AFFIDAVIT
I, MARY ANN NACINO, Filipino, of legal age, and with an office address at
303-304 Taft Office Center 1986 Taft Avenue Street, Pasay City, Philippines. After
having been duly sworn to in accordance with the law, hereby depose and say:
1. That I am currently employed at Landbase Human Resource Company;
2. That on 04 March 2015, Joanna Nacino and I went to Qatar to meet Dr.
Faissal for purposes of finding out the truth regarding the allegations made by Mr.
Benjamin Magracia;
3. That for that purpose, we met some of the Filipino co-workers of Mr.
Benjamin Magracia;
4. That they disagreed with the allegations made by Mr. Benjamin
Magracia, in fact, none of the Filipino workers who stayed in the same
accommodation raised such issue and all the allegations mentioned were all
untrue;
5. That according to Engr. Fabellore, to wit: Hindi naman ganon ka worst,
ok naman ang accommodation;
6. That we had a meeting with Dr. Faissal and Engr. Fabellore regarding
Mr. Benjamin Magracias allegation on the issue of termination;
7. That contrary to Mr. Magracias allegation, Engr. Fabellore said that Mr.
Magracia was not terminated;
8. That the final alarms sent to him were just considered warning letters;
9. That his employer was giving him a chance to go back to work and
correct his mistake, nonetheless, he failed to submit any response concerning
the letters sent to him;
10. That there was NO termination happened with regard to Mr. Benjamine
Magracias employment and there was NO termination letter sent to him either;

11. That according to Engr. Fabellore, since Mr. Benajmin Magracia


stopped coming back to work, he also stopped repoorting to their respective
accommodation;
12. That Engr. Fabellore believed Mr. Benjamin Magracia had a friend in
Qatar where he is staying;
13. That according to some of his Filipino co-workers, with that kind of
situation, it clearly showed that Mr. Benjamin Magracia just run away;
14. That I even recommended to Dr. Faissal the case be submitted for
repatriation since he was no longer working under them, but averred that he
cannot do anything about it since the case was already reported to the CIDG;
15. That on the same day, we went straight to Philippine Consulate to
meet the Welfare Officer who was in charged of Mr. Magracias case;
16. That according to the Welfare Officer, when the case was submitted to
him, he immediately called Mr. Benjamin Magracia and inform the case about
him;
17. The Welfare Officer also advised Mr. Benjamin Magracia to meet-up
with his employer to consider any amicable settlement about his case;
18. Also, according to the Welfare Officer, he also visited the office of Dr.
Faissal to gather informations regarding the run-away case of Mr. Benjamine
Magracia;
19. That the Welfare Officer informed us, while Mr. Benjamin Magracia was
not reporting to work, he was doing part-time jobs in Qatar;
20. That before we leave, we accompanied Mr. Magracia to the Philippine
Embassy to submit his endorsement letter for his repatriation;
21. That upon leaving, we gave Mr. Benjamin Magracia some cash
assistance.
