ESTABLISHMENT
OF
A
TEACHERS
EDUCATION COLLEGE IN WEST BENGAL

We first need to understand and identify what is a teachers training institute and the
courses that are offered.
A teachers training institute imparts training to future teachers and educationists. A
teacher can be either an elementary school teacher or a secondary and higher
secondary school teacher. Like their future students are categorized into different
standards/classes depending on their age and are promoted to higher standards with
further learning, teachers are also trained depending on the students they will teach in
future.

Categories of Courses in Teachers Education

It is the degree or programme which determines whether the teacher is qualified


to teach elementary level students or secondary level students.

Elementary Teacher Education courses are PTTC, TTC, PTT, E.T.E and D.Ed.
In West Bengal, the affiliating body is either the West Bengal Board of Primary
Education or state universities.
Secondary Teacher Education programmes fall into two categories B.Ed. and
B.P.Ed. These are offered by the Teacher Training Colleges affiliated to
universities.

M.Ed. and M.P.Ed. programmes in West Bengal are also offered by the Teacher
Training Colleges affiliated to universities.
The highest requirement for setting up and running a teachers training institute is to
receive recognition from the National Council for Teacher Education (NCTE)

which is a statutory body incorporated under the National Council for Teacher
Education Act, 1993.
It is NCTE which regulates the Teachers Education in India by its Rules and
Regulations published from time to time. The administrative governance in the
secondary teacher education institutions of West Bengal is controlled by the norms
and standards set by NCTE and the rules and policies directed by the Government of
West Bengal.

Eligibility to provide teachers education/training


The following categories of institutions are eligible to provide Teachers
Training:
-

Institutions established by or under the authority of Central/State


Government and Union Territories

Government financed Institutions

Departments of Universities where the university or deemed university is


recognized by the UGC

Self-financed private colleges established and operated by not for profit


societies/trusts/companies incorporated and registered under the appropriate
law.

However, before either of the aforesaid institution can receive the recognition from
NCTE, it has to fulfill various other pre-requisites which are discussed hereinbelow.

a)

Pre-Requisites for Establishing a Teachers Training Institute

Formation of Body Corporate: A Society duly registered under the Societies


Registration Act, 1860 or a Trust duly registered under the Indian Trust Act,
1882 or a Company duly registered under the Companies Act, 2013 or a

Minority Institution, whether based on religion or language, has to be formed


for the purposes of running the college/Institution.
b)

Land and Building for the College:


(i)

Land has to be selected by the Institution for constructing the building or


else a suitable building has to be identified for running the Institution out
of such building.

(ii)

The NCTE has specific norms for land and building for a teachers
training college/institute depending on the degree of education offered.

(iii) The land must be either self-owned or a demised land obtained by way
of a long term lease or assignment from the Government of West Bengal.
(iv) The NCTE has norms and standards prescribing the minimum built up
area and the minimum land area for running the institution which has to
be complied with.
(v)

The land and the building must be recorded in government records for
educational or institutional usage as per the rules of the Municipal
Corporation, Municipality, Gram Panchayat or Development Authority
having jurisdiction over the area. If the land and/or the building is
recorded for any other purposes, then a conversion or permission has to
be

obtained

from

the

Land

Office/Municipality/Municipal Corporation, as the case may be, for


using the land and building for running of a Institution.
(vi) The land and the building must be mutated in the name of the body
corporate which has set up the Institution.
(vii) The sanctioned plan and completion certificate/occupancy certificate as
issued by the Municipal Corporation, Municipality, Gram Panchayat or
Development Authority in respect of the building must be available.
(viii) A Report on Title has to be obtained through an advocate after having
conducted the required due diligence certifying that the land and
building is free from encumbrances and having a valid and marketable
title.

Affiliation: The new Institution has to obtain an affiliation from the


University having jurisdiction over the area in which the private Institution is
established. Such affiliation has to be renewed from time to time (as per the
Universitys requirements) and the University may also conduct inspection of
the institution before renewing such affiliation.

d)

Submission of Application: The applicant Institution has to submit an


application containing the proposal and copies of a Detailed Project Report
along with a non-refundable fee before the Higher Education Department,
Government of West Bengal. The Detailed Project Report should comprise of
the following particulars:
(i)

Name and address of the applicant (a person or a Society or a Trust or a


Company);

(ii)

Evidence of registration in case of Society, Trust or Company: (aa)


Whether the society is registered under the Societies Registration Act,
1860 or the Trust is duly registered under the Indian Trusts Act, 1882 or
the Company is duly registered under the Companies Act (bb)
Registration Number (cc) Date of Registration (dd) Place of Registration
(Copy of Registration of Society / Trust / Company along with details of
constitution, memorandum of association of the Society / Trust/
Company to be attached)

(iii) Details of financial resources of the applicant for the last five years;
(iv) The name and location of the proposed Self-financing Under Graduate
Degree College;
(v)

Aims and objectives of the proposed Self-financing Under Graduate


Degree College;

(vi) Details of land (name of Mouza, P.S., J. L. No., Khatian No., Plot No.,
Area, classification of land etc. or Premises No., Ward No. P.S.,
Borough No. as the case may be);

(vii) Details of plan for campus development such as construction of


buildings, development of structural amenities and infrastructural
facilities to be undertaken before the Institution starts functioning;
(viii) Blue-print for campus development programme to be undertaken during
first five years in phased manner after commencement of functioning of
the private university college and phased outlays of capital expenditure
and sources of finance for those five years;
(ix) The nature and type of courses of study which are proposed to be
undertaken by the college and their relevance to the development goal
and employment needs of the State and course-wise enrolment target;
(x)

The experience and expertise in the concerned disciplines at the


command of the applicant;

(xi) The scheme for mobilizing resources internally and externally;


(xii) Details of proposed fee structure along with proposal of fee concession /
fee exemption for the poor and physically handicapped students;
(xiii) Details of Endowment Fund;
(xiv) Admission procedure to be followed for students to different courses of
the proposed college;
(xv) Procedure to be followed for appointment of permanent Faculty having
requisite educational and professional qualifications as per UGC norms
for the proposed college;
(xvi) Procedure to be followed for appointment of officials having requisite
educational and professional qualification as well as non-teaching staff
for the proposed college;
(xvii)Special activities and /or skill development activities that the college
wants to run in response to local necessity;
(xviii) Details of playground, auditorium and other facilities available or
proposed to be created for games, sports, culture and extracurricular
activities;
(xix) Perspective programme / arrangement for academic auditing;

On-Site Inspection: The Higher Education Council of West Bengal conducts


an on-site inspection through its inspection team prior to issuing its
consent/no-objection certificate for establishment of the college/institution.

f)

Setting up of Infrastructure Facilities: The applicant institution has to


satisfy the State Government in terms of infrastructure, in the following
manner:
(i)

Establishment of the endowment fund;

(ii)

Deed of ownership or settlement of land in favour of the proposed


college (even if the college is in the name of the society/trust/company
governing it, ultimately it has to be transferred in the name of the
college this is also a requirement under NCTE Regulations);

(iii)

Construction of the minimum built-up area for carrying on


administrative and academic functions at the beginning;

(iv)

Availability of books and journals as per the norms of NCTE or at least


Rs. 5,00,000/- whichever is higher and submit an affidavit on a nonjudicial stamp paper of Rs.10/- to invest within first five years not less
than Rs.10, 00,000/- or as per the norms of NCTE, whichever is higher
on books, journals, computers, library networking and other facilities
in the library;

(v)

Availability

of

equipments,

computers,

furniture

and

other

infrastructural facilities other than building worth Rs. 10,00,000/- or as


per the norms of NCTE, whichever is higher and submit an affidavit on
a non-judicial stamp paper of Rs.10/- to invest within first five years
not less than Rs.25,00,000/- or as per the norms of NCTE, whichever is
higher on equipments, computers, furniture and other infrastructural
facilities other than building;
(vi)

Furnishing of an affidavit on a non-judicial stamp paper of Rs.10/- to


the effect that the proposed college shall observe the provisions of the
Act, Rules, Statutes, Ordinances and Regulations of the State
Government, affiliating University and NCTE and UGC (if applicable)

in the matter of appointment of Principal and full time teachers of the


college, their pay and allowances, provident fund and other welfare
programmes etc.;
(vii)

Furnishing of an affidavit on a non-judicial stamp paper of Rs.10/- for


observing all other conditions as may be prescribed by the Act, Rules,
Statutes, Ordinances and Regulations of the State Government,
affiliating University and NCTE and UGC (if applicable) or any other
regulatory body as may be amended from time to time;

g)

No-Objection Certificate: On being satisfied about compliance of all terms


and conditions, the State Government calls upon the applicant to pledge a
security fund, by way of a fixed deposit to be kept as security deposit in a
nationalized bank. This is primarily to ensure that the college/institution
complies with all laws, rules and regulations of the State Government and
NCTE as issued from time to time for running of the institution. Thereafter,
after being satisfied in all respects, State Government issues a No-Objection
Certificate.

Note:

The Government of West Bengal has a category of reservation for


SC/ST/Physically Handicapped students, for students from home university vis-vis outside universities and also for in-service untrained teachers.

The maximum admission fees for B.Ed./B.P.Ed./M.Ed./M.P.Ed. has been


capped through a government regulation.

Application to Regional Committees of NCTE

After receipt of the No-Objection Certificate from the West Bengal


Government, the applicant college/institution has to apply to the NCTE in the
prescribed form, the proforma whereof is annexed to the National Council for
Teachers Education (Recognition Norms and Procedure) Regulations, 2014,
along with affidavits and other annexures (most of which are those which are

submitted before the State Government). The Norms and Standards for the
education programme are also set by NCTE. NCTE also requires that an
Endowment Fund and a Reserve Fund be created by the college/institution. It is
pertinent to note that UGC Regulations are also to be followed for appointment
of academic faculty.

NCTE has four regional committees at Bangalore, Bhopal, Bhubaneswar and


Jaipur to look after its statutory responsibilities. Each Regional Committee is
headed by a Regional Director.
Teachers Training Institutions in West Bengal are under the jurisdiction of the
Eastern Regional Committee at Bhubaneswar. Every Institution seeking to offer
a course or training in teachers education has to make an application in the
prescribed form before the Regional Committee of NCTE.

The NCTE being a central statutory body, its regulations and requirements are
same pan India. However, some regulations are highlighted below for better
understanding.
Regulation 5 of the National Council for Teachers Education (Recognition
Norms and Procedure) Regulations, 2014 also prescribes a timeline by which an
application is to be filed for a particular academic session.

The Regulation of 2014 also makes it mandatory that new colleges/institutions


be located in composite institutions and not as stand-alone institutions.

At the first instance, the NCTE issues a letter of intent intimating the
college/institution about NCTEs decision to grant recognition to the
college/institution. Subsequently, after NCTE is satisfied that all requirements in
terms of building, educational infrastructure, academic faculty, university

affiliation et al, an order granting recognition to the college/institution is granted


by NCTE.

We understand you have a query as regards the timeline required for the approval
from the Government of West Bengal. However, it is not feasible to pre-estimate the
same as it involves various levels of the Government department which take their own
time to process applications. As per NCTE Regulations, ideally the Higher Education
Council should process the application of a college within 75 days from receipt.
