WhatisPatta?
Pattaisbasicallyarevenuerecord.Itisanextractissued
fromtheRegisterofLandholdingsmaintained,usuallyat
theofficeoftheTahsildar.Thisisissuedinthenameofthe
person or persons in whose name the records relating to
theholdingsaremaintained.

Patta:Alegaldocument
Pattaisaninstrumentshowcasingpossessionofproperty.Rightstopropertymayariseinthreeways:
(i)ThroughvoluntaryactofpartiesThetransactionswhichfallwithinthisclassificationarethosecoveredbythe
TransferofPropertyAct.
(ii)InheritanceorbequestLawsrelatingtosuccessioncoversthistypeofrightsofproperties.
(iii)Byordersofcourts,tribunals,Stateaction,etc.
Similarly, there are three levels of documents supporting claims to the title title documents, approvals or other
municipalrecordsandrevenuerecords.Dependingonthenatureofthepropertyandthenatureofitspossession,
Pattacanbeobtainedinrespectoftheabovementionedthreetransactions.

WhyisitimportanttohaveaPatta?
TheissuanceofPattasignifiesthatyouhavelawfulpossessionovertheproperty.Itisissuedinthename
ofownerorinthecaseofjointholdings,inthenamesofthejointowners.
IfthereisanyproblemortitleconflictwiththeGovernmentoranythirdpersonregardingtheland,thenthe
Pattacanbegivenasusefulevidence.
Even if the Government wishes to acquire land, it has
topaycompensationtothePattaholder,sincethePatta
holderhasthefirstrighttotitleoverthatproperty.
Ifthereisanysaleoftheproperty,thePattawillbethe
maindeterminantoftheownershipoftheproperty.

Whatistheprocedureforobtaining
Patta?
YouhavetoapplytotheTahsildarintheformofasimplerequisitiontoissuethePatta
Alongwithit,youhavetoprovidenecessarydetailsanddocumentsrelatedtotheproperty
The concerned officer may hold an enquiry or conduct a survey of the land/property before granting the
Patta.

IsitmandatorytohaveaPattaforeveryproperty?
Incaseofvacantplotsofland,Pattaisamust,asitisthemaindocumentforestablishinglawfulpossession.Evenin
caseofpropertieswithbuildingsandstructures,Pattaistheprimarydocumenttoestablishlawfulpossession.Italso
includesothervitaldetailsincludingtheextentofholdingsandthemeasurementsoftheproperty.

IsPattarequiredforapartmentowners?
Pattaisprimarilyadocumentrelatingtolandandnotbuildings.However,thePattamayincludeparticularsrelating
tothebuildings.Incaseofapartments,thelandisusuallyownedbythecoownersinundividedsharesandPattais
not issued for undivided shares of land. However, it may be possible to get the Patta in the names of all the co
ownersjointly.

InwhatcasesarePattatransferred?
IfanownerhavingaPattainhisname,dieswithoutleavingawill,thelegalheirsofthedeceasedperson
areentitledtohavePattaforthepropertyintheirnames.
In the case of a person leaving a Will, Patta can be transferred to the beneficiary with the consent of
otherswhowillbetheimmediateheirsofthedeceasedperson.
Incaseofpurchase/saleofproperties,itispossibletohavethePattadirectlyinthenameofapurchaser
oratransferee.
