The Ministry of Transportation (MTO) has completed its review of the latest submission of the
above noted documents for the subject development site. The proposed development has been
considered and revewed in accordance with the requirements of our highway access policies
and the Public Trcnspoation and Highway lmprcvement Act (PTHIA).
The PTHTA establishes that MTO may issue permits for the purpose of controlling and
regulating buildings, land use, business establishments, encroachments, entrances, plantings,
signs and miscellaneous structures and installations on orwithin MTO's Permit Control Area
(PCA) adjacent to a provincial highway, and that MTO may attach such conditions to these
permits as deemed necessary to protect our highways.
The subject property lies within MTO's PCA, and as such, Building and Land Use Permits and
Sign Permits are required from MTO before any grading/construction commences, the following
outlines our comments and conditions of permit:

MTO has reviewed the subject TIS and accept the conclusions made;

A northbound left turn lane with a 15-m storage and standard taper at the
intersection of Highway 10 and McNab Street. Designed to meet the Geometric
Design Standards for Ontario Highways.

The TIS identifies a need for highway improvements as a result of this development and
therefore the owner shall enter into a Legal Agreement with the MTO whereby the owner
agrees to assume financial responsibility, supported by a Letter of Credit for the
environmental assessment, design, construc{ion and contract administration of the new
street entrance and all necessary associated highway improvements.

SWM

MTO has reviewed the subject report and accepts the report in principle, however the
report must be signed and sealed by a Professional Engineer Licenced in the Province
of Ontario.

Site Plan

The 0.3m reserve is shown on the highway side of the visibility triangle, please revise
this detail to show this 0.3m reserye along the development property side of the
triangles. This 0.3m reserve is required as a separate block in the reference plan.
lf any part of the development (including parking) is integral to the operation of the
business, or must comply with municipal by-laws, such as minimum parking
requirements, fire lanes, drive'through lanes, delivery areas and loading docks, those
parts of the development must be set back a minimum of 14m from the Highway 10
(property) limits, as any future highway widening may result in the loss of these features.
Please confirm that the parking within 14m is surplus.

A portion of the parking facility is directly adjacent (no setback) from the daylighting
triangle that will be deeded to MTO along with a 0.3m reserve along the property limit,
forming the new highway (property) limit as part of the land requirements for the subject
development. The minimum setback for all surplus parking on the lot is 3m from the
widened highway (property) limit.
The pylon sign needs to be setback a minimum of 3m from the widened highway
(property limit. The cunent site plan shows the dimension to the highway (property) limit
prior to the daylighting triangle or 0.3m reserve.

Landscape Plan

The minimum setback for trees, hedges plantings and berms is 0.3m from the highway
(property) limit. Please review drawings and dimension all items shown to ensure the
setback requirements are adhered to.

-3Draft Reference Plan

Per MTO Comments dated July 9, 2015, please submit a draft reference plan for our
review.

All Lots Consolidated

Per MTO Comments dated July 9, 2015, all lots shall be consolidated and merged as
one ownership parcel prior to the issuance of any MTO permits.
