SELLER have, on this day has delivered all the Documents in respect
of Schedule Property to the PURCHASER. The PURCHASER hereby acknowledges the
receipt of the same.
7. VACANT POSSESSION:
That on this day, the SELLER has delivered the actual physical, peaceful and
vacant possession of the schedule property to the PURCHASER. Hereinafter at all
times the PURCHASER shall be the full and absolute owner thereof and shall
peaceably and quietly hold, possess and enjoy the schedule property without any
interruption, hindrance, claim or demand whatsoever from the SELLER or any
person/s claiming through or under the SELLER.
8. INDEMNITY:
That the SELLER assures to indemnify and to keep indemnified the
PURCHASER against any losses, damages, costs, charges and expenses etc., if any
suffered by any reason or any defect in the title of the SELLER or any breach of any
covenants contained herein.
9. LAWFUL ACTS:
That the SELLER shall at the request and cost of the PURCHASER do or create
or cause to be done or execute all such lawful acts, deeds and things whatsoever
further and more perfectly conveying and assuring the Schedule Property in the
manner aforesaid according to the true intent and meaning of this Deed.
10. KHATA TRANSFER:
The SELLER has got the Khata bearing No. 1210, page No. 03, Book No.19
dated 11.06.2015 transferred in his favour from Mysore Urban Development Authority.

That the SELLER has no objection for the Khata and other revenue records in respect
of the Schedule Property being transferred and registered in the name of the
PURCHASER in the records of the Competent Authorities.
SCHEDULE PROPERTY
All that piece and parcel of portion of property bearing vacant site number 60,
situated at Vinayaka Enclave situated in survey numbers 321, 322 & 323 (total
extent of 04 acres 37 guntas), at Belwadi Village, Yelwala Hobli, Mysuru Taluk,
measuring East to West: 06.00 Meters & North to South: 09.00 meters (54.00
smt) and bounded on the:

In Witnesses whereof both the SELLER and PURCHASER have affixed their Signatures
to this Absolute Sale Deed on the day, month and year first above mentioned after
ascertaining the correctness and fully satisfied with the contents of this Absolute Sale
Deed.
