You have started a home office and you would like to
take a tax deduction for doing so. There’s just one little
problem-you don’t know how. Here is some information
to assist you with that task.
Home offices do not have to be actual offices. They
can also be a garage where you do mechanical repairs or a
greenhouse where you grow plants or flowers to sell. In
order to claim your home office, you must prove you use
it for the convenience of your employer, spend most of
your working hours there and receive most of your
taxable income from activities in that office. You should
keep a log of the time you spend working in your home
office as well as tax records of your activities in it.
In order to determine what to take as a deduction,
you should divide the square footage of your home office
by the total square footage of your home. Once you have
that percentage, you can figure what part of the utilities,
repairs, security, furniture and such you can deduct.
You must distinguish direct, indirect and unrelated
expenses. A direct expense relates directly to your home
office use and is fully deductible, depending upon the
deduction limits set by your business’ income and loss.
Your deductions can’t exceed the income you get from
using your home office. An indirect expense like utilities
or insurance is based on the percentage of your home used
for business. If you use 15% of your home for business,
you can only deduct 15% of your utilities. Unrelated
expenses such as landscaping can’t be deducted even if
they make your home office look better.
You are limited as to what you can deduct. If you
own your home, for example, you can claim depreciation.
If you have special coverage on your home office
equipment, you can claim that as a direct expense. If the
part of your home used for an office is ever damaged, you
can claim that as a direct expense and deduct the entire
loss. If you install a security system, you can deduct part
of it based on the percentage used for your home office.
Cleaning services, utilities and garbage removal are
considered personal expenses. The only time you can
deduct these expenses is if you meet the criteria for a
home office. If you have a higher electrical bill due to
your home office, you can claim that amount as a direct
expense.
Among other items you can claim as a partial
deduction are property taxes, moving expenses, condo
leases and phone bills. You can claim part of your phone
bills if you have a second line used entirely for business
purposes or if you make long-distance calls you wouldn’t
normally make on your home phone line.
When considering a tax deduction for your home
office, make sure you figure everything correctly. If there
is any doubt as to whether something qualifies, consult a
professional.
Uh-Oh, You’ve Been Audited

Don’t panic. You may just need to correct an error in
your return or provide further information. Read the letter
the Internal Revenue Service (IRS) has sent you and go
from there.
There are three types of audits: a correspondence
audit, a field audit and an office audit. Correspondence
audits typically apply to small mistakes and are handled
by mail. Field and office audits apply to larger issues and
are handled in person. In a field audit, an auditor comes to
your place of business or your home and inspects your
return. In an office audit, you must go to an IRS office on
a specific date and time and bring whatever documents
have been requested.
Field and office audits are the most serious. For
either of these, you may want to consider hiring a tax
professional. Tax attorneys, certified public accountants
and enrolled agents are all qualified to represent you in an
IRS audit. Accredited tax advisors and preparers may
represent you only if the audit pertains to a return on
which they signed as the preparer. Once the meeting
begins, follow the lead of the tax professional. Be polite,
but don’t provide any more information than necessary.
Admit any mistakes you may have made and retrieve all
of your original documents.
As soon as the auditor has finished their inspection,
they will provide you with their findings and the outcome.
You may be asked to pay further taxes, be subject to fines,
or be criminally charged with a crime. Should you agree
with the auditor’s findings, do what is asked of you and
the matter will be resolved. Should you disagree, say so
and the auditor will be present you with the options for
reaching a satisfactory conclusion to your case.
Every year, the IRS randomly selects 50,000 tax
returns across the board to review. With over 140 million
tax returns filed each year, the chance of you getting into
this group is slim. You are more likely to be subject to an
audit if you raise some sort of red flag, such as having
your own business or taking a very large deduction.
Should you get audited, do not freak out. Read the letter,
follow the instructions and hire a tax professional to assist
you in the matter.

extends the deadline for qualifying home purchases from
Nov. 30, 2009, to April 30, 2010. Additionally, if a buyer
enters into a binding contract by April 30, 2010, the buyer
has until June 30, 2010, to settle on the purchase.
The maximum credit amount remains at $8,000 for a
first-time homebuyer –– that is, a buyer who has not
owned a primary residence during the three years up to
the date of purchase. But the new law also provides a
“long-time resident” credit of up to $6,500 to others who
do not qualify as “first-time homebuyers.” To qualify this
way, a buyer must have owned and used the same home
as a principal or primary residence for at least five
consecutive years of the eight-year period ending on the
date of purchase of a new home as a primary residence.
For all qualifying purchases in 2010, taxpayers have
the option of claiming the credit on either their 2009 or
2010 tax returns. A new version of Form 5405, First-
Time Homebuyer Credit, will be available in the next few
weeks. A taxpayer who purchases a home after Nov. 6
must use this new version of the form to claim the credit.
Likewise, taxpayers claiming the credit on their 2009
returns, no matter when the house was purchased, must
also use the new version of Form 5405. Taxpayers who
claim the credit on their 2009 tax return will not be able to
file electronically but instead will need to file a paper
return.
The new law raises the income limits for people who
purchase homes after Nov. 6. For homes purchased prior
to Nov. 7, 2009, existing income limits remain in place.
