its regulations for Parts B and C of the law. All States were required to create a special
education state performance plan (SPP) identifying those areas that any particular
state needed to address with regard to federal special education compliance. When
the state identifies noncompliance, it must provide notification to the local district.
Tri County Area School district received notification of noncompliance on April
15, 2009 in (2) areas: State Performance Plan Indicator B11: Child Find as well as State
Performance Plan Indicator B12: Early Childhood Transition. The noncompliance
determination was based on Tri County Area School district’s 2007-2008 data
submission in the Single Record Student Database, one of Michigan’s student data
tracking systems. It is important to understand that all local school districts in our
county were found to have similar compliance issues, as well as many other local
districts across the state.
Upon receiving the notification of noncompliance, Tri County Area Schools
took immediate action. Our special education staff participated in meetings to gain
a better understanding of those components of our noncompliance. The district also
made the decision to centralize data submission into the state data system in an effort
to decrease possible data submission errors. Through much hard work from all of
our special education staff, building secretaries, and Sherry Wheeler at the central
office, the State has verified as of April 14, 2010 that Tri County Area School district
completed its corrective action plan activities for our areas of noncompliance and is Back row (l to r): Nina Bohm, Darcy Engelman, Dana Ballivian, Coach Brianna Ebenstein, Valeriya

after a car accident in January.
The school held an assembly on March 25,
honoring Kim and letting her know how much she

The accident happened on January 26 as she

conditions caused her vehicle to leave the road,
trapping her inside.
Kim has made great strides in regaining her
