This SETTLEMENT, made and entered into by and among:

1. NORBERTO A. ROMUALDEZ III, of legal age, Filipino,
married and a resident of #408 Joe MacArthur Drive,
Apartment D-1, Armherst N.Y., USA 14228
2. AMPARO R. TAN, of legal age, Filipino, married and a
resident of Brgy. Alegria, Ormoc City
3. TERESITA R. ABIVA, of legal age, Filipino, married and a
resident of #9 M. Agoncillo Place, Ayala Heights, Quezon City
4. CATALINA A. ROMUALDEZ, of legal age, Filipino, single and
a resident of # 9 M. Agoncillo Place, Ayala Heights, Q.C.
5. JOSEFINA R. HOCSON (deceased, September 1, 2002),

WITNESSETH:
1. The decedent spouses NORBERTO BUZ ROMUALDEZ JR. ( +
August 30, 1972) and ROSA AGUINALDO ROMUALDEZ ( + June 25,

2. That the parties hereto are the sole and only heirs of the
deceased spouses entitled to succeed to their estate, they being the
legitimate children of their marital union;
3. That there are no known debts or obligations due against the
estate of the decedents; That no personal properties are involved in
this extra-judicial settlement;
4. That it is to the best interest of the herein parties to divide,
partition, and adjudicate amongst themselves the entire estate
particularly the real properties above described extrajudicially;
5. NOW THEREFORE, for and in consideration of the foregoing
premises, and invoking the provision of Section 1, Rule 74 of the Rules
of Court, the parties hereto have agreed to divide, partition and
adjudicate the above described estate among themselves in (pro
indiviso) equal share; Subject, however, to contingent liabilities to
creditors, heirs or other persons who might have been deprived of
lawful participation of the estate of the decedents, for a period of two
(2) years from and after the settlement and distribution thereof, in
accordance with the provision of Section 4, Rule 74 of the Rules of
Court; and
That in the remote event that any other property of the
decedents should ever be found which is not included hereinabove, the
parties hereto further agree as they do so agree to settle and distribute
the same in like manner and proportion as herein established and
disposed.
