COMPLAINT-AFFIDAVIT
I, VIRGIN MARGARITA, of legal age, Filipino and with postal
address at 88 Lagusang Diretso St., FB Subdivision, Sto. Domingo,
Angeles City after having been duly sworn to in accordance with
law do hereby depose and state:
1. Respondent JASON IVE HEARD is a resident of 1234 Biglang Liko
St., Victoria Village, Pampang, Angeles City, where he may be
served with summons and other legal processes.
2. That on 20 May 2015, respondent JASON IVE HEARD texted me
and offered me the sum of Philippine Currency: FIFTY THOUSAND
PESOS (PhP 50,000.00) to engage in a sexual intercourse.
3. That I due to the financial difficulty I was facing, I was inclined to
accept the offer of respondent JASON IVE HEARD.
4. That on 22 May 2015, respondent JASON IVE HEARD gave me a
postdated check dated 12 June 2015, in the amount of Philippine
Currency: Forty Five Pesos (PhP 45,000.00) and Cash in the
amount of Philippine Currency: Five Thousand Pesos (PhP
5,000.00).
5. That the respondent JASON IVE HEARD, told me that the check
was good as cash and the scheduled date of pursuing the sexual
intercourse is on 11 June 2015.
6. That on 11 June 2015, the respondent JASON IVE HEARD and I
proceeded with the proposed sexual intercourse in his house at
1234 Biglang Liko St., Victoria Village, Pampang, Angeles City.
7. That during the foregoing date, before proceeding to have sexual
intercourse with the respondent JASON IVE HEARD, I asked him
the second time if the check has sufficient balance to cover the
abovementioned amount because I have already paid the check
to Angeles University Foundation as payment for my tuition fee
this school year 2015.
8. That respondent JASON IVE HEARD, assured me that his account
can cover the abovementioned amount. Based on his assurance, I
acceded to his every will during the sexual intercourse.

9. That on 17 June 2015, Angeles University Foundation sent me a

letter through the Office of the Student Affairs and Financial Aid
stating that the check I used to pay my tuition fee bounced due to
insufficient funds.

That after the foregoing incident, I tried contacting
respondent JASON IVE HEARD to confront him about the check but
despite due diligent effort, I was not able to contact him or
ascertain his whereabouts to confront him personally.
11.
That based on the foregoing incident, I have reason to
believe that respondent JASON IVE HEARD has no intention in
fulfilling his end of the bargain.
12.
I am executing this affidavit to attest to the truth of the
foregoing averments and for the purpose of criminally prosecuting
said respondent for Rape by means of fraudulent machination or
grave abuse of authority under Article 266-A of the Revised Penal
Code as Amended.
