Indeed all praise is due to Allaah; we praise Him and seek His aid and
forgiveness. And we seek refuge with Allaah from the evils of ourselves and
from the evil of our actions. Whosoever Allaah guides, there is no misguidance
for him. And whosoever Allaah leads astray, there is no guidance for him. And
I testify that there is nothing worthy of worship except Allaah and that
Muhammad is His servant and Messenger.

“O you who believe! Fear Allaah as He should be feared, and do not die
except in a state of Islaam.”

“O Mankind! Fear your Lord who has created you from a single soul and
from him created his spouse, and from them He created many men and
women. Fear Allaah through Whom you demand your mutual rights and
do not cut the ties of kinship, for surely Allaah is ever an All Watcher
over you!”

“O you who believe! Fear Allaah and say truthful speech, He will direct
you to righteous deeds and forgive your sins. And whosoever obeys
Allaah and His Messenger, he has indeed achieved a great
achievement.”

Indeed the best of speech is the Book of Allaah and the best of guidance is the
guidance of Muhammad. And the worst of affairs are newly invented matters,
and every newly invented matter is an innovation and every innovation is a
misguidance and every misguidance is in the hellfire.

I ask Allaah, The Most Beneficent and Most Merciful, that He guides us in
understanding this religion which He has revealed to His Servants. I ask Allaah
that He has Mercy upon the Readers of this short treatise and that He protects
us and you from falling into the traps of Shaytaan. With Allaah is the source of
All guidance and strength.

The treatise which is before you is intended to explain to you the methodology
of a Muslim concerning the Legislations of Al-Islaam. We ask Allaah to make
us firm upon the legislation of Islaam with the understanding of the Best of
Mankind.

O Noble reader, May Allaah have mercy upon you, Allaah, the Most Majestic,
has indeed revealed to us the Qur'aan and has sent His Prophet (  ‫ ا‬
‫ )وﺱ‬to explain it to us.

Islaam is a religion of 'Adl (Justice), it is a religion of Rahmah (Mercy) and it is


a religion which is clear as the Messenger of Allaah (‫ ) ا  وﺱ‬said:

I left you upon a clear white path, its night is like its day, no one deviates
from it except one who is destroyed.

(Sunan Ibn Maajah (no. 43 "Ittibaa' Sunnatul Khulaafaa ar-Raashideen al-


Mahdiyyeen)

As Muslims it is upon us that we be Just in all of our affairs as Allaah tells us:

“Be Just! That is closer to Taqwa” (Surah Maa'idah: 8)

So O Noble Reader, May Allaah guide you to the Haqq, before you is a humble
attempt in mentioning a few words with regards to the methodology of a
Muslim in his affair (Islaam).

So to proceed:

O Noble Reader, May Allaah reward you, we are asked the following question:

"As a Muslim, what are your sources of Legislation?"

The correct response to this is: "The Qur'aan and Sunnah"

The Sources of Legislation in Islaam

The Qur'aan:

The Proof that the Qur'aan is from the sources of legislation is the statement of
Allaah:

“This is the Book (the Qur'ân), whereof there is no doubt, a guidance to
those who are Al-Muttaqûn [the pious and righteous persons who fear
Allâh much (abstain from all kinds of sins and evil deeds which He has
forbidden) and love Allâh much (perform all kinds of good deeds which
He has ordained)].” (Al-Baqarah: 2)

“The month of Ramadân in which was revealed the Qur'ân, a guidance
for mankind and clear proofs for the guidance and the criterion (between
right and wrong).” (Al-Baqarah: 185)

And

“We have revealed to you the Reminder (the Qur’aan) so that you (O
Muhammad) may explain to the people what was revealed to them.”
(Surah an-Nahl: 44)

The 'Ulemaa of Tafseer have said that the word "Dhikr" in this Ayah refers to
the Qur'aan.

Ibn Katheer said in the Tafseer of this Ayah:

"And we have revealed to you the Reminder"

(“The Reminder”) means the Qur'aan

So the one who denies that the Qur'aan is one of the sources of legislation has
denied these verses and thus left the fold of Islaam, due to the denial of these
verses and believing that the Qur'aan is not a source of legislation.

So O Noble Reader, may Allaah have mercy upon you, so with consensus of
this Ummah, the Qur'aan is from the legislation (Sharee'ah) which the Muslim
bases his beliefs, actions, behavior and all of his life upon.

The Sunnah

The proof that the Sunnah is from the sources of legislation is the statement of
Allaah:

“He who obeys the Messenger, has indeed obeyed Allah, but he who
turns away, then we have not sent you (O Muhammad) as a watcher over
them.” (Surah an-Nisaa: 80)

Ibn Katheer said with regards to the explanation of this Verse:

(The Most High informs (us) about His servant and Messenger Muhammad;
that whoever obeys him, obeys Allaah; and whoever disobeys him, disobeys
Allaah. And this is not the case except for the fact that (the Messenger) speaks
not of his own desire, (Rather) it is only revelation inspired to him.)

Another proof that the Sunnah is from the legislation from the statements of
Messenger of Allaah (>(. (+  Z([):

Surely I have been given the Qur’aan and that which is like it1.

(Imaam al-Albaanee recorded this from at-Tirmidhee in "Manzilat asSunnah fil


Islaam")

Amongst the many ahaadeeth that prove that the Sunnah is a source of
legislation is this hadeeth which clearly states that the Qur'aan and Sunnah are
equal in their legislation. So the one who denies this and says: "We take what we
find in the Qur'aan and give it precedence over the Sunnah" is one who has erred in his
statement and placed a lie upon the Prophet (‫ ) ا  وﺱ‬and has rejected
this Hadeeth.

Allah says,

“And whatsoever the Messenger (Muhammad) gives you, take it, and
whatsoever he forbids you, abstain (from it).” (Al-Hashr:7)

O Noble Reader, May Allaah protect us and you, we must be careful in our
statements concerning the Sunnah of our beloved Messenger
(‫) ا  وﺱ‬. Allah out of His Mercy has sent to mankind Messengers and
revealed to them books so that mankind may be guided to that which He
(Allah) loves and is pleased with. It is in mankinds, and in particular the
Muslims best interest to concern themselves with that which Allah has
revealed, following its guidance and adorning their lives with its teachings. The
Qur’aan and Sunnah have been revealed to us from our Lord The Most High,
as the Messenger (‫ ) ا  وﺱ‬has informed us in his statement,

Surely I have been given the Qur’aan and that which is like it (i.e. the
Sunnah).

O Noble Reader, May Allaah bless us and you to be from those who follow
that which he has been revealed and implement His The Most High’s
command in His statement,

” (Say to them O Muhammad) Follow what has been sent down unto
you from your Lord (the Qur'aan and the Sunnah), and follow not any
Auliyâ' (protectors and helpers, etc. who order you to associate partners
in worship with Allah), besides Him (Allah). Little do you remember!”
(Al-A'raf: 3)
