All India Bar Association (AIBA) expresses shock and strongly


condemns, the recent incidents in Madras High Court where the
judicial functioning of Honble Chief Justice Sanjay Kishan Kaul was
sought to be undermined by fringe elements within the legal
fraternity.
On September 14, 2015 (Monday), a group of lawyers,
accompanied outside elements dressed in plainclothes, used a child
as a human shield and entered the court hall of Chief Justice Sanjay

Kishan Kaul and Justice T.S. Sivagnanam carrying placards,


banners and black flags. They demanded immediate declaration of
Tamil as official language of the high court. The Honble judges tried
their best to reason out to them that it is not the forum to take such
decisions, but their counsel went unheeded.
The group stayed put inside the court hall chatting among
themselves and even eating food items while the judges were
hearing the case. It is height of disrespect shown to the highest
judicial seat in the state of Tamil Nadu and Chief Justice is no less
important in authority than the states Governor and Chief Minister.
Still, Tamil Nadu police not only failed to stop advocates
unconnected with cases pending in the first court, non-advocates
and the child to enter the court hall, it also failed to evict them. It is
clear dereliction of duty.

The Honble first bench rightly initiated suo motu proceedings and
ordered that the courts principal seat in Chennai and bench in
Madurai were brought under Central Industrial Security Forces
security domain. Being specialized agency, CISF will enhance the
security quotient of the high court to a great extent.

As if the Monday incident was not enough, on September 16, 2015


(Wednesday) a large number of lawyers from Madurai came to the
principal seat in Chennai and held the entire court to ransom,
according to media reports that are confirmed by photographs and
video footages. This incident also lasted for a whole day, and
severely challenged and undermined the authority of Honble Chief
Justice Sanjay Kishan Kaul.
All India Bar Association has always fought for independence of
judiciary and it reiterates its stand that there should not be any form
of threat to the judiciary, including threat from within. Lawyers
becoming a threat to judicial independence is the worst crisis a court
could confront. The unfortunate situation has arisen in Honble
Madras High Court, which is a chartered high court and has enjoyed
great reputation. AIBA resolves that such incidents should be
nipped in the bud.
With this purpose in mind, AIBA calls upon authorities concerned to
take following measures.
1.
The Centre and its Union Ministry of Home Affairs should not
waste even a single day in acceding to the Honble High Courts
judicial order handing over its security to the CISF. Necessary
orders must be passed immediately, so that state governments

understand the gravity of the challenge posed by forces inimical to


judicial supremacy.
2. The Bar Council of Tamil Nadu and Puducherry should initiate
suo motu proceedings and debar the elements responsible for the
ruckus on September 14 and 16 on Honble High Court campus. By
now it should have identified persons leading the illegal agitation
and those participating in it, and should have acted against them.
The Councils failure could lead to more serious threats to judicial
independence. Therefore, AIBA demands Bar Council of India (BCI)
to take suo motu note of the developments, and immediately initiate
suo motu proceedings and debar advocates who unleashed threat
and intimidation to the institution which is feeding them.

3. Tamil Nadu police ought to have controlled the illegal acts but
they failed to discharge their duty. We demand the Govt. of Tamil
Nadu to give proper protection to the Madras High Court till security
arrangements are taken over by CISF.
4. AIBA assures Honble Chief Justice Sanjay Kishan Kaul and his
puisne judges that it would stand by them at all times, and would not
hesitate to come to their defence should any more such unfortunate
situation arises.
