I have a few concerns.

This is written as if this is a Border Patrol project, and I can’t imagine that OBP would want this to go
out as-is. (b) (6) what are your thoughts?

My only concern is on the first answer. I don’t know what (b) s talking about regarding the ½ mile of
retaining wall. I will find out about that. (6)

Here are some points we believe Mayor Foster may try to make on the O’reilly Show
tonight and the counter to those statements. If you have any questions let me know.
Thanks.

1. The Border Fence proposed for the Del Rio Sector Area is “wall like” in nature and
has the appearance of the border fences in California.

Truth - The Del Rio Sector Border Patrol has requested an aesthetic fence for the
entire project minus the approximate 0.5 miles of retaining wall where fence cannot
be built in the Eagle Pass.

2. The Border Fence is being constructed from the City of Del Rio to the City of Eagle
Pass.

Truth - The Del Rio Sector Border Patrol has requested a little under 2 miles of fence
to be built in the down-town area where illegal entrants are able to abscond into the
city of Eagle Pass before agents are able to respond to make a law enforcement
interdiction. This is a public area and accounts for a significant percentage of our
illegal activity. Del Rio Sector feels it is safer to perform interdictions of illegal
entrants away from the public. Del Rio Sector also proposes approximately 3 miles of
fence to be built in the City of Del Rio

3. Border Patrol has not discussed the matter with the City of Eagle Pass.

Truth - The Del Rio Sector Border Patrol has contacted officials of the City of Eagle
Pass on numerous occasions. The project was formally presented to City Council on
two occasions, the most recent being on June 5, 2007. The City Council members
voiced opposition to any type of fencing on City property. The council denied
requests to negotiate the placement of fencing and tabled the matter.

The Del Rio Sector Border Patrol has contacted all affected Landowners in the PF225
fence project areas in Del Rio, Texas and Eagle Pass, Texas. We have an open line
of communication with these landowners and they are kept up to date of the
progression of the project.

4. The Fence is going to cut through a new residential housing development in Eagle
Pass, Texas.

Truth - The Border Patrol has been in contact with the Landowner that is developing
property along the proposed fence alignment in Eagle Pass, Texas. Both the
developer and the Border Patrol are in agreement that the property on the river side of
where the fence is proposed is river “vega” land that is not suitable for housing
development. The fence alignment as proposed will not interfere the development of
this property for residences.

5. The fence will cut off the water intake, golf course and park from the residents of
Eagle Pass.
Truth - The Del Rio Sector Border Patrol had no intention of taking the City of Eagle
Pass property south of the proposed fence. The Border Patrol proposed to place the
fence above the golf course and park so that the park atmosphere is not interfered
with. The City will be provided with keys to the gates on all their roads and will be
able to shut or open gates as they see fit. The fence will have the appearance of a
security fence surrounding a country club.

6. The proposed fence will cut off industrial parks, buildings and other structures from the
rest of the City of Eagle Pass.

Truth - There are currently no buildings or businesses on the river side of the
proposed fence location. The proposed fence and retaining wall are just above but
near the IBWC flood plain. No buildings or structures may be built below this line.

7. Everyone is against the fence.

Truth – All landowners with the exception of the City of Eagle Pass, that own
property within the proposed fence footprint within Del Rio Sector, including the City
of Del Rio have signed Right of Entry forms and are working with the Government
towards exploring the feasibility of, and construction of border fence.
