Plaintiff Oakley, Inc. (Oakley) hereby complains of Defendant PR

Trading Company, Inc. d/b/a PR Sunglasses (Defendant) and alleges as

follows:

I. JURISDICTION
1.

This Court has original subject matter jurisdiction over the claims

in this action that relate to patent infringement, trademark infringement, trade

dress infringement, false designation of origin, and federal unfair competition

pursuant to 35 U.S.C. 271 and 281, 28 U.S.C. 1331 and 1338, and 15

U.S.C. 1116(a), 1121(a), and 1125(a), as these claims arise under the laws of

10

the United States. The Court has supplemental jurisdiction over the claims in

11

this Complaint which arise under state law pursuant to 28 U.S.C. 1367(a)

12

because the state law claims are so related to the federal claims that they form

13

part of the same case or controversy and derive from a common nucleus of

14

operative facts.

15

2.

This Court has personal jurisdiction over Defendant because

16

Defendant has a continuous, systematic, and substantial presence within this

17

judicial district including by selling and offering for sale infringing products in

18

this judicial district, and by committing acts of patent infringement in this

19

judicial district, including but not limited to selling infringing eyewear directly

20

to consumers and/or retailers in this district and selling into the stream of

21

commerce knowing such products would be sold in California and this district,

22

which acts form a substantial part of the events or omissions giving rise to

23

Oakleys claim.

COMPLAINT

Case 3:16-cv-01147-AJB-NLS Document 1 Filed 05/12/16 Page 16 of 80

54.

Without Oakleys consent, Defendant uses in commerce marks that

are confusingly similar to the Oakley Marks in connection with the sale,

offering for sale, distribution, or advertising of goods in a manner which is

likely to cause confusion, or to cause mistake, or to deceive.

55.

Oakley is informed and believes, and thereon alleges, that

Defendant did so with the intent to unfairly compete with Oakley, to trade upon

Oakleys reputation and goodwill by causing confusion and mistake among

customers and the public, and to deceive the public into believing that

Defendants products are associated with, sponsored by, originate from, or are

10
11

approved by Oakley, when they are not.

56.

Defendants

activities

constitute

willful

and

intentional

12

infringement of the Oakley Marks in total disregard of Oakleys proprietary

13

rights, and were done despite Defendants knowledge that the use of the Oakley

14

Marks was and is in direct contravention of Oakleys rights.

15

57.

Oakley is informed and believes, and thereon alleges, that

16

Defendant has derived and received, and will continue to derive and receive,

17

gains, profits, and advantages from the use of the Oakley Marks in an amount

18

that is not presently known to Oakley. By reason of Defendants actions,

19

constituting unauthorized use of the Oakley Marks, Oakley has been damaged

20

and is entitled to monetary relief in an amount to be determined at trial.

21

58.

Due to Defendants actions, constituting unauthorized use of the

22

Oakley Marks, Oakley has suffered and continues to suffer great and irreparable

23

injury, for which Oakley has no adequate remedy at law.

59.

Oakley repeats and re-alleges the allegations of paragraphs 1-32 of

this Complaint as if set forth fully herein.

60.

1
2

This is a claim for trade dress infringement under 15 U.S.C.

1125(a).
61.

As a result of the widespread use and display of Oakleys HALF

JACKET Trade Dress, the trade dress has acquired secondary meaning to

potential purchasers, in that potential purchasers have come to associate

sunglasses bearing the design of the HALF JACKET Trade Dress with

Oakley.
62.

Subsequent to Oakleys use and adoption of the HALF JACKET

Trade Dress, Defendant has developed, advertised, and sold sunglasses that use

10

trade dress that is confusingly similar to the HALF JACKET trade dress. For

11

example, the frame of Defendants eyewear model CAMO11 uses trade dress

12

that is confusingly similar to Oakleys HALF JACKET Trade Dress.

63.

13

As a result of the widespread use and display of Oakleys

14

STRAIGHT JACKET Trade Dress, the trade dress has acquired secondary

15

meaning to potential purchasers, in that potential purchasers have come to

16

associate sunglasses bearing the design of the STRAIGHT JACKET Trade

17

Dress with Oakley.

64.

18

Subsequent to Oakleys use and adoption of the STRAIGHT

19

JACKET Trade Dress, Defendant has developed, advertised, and sold

20

sunglasses that use trade dress that is confusingly similar to the STRAIGHT

21

JACKET trade dress. For example, the stems of Defendants eyewear model

22

CAMO11 uses trade dress that is confusingly similar to Oakleys STRAIGHT

23

JACKET Trade Dress.

65.

24

Upon information and belief, Defendants acts of trade dress

25

infringement were undertaken willfully with full knowledge and with the

26

express intent to cause confusion, and to mislead and deceive the purchasing

27

public.
